153	153		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
154	154		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1283, as
155	155		amended by Section 1, Chapter 299, O.S.L. 2022 (21 O.S. Supp. 2022,
156	156		Section 1283), is amended to re ad as follows:
157	157		Section 1283. CONVICTED FELONS AND DELINQUENTS
158	158		A. Except as provided in subsection B of this section, it shall
159	159		be unlawful for any person co nvicted of any felony in any court of
160	160		this state or of another state or of the Unit ed States to have in
161	161		his or her possession or under his or her immediate control, or in
162	162		any vehicle which the person is operating, or at the residence where
163	163		the convicted person resides, any pistol, imitation or h omemade
164	164		pistol, altered air or toy pistol, machine gun, sawed-off shotgun or
165	165		sawed-off rifle, or any other firearm.
166	166		B. Any person who has previously been convicted of a nonviolent
167	167		felony in any court of this state or of another s tate or of the
168	168		United States, and who has received a full and complete pardon from
169	169		the proper authority and has not been convicted of any other felony
170	170		offense which has not been pardoned, shall have restored the right
171	171		to possess any firearm or other weapon prohibited by subsection A of
172	172		this section, the right to apply for and carry a handgun, concealed
173	173		or unconcealed, pursuant to the provisions of the Oklahoma Self-
174	174		Defense Act or as otherwise permitted by law, and have the right to

226	226		perform the duties of a peace officer, gunsmith, and for firearms
227	227		repair.
228	228		C. It shall be unlawful for any person serving a term of
229	229		probation for any felony in an y court of this state or of another
230	230		state or of the United States or under the jurisdiction of any
231	231		alternative court program to have in his or her possession or under
232	232		his or her immediate control, or at his or her residence, or in any
233	233		passenger vehicle whi ch the person is operating, any pistol, shotgun
234	234		or rifle including any imitat ion or homemade pistol, altered air or
235	235		toy pistol, toy shotgun or toy rifle, while such person is subject
236	236		to supervision, probation, parole or inmate status.
237	237		D. It shall be unlawful for any person previously adjudicated
238	238		as a delinquent child or a youth ful offender for the commission of
239	239		an offense, which would have constituted a felony offense if
240	240		committed by an adult, to have in the possession of the person or
241	241		under the immediate control of the person, or have in any vehicle
242	242		which he or she is driving , or at the residence of the person, any
243	243		pistol, imitation or homemade pistol, altered air or toy pistol,
244	244		machine gun, sawed-off shotgun or sawed-off rifle, or any other
245	245		dangerous or deadly firearm within ten (10) years after such
246	246		adjudication; provided, that nothing in this subsection shall be
247	247		construed to prohibit the placement of the person in a home with a
248	248		full-time duly appointed peace officer who is certified by the
249	249		Council on Law Enforcement Education and Training (CLEET) pursuant

301	301		to the provisions of Section 3311 of Title 70 of the Oklahoma
302	302		Statutes.
303	303		E. It shall be unlawful for any person w ho is an alien
304	304		illegally or unlawfully in the United States to have in the
305	305		possession of the person or under the immediate control of the
306	306		person, or in any vehicle the person is operating, or at the
307	307		residence where the person resides, any pistol, imitation or
308	308		homemade pistol, altered air or toy pistol, shotgun, rifle or any
309	309		other dangerous or d eadly firearm; provided, that nothing in this
310	310		subsection applies to prohibit the tra nsport or detention of the
311	311		person by law enforcement officers or federal immigrati on
312	312		authorities. Any person who violates the provisions of this
313	313		subsection shall, upon con viction, be guilty of a misdemeanor
314	314		punishable by a fine of Two Hundred Fifty Dollar s ($250.00).
315	315		F. It shall be unlawful for any person :
316	316		1. Convicted of misdemeanor domestic abuse under subsection C
317	317		of Section 644 of this tit le;
318	318		2. Convicted of misdemeanor stalking under paragraph 2 of
319	319		subsection A of Sectio n 1173 of this title ;
320	320		3. Convicted of a misdemeanor crime of domestic violenc e as
321	321		defined in 18 U.S.C. Section 921(a)(33)(A) in any court of this
322	322		state or of another state or of the United States ; or
323	323		4. Subject to a final protective order issued pursuant to
324	324		subsection C of Section 60.4 of Title 22 of the Oklahoma Statutes or

376	376		a foreign protective order that qual ifies as an order described in
377	377		18 U.S.C. Section 922(d)(8) or (g)(8),
378	378		to have in his or her possession, under his or her immediate
379	379		control, in any vehicle which the person is operating or in which
380	380		the person is riding as a passenger, or at the residence w here the
381	381		convicted person resides, any p istol, imitation or homemade pistol,
382	382		altered air or toy pistol, machine gun, sh otgun or rifle, or any
383	383		other dangerous or dea dly firearm.
384	384		G. Any person having been issued a handgun license pursuant to
385	385		the provisions of the Oklahoma Self-Defense Act and who knowingly or
386	386		intentionally allows a convicted felon or adjudicated delinquent or
387	387		a youthful offender as prohi bited by the provisions of subsection A,
388	388		C, or D of this section to possess or have control of any firearm
389	389		authorized by the Oklahoma Self-Defense Act shall, upon conv iction,
390	390		be guilty of a felony punishable by a fine no t to exceed Five
391	391		Thousand Dollars ($5,000.00). In addition, the person shall have
392	392		the any handgun license revoked by the Oklahoma State Bureau of
393	393		Investigation after a hearing and determination that the per son has
394	394		violated the provisions of this section.
395	395		G. H. Any convicted or adju dicated person violating the
396	396		provisions of this section shall, upon conviction, be guilty of a
397	397		felony punishable as provided in Section 1284 of this title.

