39	40		amending 82 O.S. 2021, Section 896 .16, which relates
40	41		to user fees and licenses; authorizing promulgation
41	42		of rules; updating statutory language; updating
42	43		statutory reference; and providing an effective date .

48	49		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	50		SECTION 1. AMENDATORY 82 O.S. 2021, Section 896.16, is
50	51		amended to read as fo llows:
51	52		Section 896.16. A. 1. Until replaced or changed as provided
52	53		for in subsection C of this section, the Grand River Dam Authority
53	54		is authorized and directed to charg e an annual use fee of Thirty-
54	55		five Dollars ($35.00) per commercially owned and opera ted flotation
55	56		device on the Illinois River within Adair, Cherokee and Delaware
56	57		Counties.
57	58		2. The operation of a commercial flotation dev ice without
58	59		displaying a proper lice nse issued by the Authority shall result in
59	60		a fine not to exceed One Hundred Dollars ($100.00). The fine shall
60	61		be assessed upon the owner or operator of the commercial flotation

87	89		device business and not upon the individual renting the commercial
88	90		flotation device.
89	91		3. Commercial flotation devices shall not b e operated on Flint
90	92		Creek in Delaware County and those portions of Barren Fork Creek in
91	93		Cherokee County.
92	94		B. For the Flint Creek and Illinois River within Adair,
93	95		Cherokee and Delaware Counties and those portions of Barren Fork
94	96		Creek within Cherokee County , the Authority is authorized and
95	97		directed to charge until replaced or changed as provided for in
96	98		subsection C of this section:
97	99		1. An annual use fee of Ten Dollars ($10.00) per noncommercial,
98	100		privately owned device; or
99	101		2. A use fee of One Dollar ($1.00) per day for all
100	102		noncommercial, privately owned flotation devices floating upon a
101	103		designated scenic river. Landowners located immediately adjacent to
102	104		a designated scenic river shall not be required to pay any fee for
103	105		private use as authorized in this section or otherwise by law.
104	106		C. Under the provisions of Section 5 of this act 896.2 of this
105	107		title granting the Authority the power to establish licenses and set
106	108		fees, the Authority may promulgate rules for the collection and
107	109		administration of the fees i mposed pursuant to the provisions of
108	110		this section or may promulgate rules establishing licenses ;
109	111		providing for the issuance, renewal, revocation, denial, and
110	112		suspension of licenses ; and setting fees that change or replace the

137	140		licenses and fees imposed purs uant to the provisions of this
138	141		section. Upon final adoption of rules changing or replacing any or
139	142		all of the licenses and fees im posed pursuant to the provisions of
140	143		this section, the Authority shall cease to im pose, collect or charge
141	144		the license and fee t hat was changed or replaced by rule. Rules
142	145		promulgated by the Authority pursuant to this section shall be in
143	146		accordance with the Administrative Procedures Act.
144	147		D. Until replaced or changed as provided for in subsection C
145	148		of this section, the Grand River Dam Authority may charge a fee for
146	149		use of camping sites located in public use and access areas
147	150		controlled by the Authority in an amount that does not exceed the
148	151		rate charged by the Oklahoma Tourism and Recreati on Department for
149	152		camping sites.
150	153		E. For the purposes of the Scenic Rivers Act, “commercial
151	154		flotation device” means a canoe, boat, kayak, inner tube, raft or
152	155		other similar device suitable for the transportation of a person or
153	156		persons on waterways which is available for hire by the public for
154	157		use on scenic rivers.
155	158		SECTION 2. This act shall become effective in accordance with
156	159		the provisions of Section 58 of Article V of the Okl ahoma
157	160		Constitution.
