7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
7676 SECTION 1. AMENDATORY 22 O.S. 2021, Section 472, is
7777 amended to read as follows:
7878 Section 472. A. This section shall be known and may be cited
7979 as the “Anna McBride Act”.
8080 B. Any district or municipal court of this state may establish
8181 a mental health court pro gram pursuant to the provisions of this
8282 section, subject to the availability of funds.
8383 C. The court may request assistance from the Department of
8484 Mental Health and Substance Abuse Services which shall be the
8585 primary agency to assist in developing and impl ementing a mental
8686 health court program.

138138 D. For purposes of this section, “mental health court” means a
139139 judicial process that utilizes specially trained court person nel to
140140 expedite a case and explore alternatives to incarceration for an
141141 offender charged with criminal offenses other than a crime listed in
142142 paragraph 2 of Section 571 of Title 57 of the Oklahoma Statutes who
143143 has a mental illness or a developmental disabil ity, or a co-
144144 occurring mental illness and substance abuse disorder. The district
145145 attorney’s office may use discretion in the pros ecution of an
146146 offender specified in this subsection subject to the restrictions
147147 provided in subsection E of this section.
148148 E. The court shall have the authority to exclude from mental
149149 health court any offender arreste d or charged with any violent
150150 offense or any offender who has a prior felony conviction in this
151151 state or another state for a violent offense. Eligibility and entry
152152 by an offender into the mental health court program is dependent
153153 upon prior approval of the district attorney. Eligible offenses may
154154 further be restricted by the rules of the specific mental health
155155 court program. The court shall have the authority to exc lude
156156 persons from mental health court who have a propensity for violence.
157157 F. The mental health court judge shall recognize relaps es and
158158 restarts in the program which shall be considered as part of the
159159 rehabilitation and recovery process. The court shall accomplish
160160 monitoring and offender accountability by ordering progressively
161161 increasing sanctions or providing incentives, rather t han removing

213213 the offender from the program when a violation occurs, except when
214214 the conduct of the offender requires revocatio n from the program.
215215 Any revocation from the mental health court program shall require
216216 notice to the offender and other participat ing parties in the case
217217 and a revocation hearing. At the revocation hearing, if the
218218 offender is found to have violated the co nditions of the plea
219219 agreement or performance contract and disciplinary sanctions have
220220 been insufficient to gain compliance, the o ffender shall be revoked
221221 from the program and sentenced for the offense as provided in the
222222 plea agreement.
223223 G. Any criminal case which has been filed and processed in the
224224 traditional manner shall be cross -referenced to a mental health
225225 court case file by th e court clerk if the case is subsequently
226226 assigned to a mental health court program. The originating criminal
227227 case file shall remain open to public inspection. The court shall
228228 determine what information or pleadings are to be retained in the
229229 mental health case court file, which shall be closed to public
230230 inspection.
231231 H. 1. Upon approval of the di strict or municipal court, an
232232 offender participating in a mental health court program shall be
233233 afforded the opportunity, if available, to have a certified
234234 therapeutic dog accompanied by the handler of the certified
235235 therapeutic dog while the offender provides testimony or otherwise
236236 appears in court proceedings.

288288 2. For purposes of this subsection, “certified therapeutic dog”
289289 means a dog which has received the requisit e training or
290290 certification from the American Kennel C lub, Alliance of Therapy
291291 Dogs, or an equivalent organizatio n to perform the duties associated
292292 with therapy dogs in plac es such as hospitals, nursing homes, and
293293 other facilities where the emotional benefits of therapy dogs are
294294 recognized. Prior to the use of a certified therapeutic dog the
295295 court shall conduct a he aring to verify:
296296 a. the credentials of the certified therap eutic dog,
297297 b. the certified therapeutic dog is appropriately
298298 insured, and
299299 c. a relationship has been established between the
300300 offender and the certified therapeutic dog in
301301 anticipation of testi mony or other appearance in court
302302 proceedings.
303303 SECTION 2. This act shall bec ome effective November 1, 2023.