449	449		H. I. For purposes of this section, "sawed-off shotgun" or
450	450		"sawed-off rifle" shall mean any shotgun or rifle which the barrel
451	451		or barrels have been illegally shortened in length.
452	452		I. For purposes of this section, "altered toy pistol" shall
453	453		mean any toy weapon which has been altered from its original
454	454		manufactured state to resemble a real wea pon.
455	455		J. For purposes of this section, "altered:
456	456		1. "Altered air pistol" shall mean any means an air pistol
457	457		manufactured to propel projectiles by air pressure which has been
458	458		altered from its origina l manufactured state.;
459	459		2. "Altered toy pistol" means a toy weapon which has been
460	460		altered from its original manufactured sta te to resemble a real
461	461		weapon;
462	462		K. For purposes of this section, "alternative 3. "Alternative
463	463		court program" shall mean any means a drug court, Anna McBride or
464	464		mental health court, DUI court or veterans court; and
465	465		4. "Sawed-off shotgun" or "sawed-off rifle" means a shotgun or
466	466		rifle on which the barrel or barrels have been illegally shortened .
467	467		SECTION 2. NEW LAW A new section of law to be codified
468	468		in the Oklahoma Statutes as Section 60.10 of Title 22, unless there
469	469		is created a duplication in numb ering, reads as follows:
470	470		A. When a person is convicted of domestic abuse pursuant to
471	471		Section 644 of Title 21 of the Oklahoma Statutes , stalking pursuant
472	472		to Section 1173 of Title 21 of the Oklahoma Statutes , or becomes

524	524		subject to a final pro tective order pursuant to Section 60.4 of
525	525		Title 22 of the Oklahoma Statutes, the court shall, at t he time of
526	526		conviction or issuance of the protective order :
527	527		1. Indicate in the judgment of conviction or protective order
528	528		that the person is prohibited from possessing a firearm pursuant to
529	529		subsection F of Section 1283 of Ti tle 21 of the Oklahoma Stat utes;
530	530		2. Order in writing that the person transfer all firear ms and
531	531		any handgun license issued pursuant to the provisions of the
532	532		Oklahoma Self-Defense Act in the person's possession in accordance
533	533		with subsection B of thi s section; and
534	534		3. Order that the person file a declaration as described in
535	535		subsection D of this section.
536	536		B. Excluding legal holida ys and weekends, within twenty-four
537	537		(24) hours of becoming subject to a court order under paragraph 2 of
538	538		subsection A of this sectio n, a person shall transfer al l firearms
539	539		and any handgun license in the person's possession to a law
540	540		enforcement agency within the municipality or county in which the
541	541		person resides or to a licensed dealer as defined in paragraph 1 of
542	542		subsection A of Sectio n 1289.28 of Title 21 of the Oklahoma
543	543		Statutes, and shall obtain a proof of transfer unde r subsection C of
544	544		this section. If the person is incarcerated at the time the order
545	545		is issued, the person shall transfer the firearms and any handgun
546	546		license no later than twenty-four (24) hours after release from
547	547		incarceration, exclusive of legal holiday s and weekends.

599	599		C. A law enforcement agency or licensed dealer receiving a
600	600		firearm or handgun license pursuant to this subsection shall issue
601	601		to the person a written proof of transfer. The proof of transfer
602	602		shall include the name of the person, the date of transfer and the
603	603		serial number and make and model of each transferred firearm.
604	604		D. Exclusive of legal holidays and weekends, within forty-eight
605	605		(48) hours of becoming subject to a court order under par agraph 2 of
606	606		subsection A of this section, a person shall file with the court a
607	607		declaration under penalty of perjury attesting that:
608	608		1. All firearms and any handgun licens e in the person's
609	609		possession have been transferr ed under subsection B of this section
610	610		to a law enforcement agency or licensed dealer ;
611	611		2. The person was not in possession of any firearms or handgun
612	612		license at the time of the court order and continues to not possess
613	613		any firearms or handgun license; or
614	614		3. The person is asserting the person 's constitutional right
615	615		against self-incrimination.
616	616		E. The person shall file with the declaration a copy of the
617	617		proof of transfer, if applicable.
618	618		F. A person in possession of a firearm in violation of
619	619		subsection F of Section 1283 of Title 21 of the Oklahoma Statutes
620	620		shall not be prosecuted for t hat violation if:

