27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 59 O.S. 2021, Section 1308, is
30	57		amended to read as follows:

32	58		Section 1308. A. The applicant for bail bondsman licensure
33	59		shall be required to appear in person and take an examination
34	60		prepared by the Insurance Commissioner, testing the applicant’s
35	61		ability and qualifications to be a bail bondsman. Applicatio ns are
36	62		valid for three (3) months after submission. If an applicant has
37	63		not acted upon the application within t hat period, a new application
38	64		and fees shall be submitted for the appl icant to be considered for
39	65		licensure. Bail bondsman licenses issued prior to the effective

40	93		date of this act, as a result of a successful completion of a remote
41	94		examination, shall be valid licenses from the time of issuance.

43	95		B. Each applicant shall become elig ible for examination if the
44	96		applicant has completed sixteen (16) hours of education as required
45	97		by Section 1308.1 of this title prior to the exam ination.

48	98		Examinations shall be he ld at times and places as designated by the
49	99		Commissioner.

51	100		C. The fee for the examination shall be One Hundred Dollars
52	101		($100.00). Results will be provided after the applicant is
53	102		examined.

55	103		D. The failure of an applicant t o pass an examination shall not
56	104		preclude the applicant from taking subsequent ex aminations;
57	105		provided, however, that at least thirty (30) days shall intervene
58	106		between examinations; and provided further, after a third or
59	107		subsequent examination failure, an ap plicant may not be examined for
60	108		at least one (1) year after the last examination failure.

62	109		SECTION 2. It being immediately necessary for the preservation
63	110		of the public peace, health or safety, an emergency is hereby
64	111		declared to exist, by reason whereof this act shall take e ffect and
65	112		be in full force from and after its passage and approval.
