8686 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
8787 SECTION 1. NEW LAW A new sec tion of law to be codified
8888 in the Oklahoma Statutes as Section 1371.1 of Title 59, unless there
8989 is created a duplication in numbering, reads as follows:
9090 As used in this act:
9191 1. “Board” means, unless otherwise explicitly stated, the State
9292 Board of Examiners of Psychologists;

144144 2. “Conditional prescription ce rtificate” means a document
145145 issued by the State Board of Examiners of Psychologists to a
146146 licensed psychologist th at permits the holder to prescribe
147147 psychotropic medication under the supervision of a super vising
148148 physician pursuant to this act;
149149 3. “Prescription certificate ” means a document issued by the
150150 State Board of Examiners of Psychologists to a licensed psycholo gist
151151 that permits the holder to presc ribe psychotropic medication
152152 pursuant to this act;
153153 4. “Psychologist” has the same meaning as provided in Section
154154 1352 of Title 59 of the Oklahoma S tatutes;
155155 5. “Psychotropic medication ” means a controlled substance or
156156 drug that may not be dispensed or adm inistered without a
157157 prescription and whose primary use has been approved by the federal
158158 Food and Drug Administration for the treatment of mental disorders
159159 or is listed as a psychotherapeutic agent in Drug Facts and
160160 Comparisons 2017, or the most recent edit ion of that book, or in
161161 American Hospital Formulary Se rvice Drug Information, and includes
162162 antidepressants, anti -anxiety, stimulants, antipsychotics, and mood
163163 stabilizers; and
164164 6. “Supervising physician ” means a licensed allopathic
165165 physician or osteopathic physician who is supervising a psychologist
166166 in the prescribing of psychotropic medication under this act.

221221 A. A licensed psychologist holding a conditional prescription
222222 certificate may prescribe psychotropi c medication under the
223223 supervision of a supervising physician pursuant to this act.
224224 B. A licensed psychologist holding a prescription certificate
225225 may prescribe psychotropic medication independent of the supervision
226226 of a supervising physician pursuant to this act.
227227 SECTION 3. NEW LAW A new secti on of law to be codified
228228 in the Oklahoma Statutes as Section 1371.3 of Title 59, unless there
229229 is created a duplication in numbering, reads as follows:
230230 A. A psychologist may apply to the State Board of Examiners of
231231 Psychologists for a conditional prescript ion certificate. The
232232 application shall be made on a form approved by the Board and be
233233 accompanied by evidence satisfactory to the Board that the
234234 applicant:
235235 1. Has completed a doctoral program in psychology from an
236236 accredited institution of higher educati on or professional school,
237237 or, if the program was not accredited at the time of the applicant’s
238238 graduation, that the program meets professional standards determined
239239 acceptable by the Board;
240240 2. Holds a current license to practice psychology in this

293293 3. Has successfully completed a post doctoral master of science
294294 degree in psychopharmacolog y from an institution of higher education
295295 approved by the State Board of Examiners of Psychologists , the State
296296 Board of Medical Licensure and Supervision, and the S tate Board of
297297 Osteopathic Examiners;
298298 4. Has passed a national certification examination app roved by
299299 the State Board of Examiners of Psychologists , the State Board of
300300 Medical Licensure and Supervision, and the S tate Board of
301301 Osteopathic Examiners that tests the applicant’s knowledge of
302302 pharmacology in the diagnosis, care , and treatment of mental
303303 disorders;
304304 5. Within the five (5) years immediately preceding the date of
305305 application, has successfully completed an organized program of
306306 education approved by the State Board of Examiners of Psychologi sts,
307307 the State Board of Medical Licensure and Supervi sion, and the State
308308 Board of Osteopathic Examiners and consisting of didactic
309309 instruction of no fewer than four hundred fifty (450) classroom
310310 hours in at least the fo llowing core areas of instruction:
311311 a. neuroscience,
312312 b. pharmacology,
313313 c. psychopharmacology,
314314 d. physiology,
315315 e. pathophysiology,

