41+amending 64 O.S. 2021, Section 1002 , which relates to
42+powers and authority of the Commissioners; allowing

44+certain schools; providing an effective date; and

5250 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
5351 SECTION 1. AMENDATORY 64 O.S. 2 021, Section 1002, is
5452 amended to read as follows:
5553 Section 1002. In order that the state school lands may be
5654 administered in a manner to assure their preservat ion as well as the
5755 appreciation of the trust estate and the maximum return fr om the use
5856 of state school lands for the support and maintenance of the common
5957 schools of the state, the Commissioners of the Land Office, as
6058 trustees of the state school lands, a re hereby authorized and
6159 empowered to:
60+1. Categorize the state school lands as agricultural or
61+commercial according to the use which the Commissioners of the Land

89-1. Categorize the state school lands as agricultural or
90-commercial according to the use which the Commissioners of the Land
9188 Office determine from time to time to be most beneficial to the
9289 interest of the present and future beneficiaries of the state;
9390 2. Sell, at public auction after appraise ment, the surface
9491 interest in any state school land categorized by the Commissioners
9592 of the Land Office to be excess or when determined to be in the best
9693 interest of the trust;
9794 3. Institute projects to develop and im prove those state school
9895 lands which are categorized as commercial lands;
9996 4. Acquire by exchange, purchase, gift , or grant all real
10097 property and to acquire by exchange, purchase, gift , or grant all
10198 personal property necessary for the purpose of utilizing trust lands
10299 for the development of comm ercial and agricultural leases to
103100 maximize trust income for present and future beneficiaries; and
104101 5. Exchange any real property of the trust for other real
105102 property of equal or g reater value to maximize income for pr esent
106103 and future beneficiaries, in acco rdance with and under the safeguard
107104 of trust requirements ; and
108105 6. Lease real property to a charter school formed pursuant to
109106 the Oklahoma Charter Schools Act. The Commissioners of the Land
110107 Office shall provide a right of first refusal to a charter school
111108 located in the same county or an adjacent county as the real
112109 property available for lease .
110+SECTION 2. This act shall become effective July 1, 2023.

140-SECTION 2. This act shall become effective July 1, 2023.
141137 SECTION 3. It being immediately ne cessary for the preservation
142138 of the public peace, health, or safety, an emergency is hereby
143139 declared to exist, by reason whereof thi s act shall take effect and
144140 be in full force from and after its passage and approval.
