5548 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
5649 SECTION 1. AMENDATORY 61 O.S. 2021, Section 327, as
5750 amended by Section 47, Chapter 238, O.S.L. 2022 (61 O.S. Supp. 2022,
5851 Section 327), is amended to read as follows:
5952 Section 327. A. Unless procedures for state agency real
6053 property transactions are otherwise specifically provided for by
6154 law, no state agency shall sell, lease, exchange, or otherwise
6255 dispose of such real prop erty subject to its jurisdiction, or lease,
6356 purchase or otherwise acquire real property subject to its
6457 jurisdiction, except as authorized by subsection L of this section
6558 and as otherwise provided for in this section. As used in this
59+section, “state agency” means any department, board, commission,
60+institution, agency or entity of state government.

93-section, “state agency” means any department, board, commission,
94-institution, agency or entity of state government.
9587 B. 1. Every state agency shall request the Office of
9688 Management and Enterprise Services to dispose of rea l property upon:
9789 a. legislative authorization,
9890 b. authorization by the Long-Range Capital Planning
9991 Commission, or
10092 c. a determination, in writing, by the Office of
10193 Management and Enterprise Servi ces or the state agency
10294 that a parcel of real property subject to its
10395 jurisdiction is no long er needed.
10496 2. Upon the request of the state agency to dispose of real
10597 property, the Office of Management and Enterprise Services shall
10698 estimate the value of the property, and:
10799 a. for properties with an estimated value of gre ater than
108100 Twenty-five Thousand Dollars ($25,000.00), obtain at
109101 least one complete appraisal made by a person
110102 certified by the Real Estate Appraiser Board of the
111103 Oklahoma Insurance Department, wh o shall ascertain:
112104 (1) the present fair value of the property,
113105 (2) the present value of the i mprovements on such
114106 property, and
115107 (3) the actual condition of the improvements on the
116108 property,
109+b. after completion of the provisions of subsection L of
110+this section, cause notice of such sale to be

144-b. after completion of the provisions of subsection L of
145-this section, cause notice of such sale to be
146137 published for at least one (1) day in a newspaper of
147138 general statewide circulatio n authorized to publish
148139 legal notices, and weekly for thr ee (3) consecutive
149140 weeks in a newspaper of general circulation published
150141 in the county or counties in which the property is
151142 located. The notice shall contain the legal
152143 description of each parcel of real property to be
153144 offered for sale, the appraised value thereof, the
154145 time and location of the sale or opening of the bids,
155146 and terms of the sale including the fact that no
156147 parcel of property shall be sold for less than ninety
157148 percent (90%) of the apprais ed value of the real
158149 property; provided, in lieu of such procedure, the
159150 information may be published electronically on the
160151 Office of Management and Enterprise Services’ website
161152 if the notice of sale an d instructions on accessing
162153 the public information are published in a newspaper of
163154 general circulation in the co unty or counties in which
164155 the property is located weekly for three (3)
165156 consecutive weeks,
166157 c. offer the property through electronic auction, public
167158 auction or sealed bids withi n three (3) weeks after
159+the last publication of the notice. The property
160+shall be sold to the highest bidder. The Office of

195-the last publication of the notice. The property
196-shall be sold to the highest bidder. The Office of
197187 Management and Enterprise Service s shall not accept a
198188 bid of less than ninety percent ( 90%) of the average
199189 appraised fair value of the property and the
200190 improvements on such property,
201191 d. if the property is being disposed of in compliance
202192 with Section 908 of Title 62 of the Oklahoma Sta tutes,
203193 the Office may auction the property at public o r
204194 electronic auction provided proper public no tice is
205195 given in compliance with this section and the property
206196 has been approved for liquidation by the Long-Range
207197 Capital Planning Commission. The Office of Management
208198 and Enterprise Services is authorized to reject all
209199 bids,
210200 e. if the property has an es timated value of less than
211201 Twenty-five Thousand Dollars ($25,000.00), the Office
212202 of Management and Enterprise Services may establish
213203 the value through market co mparison and may dispose of
214204 the property based on estimated va lue without
215205 obtaining a certified appraisal; provided, however,
216206 the sale shall comply with all other requirements o f
217207 statute, and
208+f. if the property is landlocked, the Office of
209+Management and Enterprise Services may offer the
210+property through indirect sale to the adjacent

245-f. if the property is landlocked, the Office of
246-Management and Enterprise Services may offer the
247-property through indirect sale to the adjacent
248237 property owner for not less than ninety percent (90%)
249238 of fair market value, as determined in com pliance with
250239 this section. All sales costs, including any required
251240 surveys and appraisals, shall be at the expense of the
252241 buyer.
253242 3. The cost of the appraisal required by the provisions of this
254243 section, together with other necessary expenses incurred pursu ant to
255244 this section, shall be paid by the state agency for which the real
256245 property is to be sold from funds available to the state agency for
257246 such expenditure. All monies received from the sale o r disposal of
258247 the property, except those monies necessary to pay the expenses
259248 incurred pursuant to this section, shall be deposited in the
260249 Maintenance of State Buildings Revolving Fund unless otherwise
261250 provided by law.
262251 4. The Office of Management and Enterprise Services may dismiss
263252 from consideration any appraisal found to be incomplete or flawed.
264253 C. Unless otherwise provided by law, the O ffice of Management
265254 and Enterprise Services shall review and ap prove state agency real
266255 property transactions. A state agency shall not lease or acquire
267256 real property, or lease, dispose of or transfer state-owned real
268257 property until the Office provides not ice of transaction approval to
258+the state agency. Prior to approval, a state agency shall provide
259+documents to the Off ice and provide reference to statutory or other
260+legal authority of the state agency to lease or acquire real

