3839 An Act relating to workers’ compensation; amending
3940 85A O.S. 2021, Section 69, which relates to statute

4647 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4748 SECTION 1. AMENDATORY 85A O.S. 2021, Section 69, is
4849 amended to read as follows:
4950 Section 69. A. Time for Filing.
5051 1. A claim for benefits under this act, other than a n
5152 occupational disease, shall be barred unless it is filed with the
5253 Workers’ Compensation Commissi on within one (1) year from the date
5354 of the injury or, if the employee ha s received benefits under this
5455 title for the injury, six (6) months from the date of the last
5556 issuance of such benefits. For purposes of this section, the date
5657 of the injury shall be defined as means the date an injury is caused
5758 by an accident as set forth in paragraph 9 of Section 2 of this
5859 title, and date of issuance of medical benefits means the date of
5960 service of the medical bene fit.

8688 2. a. A claim for compensation for disability on accoun t of
8789 injury which is either an occupational disease or
8890 occupational infection shall be barred unless filed
8991 with the Commission within two (2) years from the date
9092 of the last injurious exposure to the hazards of the
9193 disease or infection.
9294 b. A claim for compensation for disability on account of
9395 silicosis or asbestosis s hall be filed with the
9496 Commission within one (1) year after the time of
9597 disablement, and the disablement shall occur within
9698 three (3) years from the date of the last injurious
9799 exposure to the hazard of silicosis or asbestosis.
98100 c. A claim for compensation f or disability on account of
99101 a disease condition caused by exposure to X -rays,
100102 radioactive substances, or ionizing radiation only
101103 shall be filed with the Commission within two (2)
102104 years from the date the condition is made known to an
103105 employee following exam ination and diagnosis by a
104106 medical doctor.
105107 3. A claim for compensation on account of death shall be barred
106108 unless filed with the Commission within two (2) years of the date of
107109 such a death.
108110 4. If a claim for benefits has been timely filed under
109111 paragraph 1 of this subsection and the employee does not:

136139 a. make a good-faith request for a hearing to resolve a
137140 dispute regarding the right to receive benefits,
138141 including medical treatment, under this title within
139142 six (6) months of the date the claim is filed, or
140143 b. receive or seek benefits, including medical treatment,
141144 under this title for a period of six (6) months,
142145 then on motion by the employer, the claim shall be dismissed with
143146 prejudice.
144147 B. Failure to File. Failure to file a claim within the period
145148 prescribed in subsection A of this section shall not be a bar to the
146149 right to benefits hereunder unless objection to the failure is made
147150 at the first hearing on the claim in which all parties in inter est
148151 have been given a reasonable notice and opportunity to be h eard by
149152 the Commission.
150153 C. Persons under Disability.
151154 1. Notwithstanding a ny statute of limitation provided for in
152155 this act, when it is established that failure to file a claim by an
153156 injured employee or his or her dependents was induced by fraud, the
154157 claim may be filed within one (1) year from the time of the
155158 discovery of the fraud.
156159 2. Subsection A of this section shall not apply to a mental
157160 incompetent or minor so long as the person has no gu ardian or
158161 similar legal representative. The limitations prescr ibed in
159162 subsection A of this section shall apply to the mental incompetent

186190 or minor from the date of the appointment of a guardian or similar
187191 legal representative for that person, and when no g uardian or
188192 similar representative has been appointed, to a mino r on reaching
189193 the age of majority.
190194 D. A latent injury or condition shall n ot delay or toll the
191195 limitation periods specified in this section. This subsection shall
192196 not apply to the limitation period for occupational diseases
193197 specified in paragraph 2 of su bsection A of this section.
194198 SECTION 2. This act shall become effective November 1, 2023.
