86	86	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
87	87	SECTION 1. NEW LAW A new sec tion of law to be codified
88	88	in the Oklahoma Statutes as Section 1371.1 of Title 59, unless there
89	89	is created a duplication in numbering, reads as follows:
90	90	As used in this act:
91	91	1. “Board” means, unless otherwise explicitly stated, the State
92	92	Board of Examiners of Psychologists;

144	144	2. “Conditional prescription ce rtificate” means a document
145	145	issued by the State Board of Examiners of Psychologists to a
146	146	licensed psychologist th at permits the holder to prescribe
147	147	psychotropic medication under the supervision of a super vising
148	148	physician pursuant to this act;
149	149	3. “Prescription certificate ” means a document issued by the
150	150	State Board of Examiners of Psychologists to a licensed psycholo gist
151	151	that permits the holder to presc ribe psychotropic medication
152	152	pursuant to this act;
153	153	4. “Psychologist” has the same meaning as provided in Section
154	154	1352 of Title 59 of the Oklahoma S tatutes;
155	155	5. “Psychotropic medication ” means a controlled substance or
156	156	drug that may not be dispensed or adm inistered without a
157	157	prescription and whose primary use has been approved by the federal
158	158	Food and Drug Administration for the treatment of mental disorders
159	159	or is listed as a psychotherapeutic agent in Drug Facts and
160	160	Comparisons 2017, or the most recent edit ion of that book, or in
161	161	American Hospital Formulary Se rvice Drug Information, and includes
162	162	antidepressants, anti -anxiety, stimulants, antipsychotics, and mood
163	163	stabilizers; and
164	164	6. “Supervising physician ” means a licensed allopathic
165	165	physician or osteopathic physician who is supervising a psychologist
166	166	in the prescribing of psychotropic medication under this act.

221	221	A. A licensed psychologist holding a conditional prescription
222	222	certificate may prescribe psychotropi c medication under the
223	223	supervision of a supervising physician pursuant to this act.
224	224	B. A licensed psychologist holding a prescription certificate
225	225	may prescribe psychotropic medication independent of the supervision
226	226	of a supervising physician pursuant to this act.
227	227	SECTION 3. NEW LAW A new secti on of law to be codified
228	228	in the Oklahoma Statutes as Section 1371.3 of Title 59, unless there
229	229	is created a duplication in numbering, reads as follows:
230	230	A. A psychologist may apply to the State Board of Examiners of
231	231	Psychologists for a conditional prescript ion certificate. The
232	232	application shall be made on a form approved by the Board and be
233	233	accompanied by evidence satisfactory to the Board that the
234	234	applicant:
235	235	1. Has completed a doctoral program in psychology from an
236	236	accredited institution of higher educati on or professional school,
237	237	or, if the program was not accredited at the time of the applicant’s
238	238	graduation, that the program meets professional standards determined
239	239	acceptable by the Board;
240	240	2. Holds a current license to practice psychology in this
241	241	state;

294	294	degree in psychopharmacolog y from an institution of higher education
295	295	approved by the State Board of Examiners of Psychologists , the State
296	296	Board of Medical Licensure and Supervision, and the S tate Board of
297	297	Osteopathic Examiners;
298	298	4. Has passed a national certification examination app roved by
299	299	the State Board of Examiners of Psychologists , the State Board of
300	300	Medical Licensure and Supervision, and the S tate Board of
301	301	Osteopathic Examiners that tests the applicant’s knowledge of
302	302	pharmacology in the diagnosis, care , and treatment of mental
303	303	disorders;
304	304	5. Within the five (5) years immediately preceding the date of
305	305	application, has successfully completed an organized program of
306	306	education approved by the State Board of Examiners of Psychologi sts,
307	307	the State Board of Medical Licensure and Supervi sion, and the State
308	308	Board of Osteopathic Examiners and consisting of didactic
309	309	instruction of no fewer than four hundred fifty (450) classroom
310	310	hours in at least the fo llowing core areas of instruction:
311	311	a. neuroscience,
312	312	b. pharmacology,
313	313	c. psychopharmacology,
314	314	d. physiology,
315	315	e. pathophysiology,

