27	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	58		SECTION 1. AMENDATORY 2 O.S. 2021, Section 18 -308, is
30	59		amended to read as follows:

32	60		Section 18-308. A. There is hereby assessed The Oklahoma Wheat
33	61		Commission shall assess a fee of two cents ($0.02) per bushel upon
34	62		all wheat marketed by wheat producers in this stat e and sold through
35	63		commercial channels. The fee is assessed and imposed on the
36	64		producer at the time of sale or delivery, and shall be collected and
37	65		remitted by the first purchaser to the Oklahoma Wheat Commission.

38	93		Under the provisions of the Oklahoma Whe at Resources Act, no wheat
39	94		shall be subject to a fee more than once.

41	95		B. The Commission shall alloc ate twenty percent (20%) of the
42	96		two-cent fee levied and collected p ursuant to subsection A of this
43	97		section to the Oklahoma Wheat Research Foundation for the purpose of
44	98		conducting wheat research, including, but not limited to,
45	99		utilization and educational pr ojects, less the cost of collecting
46	100		the fee, such cost not to excee d fifty percent (50%) of the total of

49	101		the office rental and clerical costs, and the costs of supplies and
50	102		postage and such cost to be prorated on the basis of eighty percent
51	103		(80%) to the Commission and twenty percent (20%) to the Oklahoma
52	104		Wheat Research Foundation.

54	105		C. In order for the Oklahoma Wheat Research Foundation to
55	106		qualify for the alloc ation of twenty percent (20%) of collected
56	107		fees, the Commission shall appoin t a member of the Oklah oma Wheat
57	108		Commission to the Oklahoma Wheat Research Foundation boar d of
58	109		directors.

60	110		D. Any unexpended balance contained in the revolving fund
61	111		designated for the Wheat Utilization, Research and Market
62	112		Development Commission as of Nove mber 1, 2016, shall be transferred
63	113		and deposited to the credit of the General Revenue Fund of the State
64	114		Treasury.

66	115		SECTION 2. AMENDATORY 2 O.S. 2021, Section 18-309, is

69	144		Section 18-309. A. Producers may petition for a referen dum at
70	145		any time after five (5) years following the effective date o f the
71	146		Oklahoma Wheat Resources Act to determine if the assessment is to be
72	147		continued.

74	148		B. The President of the State Board of Agriculture shall call
75	149		and conduct a referendum if the petition s bear signatures of ten
76	150		percent (10%) of the wheat producers. No more than one such
77	151		referendum shall be conducted in any one thirty -six-month period.
78	152		The State Board of Agriculture shall determine if the petition bears
79	153		the required number of valid signa tures. The President shall
80	154		announce the referendum at least thirty (30) days prior to the day
81	155		of voting. At least thirty (30) days before the referendum, th e
82	156		President shall mail a notice of the referendum to all known wheat
83	157		producers in the State of Okl ahoma who market wheat in commercial
84	158		quantities. The notice shall specify the dates, times, and places
85	159		for holding the referendum. The notice shall also inc lude a sample
86	160		ballot with the following wording:

96	165		C. Places within each county for conducting th e referendum
97	166		shall be designated by the Agricultural Extension Division o f

100	196		designated by the Extension Division in cases where the re is no
101	197		county agent in a county at the time of the referendum.

103	198		D. The Oklahoma Wheat Commis sion shall ensure sufficient
104	199		ballots and supplies necessary for con ducting the voting and the
105	200		tabulation of returns.

107	201		E. Certified results of the referendum in ea ch county shall be
108	202		transmitted within twenty -four (24) hours after voting ends to the
109	203		President of the State Board of Agriculture. The ballots shall be
110	204		transmitted to the President within forty-eight (48) hours. Ballots
111	205		shall be preserved by the Presiden t for a period of at least three
112	206		(3) months.

114	207		F. The results of the refer endum shall be determ ined by the
115	208		President and the results certified to the Governor, wh o shall issue
116	209		a proclamation declaring the results.

118	210		G. The Commission shall bear expenses of a dvertising and
119	211		conducting the referendum.

121	212		H. Whenever the question of le vying the assessments is
122	213		disapproved, by failure of sixty percent (60%) of the producers
123	214		voting in the referendum to favor continuation of the assessments,
124	215		the proclamation declaring the result shall provide for the
125	216		termination of the assessments on April 30, following the dat e of
126	217		the referendum.