672	672		1. The person is in possession of a c ourt order described in
673	673		paragraph 2 of subsection A of this section that was issued within
674	674		the previous twenty-four (24) hours;
675	675		2. The firearm is unloaded; an d
676	676		3. The person is transporting the fire arm or ammunition to a
677	677		law enforcement agency or federally licensed dealer in accordance
678	678		with subsection B of this section.
679	679		G. Upon the expiration or termination of a protective order, at
680	680		the request of the person, a law enforcement agency or licensed
681	681		dealer shall return any stored firearms and handgun license to the
682	682		person after performing a check of the National Instant Criminal
683	683		Background Check System (NICS) to confirm that th e person is not
684	684		prohibited from posse ssing a firearm or ammunition under state or
685	685		federal law.
686	686		H. If the person does not file a declaration described in
687	687		subsection D of this section, the court may commence contempt
688	688		proceedings pursuant to Section 567 of Title 21 of the Oklahoma
689	689		Statutes.
690	690		I. On application by a law enforcement offi cer based on
691	691		probable cause to believe that the person has failed to tran sfer one
692	692		or more firearms in accordance with this section, the court may
693	693		authorize the execution of a sea rch warrant for the removal of
694	694		firearms from any location where the court has probabl e cause to
695	695		believe a firearm possessed by the person is located.

747	747		J. 1. A law enforcement agency may enter into an agreement
748	748		with another law enforcement agency or storag e facility for the
749	749		storage of transferred firearms or handgun licenses. A law
750	750		enforcement agency may charge a fee for storage which shall not
751	751		exceed the costs incurred by the law enforcement agency for
752	752		providing storage.
753	753		2. Law enforcement agencies may promulgate rules and procedures
754	754		pertaining to the storage and disposal of firearms and handgun
755	755		licenses that are transferred in accordance w ith this section.
756	756		SECTION 3. AMENDATORY 22 O.S. 2021, Section 60.11, as
757	757		amended by Section 8, Chapter 318, O.S.L. 2022 (22 O.S. Supp. 2022,
758	758		Section 60.11), is amended to read as fo llows:
759	759		Section 60.11. In addition to any other provisions re quired by
760	760		the Protection from Domestic Abuse Act, or otherwise requ ired by
761	761		law, each ex parte or final protective order issued pursuant to the
762	762		Protection from Domestic Abuse Act shall have a statement printed in
763	763		bold-faced type or in capital letters contai ning the following
764	764		information:
765	765		1. The filing or nonfiling of criminal charges and the
766	766		prosecution of the case shall not be determined by a pe rson who is
767	767		protected by the protective order, but shall be determined by t he
768	768		prosecutor;
769	769		2. No person, including a person who is prote cted by the order,
770	770		may give permission to anyone to ignore or violate any provision of

822	822		the order. During the time in wh ich the order is valid, every
823	823		provision of the order shall be in full force and effect unless a
824	824		court changes the order;
825	825		3. The order shall be in effect for a fixed period of five (5)
826	826		years unless extended, modified, vacated or rescinded by the court
827	827		or shall be continuous upon a specific finding by the court as
828	828		provided in subparagraph b of paragraph 1 of subsectio n G of Section
829	829		60.4 of this title unless modified, vacated or rescinded by the
830	830		court;
831	831		4. The order shall be entered into the National Crime
832	832		Information Center (NCIC) database;
833	833		5. A violation of the order is punishabl e by a fine of up to
834	834		One Thousand Dollars ($1,000.00) or imprisonment for up to one (1)
835	835		year in the county jail, or by both such fine and imprisonment. A
836	836		violation of the order whi ch causes injury is punishable by
837	837		imprisonment for twenty (20) days to one (1) year in the county jail
838	838		or a fine of up to Five Thousand Dollars ($5,000.00), o r by both
839	839		such fine and imprisonment;
840	840		6. Possession of a firearm or ammunition by a defendant while
841	841		an a final order is in effect may subject the defendant to
842	842		prosecution for a violation of federal law even if the order does
843	843		not specifically prohibit the d efendant from possession of a firearm

897	897		7. The defendant must avoid the residence of the petitioner or
898	898		any premises temporarily occupied by the petitioner;
899	899		8. The defendant must avoid contact that harasses or
900	900		intimidates the petitioner. Contact includes, but is not limited
901	901		to, contact at the home, work, or school of the petitioner, public
902	902		places, in person, by phone, in writing, by electronic communication
903	903		or device, or in any other manner;
904	904		9. The defendant shall not impersonate or adopt the
905	905		personification of the petitioner by pretending to be the
906	906		petitioner, ordering items, posting information or ma king inquiries,
907	907		or publishing photographs of the petitioner, by use of social media,
908	908		or by use of computer, telephone, texting, emailing, or by use of
909	909		any electronic means;
910	910		10. The defendant must refrain from removing, hid ing, damaging,
911	911		harming, mistreating, or disposing of a household pet;
912	912		11. The defendant must allow the petitioner or a family member
913	913		or household member of the petitioner acting on his or her behalf to
914	914		retrieve a household pet;
915	915		12. The defendant must avoid contacting the petitioner or
916	916		causing any person other than an attorney for the petitioner or law
917	917		enforcement officer to contact the petitioner unless the petitioner
918	918		consents in writing; and
