48	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	54		SECTION 1. AMENDATORY 74 O.S. 2021, Section 5017.1, is
50	55		amended to read as follows:
51	56		Section 5017.1. A. The Oklahoma Department of Commerce shall
52	57		have the authority to e stablish, administer and enforce state and
53	58		federal energy conservation programs including, but not limited to,
54	59		implementing The Energy Conservation Act of 1975 (P.L. 94 -163),
55	60		National Energy Extension Service Act (P.L. 95 -39, 42 U.S.C. Section
56	61		7001 et seq.) and the National Conservation Policy Act (P.L. 95 -
57	62		619), except as otherwise provided by law.
58	63		B. The Energy Conservation Services Division of the Oklahoma
59	64		Corporation Commission is hereby abolished. All personnel,
60		-	equipment, files, fixtures, funds, furn iture, publications and
61		-	supplies, and all duties, functions, authority and contra ctual

	92	+	equipment, files, fixtures, funds, furn iture, publications and
	93	+	supplies, and all duties, functions, authority and contractual
88	94		obligations that relate to the Energy Conservation Services Division
89	95		of the Oklahoma Corporation Commission are hereby transferred to and
90	96		vested in the Oklahoma Department of Commerce.
91	97		C. Employees transferred to the Oklahoma Department of Commerce
92	98		shall be classified and subject to the provisions of the Merit
93	99		System of Personnel Administration as provided for in the Oklahoma
94	100		Personnel Act. The salaries, grade and/or cl ass of the employees
95	101		transferred shall be adjusted to be com mensurate with comparable
96	102		positions in the Oklahoma Department of Commerce.
97	103		D. The full-time-equivalent employee positions funded through
98	104		the federal energy conservation programs outlined in this section
99	105		shall terminate upon the exhaustion of said the federal funding.
100	106		E. The Department shall make publicly available on its website,
101		-	to be updated annually, information related to ~~federa l,~~ ~~state,~~
102		-	~~local, and tribal energy~~ efficiency incentive programs. The
103		-	~~information provided shall~~ include, but not be limited to:

	114	+	promoting and implementing energy efficiency incentive programs; and
