6565 An Act relating to the Oklahoma Firefighters Pension

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 11 O.S. 2021, Section 49-101.2, as
7979 amended by Section 4, Chapter 232, O. S.L. 2022 (11 O.S. Supp. 2022,
8080 Section 49-101.2), is amended to read as follows:
8181 Section 49-101.2. Any member serving as an active volunteer
8282 firefighter who receives annual compensation fr om the fire
8383 department the firefighter is enrolled in as a member of the System
8484 for services related to firefighting, other than reimbursement of
8585 expenses in excess of five and one-half (5 1/2) times the annual
8686 pension benefit paid by the System to a retired volunteer
8787 firefighter with twenty (20) years credited service Nine Thousand
8888 Nine Hundred Thirty-nine Dollars and sixty-nine cents ($9,939.69),

140140 shall be considered a paid firefighter and must meet the physical
141141 and agility requirements pursuant to Section 49-116 of this title to
142142 continue as an active member of the System . Credited service earned
143143 as a paid firefighter pursuant to this section shall not be
144144 considered actual experience as a paid firefighter for purpo ses of
145145 meeting the qualifications of a paid fire chief as provi ded in
146146 Section 29-102 of this title. No fire department of a participating
147147 municipality shall employ a volunteer firefighter from another fire
148148 department to perform services relating to firefi ghting for any
149149 compensation of any kind.
150150 SECTION 2. NEW LAW A new section of law to be codified
151151 in the Oklahoma Statutes as Section 49-143.8 of Title 11, unless
152152 there is created a duplication in numb ering, reads as follows:
153153 Any member of the Oklah oma Firefighters Pension and Retirement
154154 System receiving benefits as of June 30, 20 24, who continues to
155155 receive benefits on or after July 1, 2024, shall receive a benefit
156156 equal to Ten Dollars ($10.00) for each year of credited service not
157157 to exceed thirty (30) years of service.
