70	70	be paid firefighters; modifying compensation
71	71	determination; increasing monthly benefit to be
72	72	received by retirees; and providing for codification.

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 11 O.S. 2021, Section 49-101.2, as
79	79	amended by Section 4, Chapter 232, O. S.L. 2022 (11 O.S. Supp. 2022,
80	80	Section 49-101.2), is amended to read as follows:
81	81	Section 49-101.2. Any member serving as an active volunteer
82	82	firefighter who receives annual compensation fr om the fire
83	83	department the firefighter is enrolled in as a member of the System
84	84	for services related to firefighting, other than reimbursement of
85	85	expenses in excess of five and one-half (5 1/2) times the annual
86	86	pension benefit paid by the System to a retired volunteer
87	87	firefighter with twenty (20) years credited service Nine Thousand
88	88	Nine Hundred Thirty-nine Dollars and sixty-nine cents ($9,939.69),

140	140	shall be considered a paid firefighter and must meet the physical
141	141	and agility requirements pursuant to Section 49-116 of this title to
142	142	continue as an active member of the System . Credited service earned
143	143	as a paid firefighter pursuant to this section shall not be
144	144	considered actual experience as a paid firefighter for purpo ses of
145	145	meeting the qualifications of a paid fire chief as provi ded in
146	146	Section 29-102 of this title. No fire department of a participating
147	147	municipality shall employ a volunteer firefighter from another fire
148	148	department to perform services relating to firefi ghting for any
149	149	compensation of any kind.
150	150	SECTION 2. NEW LAW A new section of law to be codified
151	151	in the Oklahoma Statutes as Section 49-143.8 of Title 11, unless
152	152	there is created a duplication in numb ering, reads as follows:
153	153	Any member of the Oklah oma Firefighters Pension and Retirement
154	154	System receiving benefits as of June 30, 20 24, who continues to
155	155	receive benefits on or after July 1, 2024, shall receive a benefit
156	156	equal to Ten Dollars ($10.00) for each year of credited service not
157	157	to exceed thirty (30) years of service.