368368 assessment, and
369369 g. clinical pharmacotherapeutics ;
370370 6. Within the five (5) years immediately preceding the date of
371371 application, has been certified by each of the applic ant’s
372372 supervising physicians as having successfully completed a supervised
373373 and relevant clinical experience, approved by the State Board of
374374 Examiners of Psychologists , the State Board of Medical Licensure and
375375 Supervision, and the S tate Board of Osteopathic Examiners of:
376376 a. no less than an eighty -hour practicum in clinical
377377 assessment and pathophysiology under the supervision
378378 of a licensed allopathic or osteopathic physician, and
379379 b. an additional supervised practicum of at least four
380380 hundred (400) hours treating no fewer than one hundred
381381 patients with mental disorders, the practic um to have
382382 been supervised by any one or a c ombination of a
383383 psychiatrist or other appropriate ly trained licensed
384384 allopathic or osteopathic physician and determined by
385385 the State Board of Examiners of Psychologis ts, the
386386 State Board of Medical Licensure and Supervision, and
387387 the State Board of Osteopathic Examiners to be
388388 sufficient to competently train the applicant in the
389389 treatment of a diverse patient population. One-to-one

441441 supervision shall be provided either fa ce-to-face,
442442 telephonically or by video conference .
443443 B. The State Board of Examiners of Psychologists shall issue a
444444 conditional prescription certificate if it finds that the appli cant
445445 has met the requirements of subsection A of this section. The
446446 certificate shall be valid for a period of two (2) years, at the end
447447 of which the holder may again apply pursuant to the provisions of
448448 subsection A of this section.
449449 C. A psychologist with a conditional prescription certificate
450450 may prescribe psychotropic medication under the supervision of a
451451 supervising physician subject to the following conditions:
452452 1. The psychologist shall continue to hold a current license to
453453 practice psychology in this state and shall maintain malpractice
454454 insurance in accordance with rules prescribed by the Board;
455455 2. The psychologist shall notify the Board of the name of the
456456 psychologist’s supervising physician; and
457457 3. A supervising physician shall notify the supervis ing
458458 physician’s own licensing board of the name of each psychologist
459459 under the supervising physician’s supervision.
460460 D. A supervising physician shall not be liable for the acts of
461461 a psychologist under the supervising physician’s supervision unless
462462 the injury or loss arises from those acts under the directi on and
463463 control of the supervising physician.

516516 in the Oklahoma Statutes as Section 1371.4 of Title 59, unless there
517517 is created a duplication in numbering, reads as follows:
518518 A. A psychologist may apply to the State Board of Examiners of
519519 Psychologists for a prescription certificate. The application shall
520520 be made on a form approved by the Board and be accompanied by
521521 evidence satisfactory to the Board that the applicant:
522522 1. Has been issued a conditional pre scription certificat e and
523523 has successfully completed two (2) years of prescribing psychotropic
524524 medication as certified by the supervising physician;
525525 2. Has successfully undergone a process of independent peer
526526 review approved by th e State Board of Examiner s of Psychologists,
527527 the State Board of Medical Licensure and Supervision, and the S tate
528528 Board of Osteopathic Examiners ;
529529 3. Holds a current license to pra ctice psychology in this
530530 state;
531531 4. Has malpractice insurance in place, suffi cient to satisfy
532532 the rules adopted by the State Board of Examiners of Psychologists ,
533533 that will cover the applicant as a prescribing psyc hologist; and
534534 5. Meets all other requirements, as determined by rule s of the
535535 State Board of Examiners of Psychologists , for obtaining a
536536 prescription certificate.

588588 B. The State Board of Examiners of Psychologists shall issue a
589589 prescription certificate if it finds that the applicant has met the
590590 requirements of subsection A of this section.
591591 C. A psychologist with a prescript ion certificate may presc ribe
592592 psychotropic medication pursuant to the provisions of this act if
593593 the psychologist:
594594 1. Continues to hold a current license to practice psychology
595595 in this state and continues to maintain malpractice insurance; and
596596 2. Annually satisfies the continuing education requirements for
597597 prescribing psychologists, as set by the Board, which shall be no
598598 fewer than twenty (20) hours each year.
599599 SECTION 5. NEW LAW A n ew section of law to be codified
600600 in the Oklahoma Statutes as Section 1371.5 of Title 59, unless there
601601 is created a duplication in numbering, reads as follows:
602602 A. The State Board of Examiners of Psychologists shall
603603 promulgate rules providing for the proced ures to be followed in
604604 obtaining a conditional pres cription certificate, a p rescription
605605 certificate, and renewals of a pr escription certificate. The Board
606606 may set reasonable application and renewal fees.
607607 B. The State Board of Examiners of Psychologists shall
608608 promulgate rules establishing the grounds for denial, suspension, or
609609 revocation of conditional prescription certificates and prescription
610610 certificates authorized to be issued pursuant to this act, including
611611 a provision for suspension or revocation of a license to practice

665665 accordance with the Administrative Procedures Act .
666666 SECTION 6. This act shall become effective November 1, 2023.
