75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 1450.1 of Title 12, unless there
78	78	is created a duplication in num bering, reads as follows:
79	79	A. Any person who, by means of a telecommunication or other
80	80	electronic communication device, either:
81	81	1. Makes any comment, request, suggestion, or proposal which is
82	82	obscene, lewd, lascivious, filthy, or indecent;
83	83	2. Makes a telecommunication or other electronic communication ,
84	84	including text, sound, or image fo r the purpose of terrifying,
85	85	intimidating, harassing, or threatening to inflict injury or
86	86	physical harm to any person or prop erty of that person;

138	138	3. Makes a telecommuni cation or other electronic communication,
139	139	whether or not conversation ensues fo r the purpose of putting the
140	140	party in fear of physical harm or de ath;
141	141	4. Makes a telecommunica tion or other electronic communication,
142	142	including text, sound, or images wh ether or not conversation ensues,
143	143	without disclosing the identity of the person making the call or
144	144	communication and for the purpose of annoying, abusing, threatening,
145	145	or harassing any person at the called number;
146	146	5. Makes a telecommunication or other ele ctronic communication,
147	147	including text, sound, or images for the purpose of intimidati ng or
148	148	threatening a person to alter his or her mode o f carrying on
149	149	business or to interrupt the carrying on of business;
150	150	6. Knowingly permits any telecommunication or oth er electronic
151	151	communication under the control of the person to be used for any
152	152	purpose prohibited by this section; and
153	153	7. In conspiracy or concerted action with other persons, makes
154	154	repeated calls or el ectronic communications or simultaneous calls or
155	155	electronic communications solely to harass any person at the called
156	156	number,
157	157	shall be liable for online harassment and liable for any damages
158	158	sustained by the person or persons injur ed as a result thereof.
159	159	B. As used in this section:
160	160	1. “Electronic communication” and “telecommunication” means any
161	161	type of telephonic, electronic or radio communicatio ns, or

213	213	transmission of signs, signals, data, writings, image s, and sounds
214	214	or intelligence of any nature by telephone, including cellular
215	215	telephones, wire, cable, radi o, electromagnetic, photoelectron ic or
216	216	photo-optical system or the creation , display, management, storage,
217	217	processing, transmission or distribution of images, text, voice,
218	218	video or data by wire, cable or wireless means, including the
219	219	internet. The term includes:
220	220	a. a communication initiated by electronic mail, instant
221	221	message, network call, or facsimile machine including
222	222	text, sound or images,
223	223	b. a communication made to a pag er, or
224	224	c. a communication including text, sound, or images
225	225	posted to a social m edia or other public media source;
226	226	and
227	227	2. “Person” means either a natural person o r entity.
228	228	C. At the time of filing a petition for an action pursuant to
229	229	this section, the plaintiff may re quest injunctive relief to prevent
230	230	any further intimidation, haras sment, threat, or abuse by means of a
231	231	telecommunication or other electronic communication dev ice. The
232	232	plaintiff may be awarded dam ages as provided in su bsection D of this
233	233	section.
234	234	D. Actual damages shall include but not be limited to funds
235	235	spent related to counseling or libel. P unitive damages of not less
236	236	than Five Hundred Dollars ($500.00) per individual may be awarded to

288	288	the injured party or parties. The prevailing party in any act ion
289	289	under this section shall be entitled t o court costs and reasonable
290	290	attorney fees.
291	291	E. The remedies provided for in this section are cumulative and
292	292	shall be in addition to any others provided for by law.
293	293	SECTION 2. This act shall become effective November 1, 2023.
