3839 An Act relating to commercial flotation de vices;
3940 amending 82 O.S. 2021, Section 896 .16, which relates

4849 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4950 SECTION 1. AMENDATORY 82 O.S. 2021, Section 896.16, is
5051 amended to read as fo llows:
5152 Section 896.16. A. 1. Until replaced or changed as provided
5253 for in subsection C of this section, the Grand River Dam Authority
5354 is authorized and directed to charg e an annual use fee of Thirty-
5455 five Dollars ($35.00) per commercially owned and opera ted flotation
5556 device on the Illinois River within Adair, Cherokee and Delaware
5657 Counties.
5758 2. The operation of a commercial flotation dev ice without
5859 displaying a proper lice nse issued by the Authority shall result in
5960 a fine not to exceed One Hundred Dollars ($100.00). The fine shall
6061 be assessed upon the owner or operator of the commercial flotation

8890 flotation device.
8991 3. Commercial flotation devices shall not b e operated on Flint
9092 Creek in Delaware County and those portions of Barren Fork Creek in
9193 Cherokee County.
9294 B. For the Flint Creek and Illinois River within Adair,
9395 Cherokee and Delaware Counties and those portions of Barren Fork
9496 Creek within Cherokee County , the Authority is authorized and
9597 directed to charge until replaced or changed as provided for in
9698 subsection C of this section:
9799 1. An annual use fee of Ten Dollars ($10.00) per noncommercial,
98100 privately owned device; or
99101 2. A use fee of One Dollar ($1.00) per day for all
100102 noncommercial, privately owned flotation devices floating upon a
101103 designated scenic river. Landowners located immediately adjacent to
102104 a designated scenic river shall not be required to pay any fee for
103105 private use as authorized in this section or otherwise by law.
104106 C. Under the provisions of Section 5 of this act 896.2 of this
105107 title granting the Authority the power to establish licenses and set
106108 fees, the Authority may promulgate rules for the collection and
107109 administration of the fees i mposed pursuant to the provisions of
108110 this section or may promulgate rules establishing licenses ;
109111 providing for the issuance, renewal, revocation, denial, and
110112 suspension of licenses ; and setting fees that change or replace the

137140 licenses and fees imposed purs uant to the provisions of this
138141 section. Upon final adoption of rules changing or replacing any or
139142 all of the licenses and fees im posed pursuant to the provisions of
140143 this section, the Authority shall cease to im pose, collect or charge
141144 the license and fee t hat was changed or replaced by rule. Rules
142145 promulgated by the Authority pursuant to this section shall be in
143146 accordance with the Administrative Procedures Act.
144147 D. Until replaced or changed as provided for in subsection C
145148 of this section, the Grand River Dam Authority may charge a fee for
146149 use of camping sites located in public use and access areas
147150 controlled by the Authority in an amount that does not exceed the
148151 rate charged by the Oklahoma Tourism and Recreati on Department for
149152 camping sites.
150153 E. For the purposes of the Scenic Rivers Act, “commercial
151154 flotation device” means a canoe, boat, kayak, inner tube, raft or
152155 other similar device suitable for the transportation of a person or
153156 persons on waterways which is available for hire by the public for
154157 use on scenic rivers.
155158 SECTION 2. This act shall become effective in accordance with
156159 the provisions of Section 58 of Article V of the Okl ahoma
157160 Constitution.