296-the state agency. Prior to approval, a state agency shall provide
297-documents to the Off ice and provide reference to statutory or other
298-legal authority of the state agency to lease or acquire real
299287 property, or lease, dispose o f or transfer state-owned real
300288 property. If the state agency i ntends to lease or acquire real
301289 property, the state age ncy shall state the intended use of the real
302290 property, and shall provide the Office with required telework
303291 documentation. Within thirty (30) days of receipt, the Office shall
304292 provide notice of transac tion approval or disapproval to th e state
305293 agency.
306294 D. The provisions of this section shall not apply to the lease
307295 of office space or real property subject to supervision of the
308296 Commissioners of the Land Office, institutions comprising The
309297 Oklahoma State System of Higher Education, or district boards of
310298 education.
311299 E. 1. The Office of Management and Enterprise Services shall
312300 maintain a comprehensive inventory of state-owned real property and
313301 its use excluding property of the public schools and p roperty
314302 subject to the jurisdiction of the Commissioners of the Land Office.
315303 2. Each state agency shall, within thirt y (30) days of the
316304 closing date for lands newly acquired, provide to the Office a list
317305 of records, deeds, abstracts and other title instru ments showing the
318306 description of and relating to any and all such lands or interests
319307 therein.
308+3. The provisions of pa ragraph 2 of this subsection shall apply
309+to all lands of public trusts having a state agency as the primary
310+beneficiary, but shall not app ly to lands of municipalities,

347-3. The provisions of pa ragraph 2 of this subsection shall apply
348-to all lands of public trusts having a state agency as the primary
349-beneficiary, but shall not app ly to lands of municipalities,
350337 counties, school districts, or agencies thereof, or D epartment of
351338 Transportation rights -of-way.
352339 4. A state agency that sells or otherwise disposes of land
353340 shall notify the Office within thirty (30) days of the disposition
354341 closing date.
355342 F. This section shall not be construed to authorize any state
356343 agency, not otherwise authorized by law, to sell, lease, or
357344 otherwise dispose of any real property owned by the state.
358345 G. The Office of Management and Enterprise Services and the
359346 Secretary of the Commissioners of the Land Office, or designee, as
360347 provided in subsection L of this section may provide services to
361348 sell, transfer, trade or purchase real property for other state
362349 agencies.
363350 H. The Director of the Office of Management and En terprise
364351 Services shall, pursuant to the Administrative Procedures Act,
365352 promulgate rules to effect procedures necessar y to the fulfillment
366353 of its responsibilities under this section.
367354 I. The Oklahoma Ordnance Works Authority and its lands, and the
368355 Northeast Oklahoma Public Facilities Authority, the Oklahoma
369356 Historical Society, the Oklaho ma Department of Transportation , the
370357 Oklahoma Turnpike Authority, institutions comprising The Oklahoma
358+State System of Higher Education, and the Department of Wildlife
359+managed lands shall be exempt from the application of this section.
360+The Grand River Dam Authority and its lands shall be exempt from the

399-managed lands shall be exempt from the application of this section.
400-The Grand River Dam Authority and its lands shall be exempt from the
401387 application of this section for any real property disposed of prior
402388 to November 1, 2006.
403389 J. Unless otherwise provided for by l aw, the procedures
404390 established pursuant to this section for the sale or exchange of
405391 real estate or personal property as authorized pursuant to Sections
406392 2222 and 2223 of Title 74 of the Oklahoma Statutes shall be followed
407393 unless the sale is to an entity of state government.
408394 K. The Director of the Office of Management and E nterprise
409395 Services shall contract with experts, professionals or consultants
410396 as necessary to perform the duties of the Office. Selections shall
411397 be made using the qualifications-based procedures established in
412398 Section 62 of this title and the rules promulg ated by the Director
413399 for the selection of construction managers and design consultants.
414400 L. 1. No state agency shall sell, lease, exchange, or
415401 otherwise dispose of such real property su bject to its jurisdiction,
416402 or lease, purchase or otherwise acquire rea l property subject to its
417403 jurisdiction, until such agency or the Office of Management and
418404 Enterprise Services acting on the agency’s behalf has presented to
419405 the Secretary of the Commissi oners of the Land Office, or designee,
420406 all information collected pursu ant to subparagraph a of paragraph 2
421407 of subsection B of this section, and provided the Secretary of the
408+Commissioners of the Land Office or designee a twenty-calendar-day
409+period to provide a proposal for the acquisition or disposal of
410+applicable real prope rty.

450-period to provide a proposal for the acquisition or disposal of

452437 2. The Secretary of the Commissioners of the Land Office or
453438 designee may decline to provide such a proposal; provided such
454439 notice of decline is communicated to the Office of Mana gement and
455440 Enterprise Services in written or electronic form. Upon the
456441 reception of such notice of decline by the Office of Management and
457442 Enterprise Services, the twenty-calendar-day period otherwise
458443 required by this subsection shall be deemed to have ex pired.
459444 SECTION 2. This act shall become effective November 1, 2023.
