7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new section of law to be codified
7777 in the Oklahoma Statutes as Section 1450.1 of Title 12, unless there
7878 is created a duplication in num bering, reads as follows:
7979 A. Any person who, by means of a telecommunication or other
8080 electronic communication device, either:
8181 1. Makes any comment, request, suggestion, or proposal which is
8282 obscene, lewd, lascivious, filthy, or indecent;
8383 2. Makes a telecommunication or other electronic communication ,
8484 including text, sound, or image fo r the purpose of terrifying,
8585 intimidating, harassing, or threatening to inflict injury or
8686 physical harm to any person or prop erty of that person;

138138 3. Makes a telecommuni cation or other electronic communication,
139139 whether or not conversation ensues fo r the purpose of putting the
140140 party in fear of physical harm or de ath;
141141 4. Makes a telecommunica tion or other electronic communication,
142142 including text, sound, or images wh ether or not conversation ensues,
143143 without disclosing the identity of the person making the call or
144144 communication and for the purpose of annoying, abusing, threatening,
145145 or harassing any person at the called number;
146146 5. Makes a telecommunication or other ele ctronic communication,
147147 including text, sound, or images for the purpose of intimidati ng or
148148 threatening a person to alter his or her mode o f carrying on
149149 business or to interrupt the carrying on of business;
150150 6. Knowingly permits any telecommunication or oth er electronic
151151 communication under the control of the person to be used for any
152152 purpose prohibited by this section; and
153153 7. In conspiracy or concerted action with other persons, makes
154154 repeated calls or el ectronic communications or simultaneous calls or
155155 electronic communications solely to harass any person at the called
156156 number,
157157 shall be liable for online harassment and liable for any damages
158158 sustained by the person or persons injur ed as a result thereof.
159159 B. As used in this section:
160160 1. “Electronic communication” and “telecommunication” means any
161161 type of telephonic, electronic or radio communicatio ns, or

213213 transmission of signs, signals, data, writings, image s, and sounds
214214 or intelligence of any nature by telephone, including cellular
215215 telephones, wire, cable, radi o, electromagnetic, photoelectron ic or
216216 photo-optical system or the creation , display, management, storage,
217217 processing, transmission or distribution of images, text, voice,
218218 video or data by wire, cable or wireless means, including the
219219 internet. The term includes:
220220 a. a communication initiated by electronic mail, instant
221221 message, network call, or facsimile machine including
222222 text, sound or images,
223223 b. a communication made to a pag er, or
224224 c. a communication including text, sound, or images
225225 posted to a social m edia or other public media source;
226226 and
227227 2. “Person” means either a natural person o r entity.
228228 C. At the time of filing a petition for an action pursuant to
229229 this section, the plaintiff may re quest injunctive relief to prevent
230230 any further intimidation, haras sment, threat, or abuse by means of a
231231 telecommunication or other electronic communication dev ice. The
232232 plaintiff may be awarded dam ages as provided in su bsection D of this
233233 section.
234234 D. Actual damages shall include but not be limited to funds
235235 spent related to counseling or libel. P unitive damages of not less
236236 than Five Hundred Dollars ($500.00) per individual may be awarded to

288288 the injured party or parties. The prevailing party in any act ion
289289 under this section shall be entitled t o court costs and reasonable
290290 attorney fees.
291291 E. The remedies provided for in this section are cumulative and
292292 shall be in addition to any others provided for by law.
293293 SECTION 2. This act shall become effective November 1, 2023.