368	368	assessment, and
369	369	g. clinical pharmacotherapeutics ;
370	370	6. Within the five (5) years immediately preceding the date of
371	371	application, has been certified by each of the applic ant’s
372	372	supervising physicians as having successfully completed a supervised
373	373	and relevant clinical experience, approved by the State Board of
374	374	Examiners of Psychologists , the State Board of Medical Licensure and
375	375	Supervision, and the S tate Board of Osteopathic Examiners of:
376	376	a. no less than an eighty -hour practicum in clinical
377	377	assessment and pathophysiology under the supervision
378	378	of a licensed allopathic or osteopathic physician, and
379	379	b. an additional supervised practicum of at least four
380	380	hundred (400) hours treating no fewer than one hundred
381	381	patients with mental disorders, the practic um to have
382	382	been supervised by any one or a c ombination of a
383	383	psychiatrist or other appropriate ly trained licensed
384	384	allopathic or osteopathic physician and determined by
385	385	the State Board of Examiners of Psychologis ts, the
386	386	State Board of Medical Licensure and Supervision, and
387	387	the State Board of Osteopathic Examiners to be
388	388	sufficient to competently train the applicant in the
389	389	treatment of a diverse patient population. One-to-one

441	441	supervision shall be provided either fa ce-to-face,
442	442	telephonically or by video conference .
443	443	B. The State Board of Examiners of Psychologists shall issue a
444	444	conditional prescription certificate if it finds that the appli cant
445	445	has met the requirements of subsection A of this section. The
446	446	certificate shall be valid for a period of two (2) years, at the end
447	447	of which the holder may again apply pursuant to the provisions of
448	448	subsection A of this section.
449	449	C. A psychologist with a conditional prescription certificate
450	450	may prescribe psychotropic medication under the supervision of a
451	451	supervising physician subject to the following conditions:
452	452	1. The psychologist shall continue to hold a current license to
453	453	practice psychology in this state and shall maintain malpractice
454	454	insurance in accordance with rules prescribed by the Board;
455	455	2. The psychologist shall notify the Board of the name of the
456	456	psychologist’s supervising physician; and
457	457	3. A supervising physician shall notify the supervis ing
458	458	physician’s own licensing board of the name of each psychologist
459	459	under the supervising physician’s supervision.
460	460	D. A supervising physician shall not be liable for the acts of
461	461	a psychologist under the supervising physician’s supervision unless
462	462	the injury or loss arises from those acts under the directi on and
463	463	control of the supervising physician.

518	518	A. A psychologist may apply to the State Board of Examiners of
519	519	Psychologists for a prescription certificate. The application shall
520	520	be made on a form approved by the Board and be accompanied by
521	521	evidence satisfactory to the Board that the applicant:
522	522	1. Has been issued a conditional pre scription certificat e and
523	523	has successfully completed two (2) years of prescribing psychotropic
524	524	medication as certified by the supervising physician;
525	525	2. Has successfully undergone a process of independent peer
526	526	review approved by th e State Board of Examiner s of Psychologists,
527	527	the State Board of Medical Licensure and Supervision, and the S tate
528	528	Board of Osteopathic Examiners ;
529	529	3. Holds a current license to pra ctice psychology in this
530	530	state;
531	531	4. Has malpractice insurance in place, suffi cient to satisfy
532	532	the rules adopted by the State Board of Examiners of Psychologists ,
533	533	that will cover the applicant as a prescribing psyc hologist; and
534	534	5. Meets all other requirements, as determined by rule s of the
535	535	State Board of Examiners of Psychologists , for obtaining a
536	536	prescription certificate.

591	591	C. A psychologist with a prescript ion certificate may presc ribe
592	592	psychotropic medication pursuant to the provisions of this act if
593	593	the psychologist:
594	594	1. Continues to hold a current license to practice psychology
595	595	in this state and continues to maintain malpractice insurance; and
596	596	2. Annually satisfies the continuing education requirements for
597	597	prescribing psychologists, as set by the Board, which shall be no
598	598	fewer than twenty (20) hours each year.
599	599	SECTION 5. NEW LAW A n ew section of law to be codified
600	600	in the Oklahoma Statutes as Section 1371.5 of Title 59, unless there
601	601	is created a duplication in numbering, reads as follows:
602	602	A. The State Board of Examiners of Psychologists shall
603	603	promulgate rules providing for the proced ures to be followed in
604	604	obtaining a conditional pres cription certificate, a p rescription
605	605	certificate, and renewals of a pr escription certificate. The Board
606	606	may set reasonable application and renewal fees.
607	607	B. The State Board of Examiners of Psychologists shall
608	608	promulgate rules establishing the grounds for denial, suspension, or
609	609	revocation of conditional prescription certificates and prescription
610	610	certificates authorized to be issued pursuant to this act, including
611	611	a provision for suspension or revocation of a license to practice
