49	42		Sections 2203, 2204, and 2206, which relate to the
50	43		Oklahoma Tourism and Recreation Commission; removing
51	44		function of Commission as an advisory body; providing
52	45		provision for removal of Commission members;
53	46		transferring powers from the Executive Director to
54	47		the Commission; modifying powers and duties of
55	48		Commission; authorizing Commission to appoint
56	49		Executive Director; allowing Commission to establish
57	50		salary for the Executive Director; and providing an
58	51		effective date.

63	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
64	57		SECTION 1. AMENDATORY 74 O.S. 2021, Section 2203, is
65	58		amended to read as follow s:
66	59		Section 2203. A. The Oklahoma Tourism and Recreation
67	60		Commission shall be an advisory body to the Executive Direct or of
68	61		the Oklahoma Tourism an d Recreation Department and shall consist of
69	62		eight (8) members who shall serve a term of six (6) years.
	63	+	Effective January 14, 2019, all duties and powers of the Commission
	64	+	shall be transferred to the Executive Director. Any p rovision in
	65	+	statute that provides to the Commission authority that is not

97		-	Effective January 14, 2019, all duties and powers of the Commiss ion
98		-	shall be transferred to the Executive Director. Any p rovision in
99		-	statute that provides to the Commission authority that is not
100	92		advisory in nature shall be deemed to grant the duty or power to the
101	93		Executive Director. No more than one Commission member shall be
102	94		from any one county. The Lieutenant Governor sh all serve as an ex
103	95		officio voting member of the Commission.
104	96		B. One member shall be appointed from each congressional
105	97		district, who shall be a resident and a qualified elector in the
106	98		district from which appointed, and the remaining members shall be
107	99		appointed from the state at large. If congressional districts are
108	100		redrawn each member appo inted shall complete the current term of
109	101		office at which time a new appointment shall be made in compliance
110	102		with the redrawn congressional district.
111	103		C. Commission members shall be appointed by the Gov ernor, with
112	104		the advice and consent of the Senate, and shall serve at the
113	105		pleasure of the may be removed with cause by the Governor. Whenever
114	106		a vacancy on the Commission occurs by death, resignation, or
115	107		otherwise, the Governor shall fill the same by appoin tment, with the
116	108		advice and consent of the Senate, and t he appointee shall hold
117	109		office during the unexpired term. Each member shall hold office
118	110		until a successor has been appointed and qualified.

	112	+	Commission shall seek election to a federal, state, or c ounty office
	113	+	while serving on the Commission.

149		-	SECTION 2. AMENDATORY 74 O.S. 2021, Section 2204, is
150		-	amended to read as follow s:
151	142		Section 2204. There are hereby granted to and imposed in the
152	143		Oklahoma Tourism and Recreation Department Commission, and in any
153	144		commission or body which may hereafter succeed to the powers,
154	145		rights, and duties of the Commission, the following additional
155	146		powers, rights and d uties:
156	147		1. Sue and be sued;
157	148		2. Adopt, use, and alter an official seal;
158	149		3. Make bylaws for the management and regulation of its
159	150		affairs;
160	151		4. Appoint, prescribe the duties, and fix the compensation for
161	152		officers, agents, and employees;
162	153		5. Make contracts an d execute instruments as in the judgment of
163	154		the Department Commission are necessary or convenient to the
164	155		exercise of the powers conferred upon it by law; and
165	156		6. Promulgate rules and policies necessary and convenient to
166	157		the exercise of the powers conferred upon it by law.
167	158		SECTION 3. AMENDATORY 74 O.S. 2021, Section 2206, is
168	159		amended to read as follow s:
	160	+	Section 2206. The chief executive officer of the Oklahoma
	161	+	Tourism and Recreation D epartment shall be the Execut ive Director,
	162	+	who shall be appointed by the Governor, with the advice and consent
	163	+	of the Senate, Commission and who shall serve at the pleasure of the
	164	+	Governor and may be r emoved or replaced without cause Commission.
