4451 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4552 SECTION 1. NEW LAW A new section of law to be codified
4653 in the Oklahoma Statutes as Section 18-202.2 of Title 70, unless
4754 there is created a d uplication in numbering, reads as follows:
4855 A. This act shall be kn own and may be cited as the “Rewarding
4956 Student Outcomes Act ”. The purpose of the act sh all be to create an
5057 outcomes-based college, career, and military readiness i ncentive
5158 program for school districts, charter schools, and virtual charter
5259 schools in this state.
5360 B. As used in this act:
5461 1. “College, career, and military readiness” means a graduating
5562 senior who accomplishes any of the following during a time period
5663 established by the State D epartment of Education:
57-a. scores the silver level or ab ove on the ACT WorkKeys
58-assessment,
59-b. earns an industry credential,

92+assessment,
93+b. earns an industry credential ,
8694 c. achieves a benchmark score on the ACT, SAT , or another
8795 assessment designated by the State Department of
8896 Education,
8997 d. scores a 3, 4, or 5 on an Advanced Placement
9098 examination,
9199 e. scores a 4, 5, 6, or 7 on an International
92100 Baccalaureate examination,
93101 f. earns transcripted college credit while still in high
94102 school through concurrent or dual enrollment,
95103 g. achieves a passing scor e set by the applicable
96104 military branch on the Armed Services Vocational
97105 Aptitude Battery, or
98106 h. is accepted for enlistment in the United States Armed
99107 Forces;
100108 2. “Economically disadvantaged” shall have the same meaning as
101109 provided for in Section 18-109.5 of Title 70 of the Oklahoma
102110 Statutes; and
103111 3. “Not economically disadvantaged” means a student who does
104112 not qualify for free- or reduced-price meals under the National
105113 School Lunch Act.
106-C. Beginning with the 2025-2026 school year and each school
107-year thereafter, the State Department of Education shall determine

141+C. Beginning with the 2025-2026 school year and each school
142+year thereafter, the State Department of Education shall determine
143+and inform each school district, charter school, and virtual charter
144+school of the number of graduating seniors who m et the college,
136145 career, and military readiness standards defined in subsection B of
137146 this section for each of the following cohorts for each school site
138147 for the preceding school year:
139148 1. Annual graduates who are economically disadvantaged; and
140149 2. Annual graduates who are not economically disadvantaged.
141150 D. 1. Beginning with the 2025-2026 school year and each school
142151 year thereafter, the State Department of Education shall determine
143152 and inform each school district , charter school, and virtual charter
144153 school the minimum number of annual graduates in each of the cohorts
145154 identified in subsection C o f this section who must demonstrate
146155 college, career, and military readiness in order for the school
147156 district, charter school, or virtual charter school to be eligible
148157 for a Rewarding Student Outcom es Act bonus.
149158 2. To qualify for a Rewar ding Student Outcomes Act bonus, the
150159 school district, charter school, or virt ual charter school shall
151160 have at least a one percent (1%) increase in the number of annual
152161 graduates in a cohort identified in subsection C of this section who
153162 demonstrate college, career, and military readiness above the number
154163 of graduates for the preceding s chool year. A qualifying school
155164 district, charter school, and virtual charter school shall be
156-eligible for a Rewarding Student Outcomes Act bonus in the following
157-amounts:

192+eligible for a Rewarding Student Outcomes Act bonus in the following
193+amounts:
184194 a. One Thousand Five Hundred Dollars ($1,500.00) per
185195 graduate if the annual graduat e is economically
186196 disadvantaged, and
187197 b. Five Hundred Dollars ($500.00) per graduate if the
188198 annual graduate is not economically disadvantaged.
189199 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.545, is
190200 amended to read as follows:
191201 Section 1210.545. A. Except as otherwise provided, as pa rt of
192202 the accountability system developed as provide d for in Section
193203 1210.541 of this title, the State Board of Education sh all prepare
194204 annual reports of the results of the Okla homa School Testing Prog ram
195205 which describe student achievement in the state, an d each school
196206 site, pursuant to the Elementary and S econdary Education Act of 1965
197207 (ESEA) as reauthorized by P.L. No. 114 -95, also known as the Every
198208 Student Succeeds Act (ESSA) , and any related federa l regulations.
199209 B. The annual report as required pursua nt to subsection A of
200210 this section shall identify sc hool sites as having one of the
201211 following grades for each indicator, sep arately, and by a single
202212 overview grade of all indica tors, defined according to rules of the
203213 State Board of Education:
204214 1. “A” means schools making excellent progress;
205215 2. “B” means schools making above average progress;

