	41	+	amending 64 O.S. 2021, Section 1002 , which relates to
	42	+	powers and authority of the Commissioners; allowing
	43	+	the Commissioners to lease certain property to
	44	+	certain schools; providing an effective date; and
	45	+	declaring an emergency .

52	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
53	51		SECTION 1. AMENDATORY 64 O.S. 2 021, Section 1002, is
54	52		amended to read as follows:
55	53		Section 1002. In order that the state school lands may be
56	54		administered in a manner to assure their preservat ion as well as the
57	55		appreciation of the trust estate and the maximum return fr om the use
58	56		of state school lands for the support and maintenance of the common
59	57		schools of the state, the Commissioners of the Land Office, as
60	58		trustees of the state school lands, a re hereby authorized and
61	59		empowered to:
	60	+	1. Categorize the state school lands as agricultural or
	61	+	commercial according to the use which the Commissioners of the Land

89		-	1. Categorize the state school lands as agricultural or
90		-	commercial according to the use which the Commissioners of the Land
91	88		Office determine from time to time to be most beneficial to the
92	89		interest of the present and future beneficiaries of the state;
93	90		2. Sell, at public auction after appraise ment, the surface
94	91		interest in any state school land categorized by the Commissioners
95	92		of the Land Office to be excess or when determined to be in the best
96	93		interest of the trust;
97	94		3. Institute projects to develop and im prove those state school
98	95		lands which are categorized as commercial lands;
99	96		4. Acquire by exchange, purchase, gift , or grant all real
100	97		property and to acquire by exchange, purchase, gift , or grant all
101	98		personal property necessary for the purpose of utilizing trust lands
102	99		for the development of comm ercial and agricultural leases to
103	100		maximize trust income for present and future beneficiaries; and
104	101		5. Exchange any real property of the trust for other real
105	102		property of equal or g reater value to maximize income for pr esent
106	103		and future beneficiaries, in acco rdance with and under the safeguard
107	104		of trust requirements ; and
108	105		6. Lease real property to a charter school formed pursuant to
109	106		the Oklahoma Charter Schools Act. The Commissioners of the Land
110	107		Office shall provide a right of first refusal to a charter school
111	108		located in the same county or an adjacent county as the real
112	109		property available for lease .
	110	+	SECTION 2. This act shall become effective July 1, 2023.

140		-	SECTION 2. This act shall become effective July 1, 2023.
141	137		SECTION 3. It being immediately ne cessary for the preservation
142	138		of the public peace, health, or safety, an emergency is hereby
143	139		declared to exist, by reason whereof thi s act shall take effect and
144	140		be in full force from and after its passage and approval.
