38	39		An Act relating to workers’ compensation; amending
39	40		85A O.S. 2021, Section 69, which relates to statute
40	41		of limitations; defining term; and providing an

46	47		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
47	48		SECTION 1. AMENDATORY 85A O.S. 2021, Section 69, is
48	49		amended to read as follows:
49	50		Section 69. A. Time for Filing.
50	51		1. A claim for benefits under this act, other than a n
51	52		occupational disease, shall be barred unless it is filed with the
52	53		Workers’ Compensation Commissi on within one (1) year from the date
53	54		of the injury or, if the employee ha s received benefits under this
54	55		title for the injury, six (6) months from the date of the last
55	56		issuance of such benefits. For purposes of this section, the date
56	57		of the injury shall be defined as means the date an injury is caused
57	58		by an accident as set forth in paragraph 9 of Section 2 of this
58	59		title, and date of issuance of medical benefits means the date of
59	60		service of the medical bene fit.

86	88		2. a. A claim for compensation for disability on accoun t of
87	89		injury which is either an occupational disease or
88	90		occupational infection shall be barred unless filed
89	91		with the Commission within two (2) years from the date
90	92		of the last injurious exposure to the hazards of the
91	93		disease or infection.
92	94		b. A claim for compensation for disability on account of
93	95		silicosis or asbestosis s hall be filed with the
94	96		Commission within one (1) year after the time of
95	97		disablement, and the disablement shall occur within
96	98		three (3) years from the date of the last injurious
97	99		exposure to the hazard of silicosis or asbestosis.
98	100		c. A claim for compensation f or disability on account of
99	101		a disease condition caused by exposure to X -rays,
100	102		radioactive substances, or ionizing radiation only
101	103		shall be filed with the Commission within two (2)
102	104		years from the date the condition is made known to an
103	105		employee following exam ination and diagnosis by a
104	106		medical doctor.
105	107		3. A claim for compensation on account of death shall be barred
106	108		unless filed with the Commission within two (2) years of the date of
107	109		such a death.
108	110		4. If a claim for benefits has been timely filed under
109	111		paragraph 1 of this subsection and the employee does not:

136	139		a. make a good-faith request for a hearing to resolve a
137	140		dispute regarding the right to receive benefits,
138	141		including medical treatment, under this title within
139	142		six (6) months of the date the claim is filed, or
140	143		b. receive or seek benefits, including medical treatment,
141	144		under this title for a period of six (6) months,
142	145		then on motion by the employer, the claim shall be dismissed with
143	146		prejudice.
144	147		B. Failure to File. Failure to file a claim within the period
145	148		prescribed in subsection A of this section shall not be a bar to the
146	149		right to benefits hereunder unless objection to the failure is made
147	150		at the first hearing on the claim in which all parties in inter est
148	151		have been given a reasonable notice and opportunity to be h eard by
149	152		the Commission.
150	153		C. Persons under Disability.
151	154		1. Notwithstanding a ny statute of limitation provided for in
152	155		this act, when it is established that failure to file a claim by an
153	156		injured employee or his or her dependents was induced by fraud, the
154	157		claim may be filed within one (1) year from the time of the
155	158		discovery of the fraud.
156	159		2. Subsection A of this section shall not apply to a mental
157	160		incompetent or minor so long as the person has no gu ardian or
158	161		similar legal representative. The limitations prescr ibed in
159	162		subsection A of this section shall apply to the mental incompetent

186	190		or minor from the date of the appointment of a guardian or similar
187	191		legal representative for that person, and when no g uardian or
188	192		similar representative has been appointed, to a mino r on reaching
189	193		the age of majority.
190	194		D. A latent injury or condition shall n ot delay or toll the
191	195		limitation periods specified in this section. This subsection shall
192	196		not apply to the limitation period for occupational diseases
193	197		specified in paragraph 2 of su bsection A of this section.
194	198		SECTION 2. This act shall become effective November 1, 2023.
