7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 4300 of Title 59, unless there
8282 is created a duplication in numbering, reads as follows:
8383 This act shall be known and may be cited as the “Oklahoma Home-
8484 based Business Fairn ess Act”.
8585 SECTION 2. NEW LAW A new section of law to be codified
8686 in the Oklahoma Stat utes as Section 4300.1 of Title 59, unless there

140140 1. “Goods” means any merchandise, equipment, p roducts,
141141 supplies, or materials;
142142 2. “Home-based business” means any business for the
143143 manufacture, provision, or sale of goods or services that is owned
144144 and operated by the owner or te nant of the residential dwelling ; and
145145 3. “No-impact home-based business” means a home-based business
146146 for which the following apply:
147147 a. the total number of on-site employees and clients does
148148 not exceed the municipal occupancy limit for the
149149 residential property , and
150150 b. the business activities are characterized by all of
151151 the following:
152152 (1) are limited to the sale of lawful goods and
153153 services,
154154 (2) do not generate on-street parking or a
155155 substantial increase in traffic through the
156156 residential area,
157157 (3) occur inside the residential dwelling or in the
158158 yard, and
159159 (4) are not visible from the street .
160160 B. The use of a residential dwelling for a home-based business
161161 is a permitted use, except that this permission does not supersede
162162 any of the following:

214214 1. Any deed restriction , covenant, or agreement restricting the
215215 use of land including, but not limited to, a property lease
216216 agreement; or
217217 2. Any master deed or other document applicable to a common
218218 interest ownership community including, but not limited to, a
219219 homeowner association (HOA).
220220 C. A municipality shall not prohibit a no -impact home-based
221221 business or otherwise require a person to apply, register, or obtain
222222 any permit, license, variance, or other type of prior approval from
223223 the municipality to operate a no-impact home-based business.
224224 D. A municipality may establish reasonable regulations for a
225225 home-based business if the regulations are narrowly tailored for any
226226 of the following purposes:
227227 1. The protection of the public healt h and safety including
228228 rules and regulations rela ted to fire and building codes, health and
229229 sanitation, transportation or t raffic control, solid or hazardous
230230 waste, pollution, and noise control;
231231 2. Ensuring that the business activity is:
232232 a. compatible with residential use of the property and
233233 surrounding residential use,
234234 b. secondary to the use as a residential dwelling , or
235235 c. complying with state and federal law and paying
236236 applicable taxes; or

288288 3. Limiting or prohibiting th e use of a home-based business for
289289 the purposes of sell ing illegal drugs, liquor, o perating or
290290 maintaining a structured sober living home, pornography, obsc enity,
291291 nude or topless dancing, and other adult-oriented businesses.
292292 E. A municipality shall not requ ire a person as a condition of
293293 operating a home-based business to:
294294 1. Rezone the property for commercial use; or
295295 2. Install or equip fire sprinklers in a single family detached
296296 residential dwelling or any residential dwelling wit h not more than
297297 two dwelling units.
298298 F. The question of whether a regulation complies with this
299299 section shall be a judicial question, and the municipality that
300300 enacted the regulation shall establish by clear and convincing
301301 evidence that the regulation complie s with this section.
302302 SECTION 3. This act shall become effective November 1, 2023.
