77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 17 9.1 of Title 13, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	A. As used in this act:
82	82	1. “Electronic communication service ” means a service that
83	83	provides to users of the service the ability to send or receive wire
84	84	or electronic communications;
85	85	2. “Electronic device” means a device that enables access to or
86	86	use of an electronic communication service or remote computing
87	87	service or location information service ;

139	139	3. “Government entity” means the state, a county, a
140	140	municipality, a higher education institution, a local distri ct, a
141	141	special service district or any other politica l subdivision of the
142	142	state or an administrative subunit of any political subdivision
143	143	including a law enforcement entity or any other investigative
144	144	entity, agency, department, division, bureau, board or co mmission,
145	145	or an individual acting or purporting to a ct for or on behalf of a
146	146	state or local agency;
147	147	4. “Location information ” means information concerning the
148	148	location of an electronic device that, in whole or in part , is
149	149	generated or derived from or obta ined by the operation of an
150	150	electronic device;
151	151	5. “Location information service ” means the provision of a
152	152	global positioning service or other mapping, locational or
153	153	directional information service;
154	154	6. “Metadata” means the structural information of an ele ctronic
155	155	file that contains data about the file itsel f rather than the
156	156	content of the file. The term includes but is not limited to hidden
157	157	text, formatting codes and formulae, and includes all contextual,
158	158	processing and use information necessary to identif y and certify the
159	159	scope, authenticity and integrity of active or archival electronic

212	212	7. “Remote computing service ” means the provision of computer
213	213	storage or processing services by means of an electronic
214	214	communications system;
215	215	8. “Stored data” means data or records that are stored on an
216	216	electronic device that contains:
217	217	a. information revealing the identity of users of the
218	218	applicable service, device or program,
219	219	b. information about a user ’s use of the applicable
220	220	service, device or p rogram,
221	221	c. information that identifies the recipient or
222	222	destination of a wire communication or electronic
223	223	communication sent to or by the user,
224	224	d. the content of a wire communication or electronic
225	225	communication sent to or by the user, or
226	226	e. any data, documents, files or communications stored by
227	227	or on behalf of the user with the applicable service
228	228	provider or on the user ’s electronic device; and
229	229	9. “Transmitted data” means data or records that are in the
230	230	possession, care, custody or control of a provider of a location
231	231	information service, an electronic communications service or a
232	232	remote computing service, which contains:
233	233	a. information revealing the identity of users of the
234	234	applicable service, device or program,

289	289	destination of a wire communication or electronic
290	290	communication sent to or by the user,
291	291	d. the content of a wire communication or electr onic
292	292	communication sent to or by the u ser, or
293	293	e. any data, documents, files or communicati ons stored by
294	294	or on behalf of the user with the applicable service
295	295	provider or on the user ’s electronic device.
296	296	B. Except as provided in subsection C of this section, a
297	297	government entity may not obtain t he metadata, stored data or
298	298	transmitted data of an e lectronic device without a court order or
299	299	search warrant issued by a court upon probable cause. A government
300	300	entity may not use, copy or disclose for any purpose location
301	301	information, metadata, stored data or transmitted data of an
302	302	electronic device that is not the subject of the court order or
303	303	warrant that is collected as part of an effort to obtain the
304	304	location information, metadata, stored data or transmitted data of
305	305	the electronic device that is the s ubject of the court order or
306	306	warrant. Such data sha ll be destroyed in an unrecoverable manner by
307	307	the government entity no later than twenty -four (24) hours after the
308	308	data is collected.

360	360	C. 1. A government entity shal l not obtain the location
361	361	information, metadata, stored data or transmitted data of an
362	362	electronic device without a court order or search warrant issued by
363	363	a duly authorized court, unless :
364	364	a. the device is reported stolen by the owner,
365	365	b. in response to the user’s call for emergency services,
366	366	c. the entity has the informed and affirmative consen t of
367	367	the owner or user of the electronic device, or
368	368	d. there exists a possible life -threatening situation.
369	369	2. Any evidence obtained in violation of paragraph 1 of th is
370	370	subsection shall not be admissible in any civil, criminal or
371	371	administrative proceeding and shall not be used in an affidavit of
372	372	probable cause in an effort to obtain a search warrant.
373	373	D. Notice shall be given to the user whose location
374	374	information, metadata, stored data, transmitted data o r electronic
375	375	device was searched or obtained by a go vernment entity.
376	376	SECTION 2. This act shall become effective November 1, 2023.
