77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Secti on 90.8 of Title 74, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	A. As used in this section:
82	82	1. “Company” shall mean any sole proprietorship, organization,
83	83	corporation, partnership, joint venture, limited partnership,
84	84	limited liability partnership, limited liability company, or other
85	85	entity or business association, including but not limited to all
86	86	wholly owned subsidiaries, majority owned subsidiaries, parent
87	87	companies, or affiliates of such entities or business associations,
88	88	that exists for the purpose of making prof it;

140	140	2. “Government of China” shall mean the government of the
141	141	People’s Republic of China led by the Chinese Communi st Party (CCP);
142	142	and
143	143	3. “Scrutinized company” shall mean any company owned or
144	144	operated by the Government of China.
145	145	B. 1. No state agency or politi cal subdivision of this state
146	146	shall purchase any goods or services from a scrutinized company or
147	147	enter into contracts with a scru tinized company.
148	148	2. Any state agency or political subdivision of this state
149	149	requiring a bid or proposal for goods or services shall require a
150	150	company submitting a bi d or proposal to certify that the company is
151	151	not a scrutinized company. Such certification shall be required in
152	152	addition to, and not in lieu of, any other certification required by
153	153	law.
154	154	3. A scrutinized company shall b e ineligible to bid on or
155	155	submit a proposal, directly or indirectly through a third-party, for
156	156	a contract with any public or private entity that directly or
157	157	indirectly receives state funding.
158	158	C. If the State Purchasing Director determines that a company
159	159	has submitted a false certification under paragraph 2 of subsection
160	160	B of this section:
161	161	1. The company shall be liable for a civil penalty of Two
162	162	Hundred Fifty Thousand Dollars ($250,000.00) or twice the amount of
163	163	the contract, whichever is greater; and
