65	65	An Act relating to the state Medicaid program;
66	66	directing Oklahoma Health Care Authority to submit
67	67	certain State Plan amendment; requiring inclusion of
68	68	certain services; authorizing promulgation of rules;
69	69	providing for codification; and providing an

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
76	76	SECTION 1. NEW LAW A new section o f law to be codified
77	77	in the Oklahoma Statutes as Section 5028.2 of Title 63, unless there
78	78	is created a duplication in numbering, reads as follows:
79	79	A. The Oklahoma Health Care Authority shall sub mit a Medicaid
80	80	State Plan amendment to the Centers for Medica re and Medicaid
81	81	Services to permit schools to seek reimbursement for Medicaid
82	82	1905(a) services delivered in a school setting without the
83	83	requirement for an individualized education plan (IEP).
84	84	B. Services included in the State Plan amendment shall include :
85	85	1. Nursing;
86	86	2. Behavioral health;

141	141	C. The Oklahoma Health Care Authority Board may promulgate
142	142	rules as necessary to prov ide for the implementation of this
143	143	section.
144	144	SECTION 2. This act shall become effective November 1, 2023.