243+3. “C” means schools making satisf actory progress;
233244 4. “D” means schools making less th an satisfactory progress ;
234245 and
235246 5. “F” means schools failing to make adequate pr ogress.
236247 C. Each school that has students who are te sted and included in
237248 the school grading system as provided for in this s ection shall
238249 receive a school grade, except as follow s:
239250 1. A school shall no t receive a school grade if the number of
240251 students tested and included in the school grading system is less
241252 than the minimum sample size necessary for statistical reliability
242253 and prevention of the unlawful release of personally iden tifiable
243254 student data. The State Board of Education is directed to establish
244255 the lowest minimum sample size necessary to meet the requirements of
245256 this paragraph; and
246257 2. The academic performance of stud ents who are enrolled full-
247258 time in an online program that is offered by a sch ool district or
248259 charter school that is not the district of residence or is not
249260 located in the district of r esidence of the student shall be
250261 reported separately by the school distr ict or charter school and
251262 shall not be included when determining the grade of the school site
252263 or charter school.
253264 D. The State Board of Education may adopt alternate systems of
254265 accountability for statewide virtual charter schools, alternative
255266 education programs as defined in Section 1210.568 of this title, a nd

283295 two.
284296 E. The grade of a school shall be based on a multimeas ures
285297 approach to accountability in accordance with the Elementary and
286298 Secondary Education Act of 1965 (ESEA) as reauthorized by P.L. No.
287299 114-95, also known as the Every Student Succeeds Act (ESSA) and any
288300 federal regulations that include, but are not limit ed to, the
289301 following indicators:
290302 1. Statewide assessments , including the establishment of
291303 student performance bands;
292304 2. Graduation rates for high s chools;
293305 3. Statewide academic measures for elementary and middle
294306 schools;
295307 4. English language proficiency for English learners; and
296308 5. At least one additional statewide measure of school quality
297309 or student success, including, but not limited to, school climate,
298310 school safety, student engagement, educator en gagement, and/or
299311 advanced coursework and postseconda ry readiness.
300312 F. Of the indicators included in subsection E of this sec tion,
301313 not less than seventy percent (70%) of the over view grade must shall
302314 be given to indicators 1, 2, 3, and 4 and, in the aggrega te, with
303315 not more than thirty percent (30%) of the g rade given to indicator

331344 G. Further, the grade of an elementary or mi ddle school site
332345 shall include, but not be limited to, a measure of status fo r
333346 English language arts (ELA), math and science, growth in ELA and
334347 math, English Language Proficiency Asses sment (ELPA) progress, and
335348 chronic absenteeism climate surveys administered to students, school
336349 staff, and parents and legal guardians of student s enrolled in the
337350 school site.
338351 H. The grade of a high scho ol site shall include, but not b e
339352 limited to, a measure of status f or English language arts (ELA) ELA,
340353 math and science status, English Language Proficiency Assessment
341354 (ELPA) ELPA progress, graduation rate, chronic absenteeism, and
342355 postsecondary opportunit ies, and climate surveys administered to
343356 students, school staff, and parents and legal guardians of student s
344357 enrolled in the school site. For purposes of this section
345358 postsecondary opportunities shall include Advanced Placement,
346359 International Baccalaureat e, dual and concurrent enrollment,
347360 internships, mentorships and apprenticeships, and industry
348361 certifications be based on the percentage of high school students
349362 who meet at least one of the following criteria:
350363 1. Achieving a benchmark score on the ACT or S AT;
351364 2. Scoring a 3, 4, or 5 on an Advanced Placement examination;
352365 3. Scoring a 4, 5, 6 , or 7 on an International Baccalaur eate
353366 examination;

385399 7. Being accepted for enlistment into the United States Armed
386400 Forces.
387401 The Board shall adopt a time line for moving from completion of
388402 such opportunities t o crediting achievement of such opportunities.
389403 I. The annual report shall identify the performance of each
390404 school as having improved, remained the same, or declined. This
391405 school improvement rating sh all be based on a comparison of the
392406 student and school performance data of the current year to the
393407 previous year data.
394408 J. The State Department of Education shall annually develop a
395409 school site report card to be delivered to pare nts or legal
396410 guardians throughout each school district. The report card shall b e
397411 in accordance with the requirements of the Elementary and Secondary
398412 Education Act of 1965 (ESEA), as reauthorized and amende d by P.L.
399413 No. 114-95, also known as the Every Stud ent Succeeds Act (ESSA) and
400414 includes include the grade for the school, information regarding
401415 school improvement, an explanation of school performance, and
402416 indicators of return on investment. The report car d for each school
403417 site shall be published annually by the Department on its w ebsite,

430445 and every school district shall provide the sch ool site report card
431446 to the parent or legal guardian of each student enrolled in the
432447 school site. In order to provide infor mation regarding school
433448 performance for school rep ort cards issued during the 2016-2017 and
434449 2017-2018 school year years, the Department shall include an
435450 explanation of the changes to the statewide system of student
436451 assessments as required in Section 1210.5 08 of this title and how
437452 the transition in assessm ents may impact school perf ormance. The
438453 Department shall issue school report card s using the 2016-2017
439454 school year assessment data that is available.
440455 K. The Legislature may factor in the performance of sc hools in
441456 calculating any performance-based funding policy that is provided to
442457 public school districts.
443458 L. The State Board of Educat ion shall promulgate rules to
444459 implement the provisions of this section.
445460 SECTION 3. This act shall become ef fective November 1, 2023.
