161 | 161 | | SECTION 2. NEW LAW A new section of law to be codified |

162 | 162 | | in the Oklahoma Statutes as Section 3600 of Title 62, unless there |
---|
163 | 163 | | is created a duplication in numb ering, reads as follows: |

164 | 164 | | A. Implementation of this act shall be subject to the receipt |
---|
165 | 165 | | of appropriations sufficient to establi sh the Oklahoma Prosperity |
---|
166 | 166 | | Act Program, as defin ed in this section. |
---|
167 | 167 | | B. As used in this act: |
---|
168 | 168 | | 1. "Administrative fund" shall mean the Oklahoma Prosperity Act |
---|
169 | 169 | | administrative fund established under this act; |
---|
170 | 170 | | 2. "Contribution rate" means the percentage of th e wages of a |
---|
171 | 171 | | covered employee that is withheld f rom his or her wages and paid to |
---|
172 | 172 | | the individual retirement account or individual re tirement annuity |
---|
173 | 173 | | established for the covered employee under the Program; |
---|
174 | 174 | | 3. "Covered employee" means any individual who is e ighteen (18) |
---|
175 | 175 | | years of age or older, who is emplo yed by a participating employ er |

235 | 235 | | the state; provided, that a federal or st ate entity, agency, or |
---|
236 | 236 | | instrumentality or any political subdivision thereof, shall not be |
---|
237 | 237 | | an employer; |
---|
238 | 238 | | 5. "Enrollee" means any covered employee enrolled in the |
---|
239 | 239 | | Oklahoma Prosperity Act Program; |
---|
240 | 240 | | 6. "Internal Revenue Code" means the federal Internal Revenue |
---|
241 | 241 | | Code of 1986, as amended; |
---|
242 | 242 | | 7. "Investment adviser" means either: |
---|
243 | 243 | | a. an investment advise r registered under the U.S. |
---|
244 | 244 | | Investment Advisers Act of 1940, or |
---|
245 | 245 | | b. a bank or other institution ex empt from registration |
---|
246 | 246 | | under the U.S. Investment Advisers Act of 1940; |
---|
247 | 247 | | 8. "Investment fund" means each investment portfolio |
---|
248 | 248 | | established within the tru st for investment purposes; |
---|
249 | 249 | | 9. "IRA" means either an individual retirement account or |
---|
250 | 250 | | individual retirement annuity establi shed under Section 408 or 408A |
---|
251 | 251 | | of Title 26 of the I nternal Revenue Code; |

---|
308 | 308 | | including plans qualified under Section 401(a), 401(k), 403(a), |
---|
309 | 309 | | 403(b), 408(k), 408(p), 457(b), or 457(f) of Title 26 of the |
---|
310 | 310 | | Internal Revenue Code or any deferred compensa tion plan offered by |
---|
311 | 311 | | any employer at any time during the preceding two (2) calendar |
---|
312 | 312 | | years; |
---|
313 | 313 | | 11. "Program" means the Oklahoma Prosperity Act Program |
---|
314 | 314 | | established under this act; |
---|
315 | 315 | | 12. "State" means the State of Oklahoma; |
---|
316 | 316 | | 13. "State Treasurer" means the Oklahoma State Treasurer; |
---|
317 | 317 | | 14. "Trust" means the IRA retirement trust or annuity contract |
---|
318 | 318 | | established under Section 7 of this act; |
---|
319 | 319 | | 15. "Trustee" means the trustee of the trust including an |
---|
320 | 320 | | insurance company is suing an annuity contract selected under Section |
---|
321 | 321 | | 4 of this act; and |
---|
322 | 322 | | 16. "Wages" means compensation within the meaning of Section |
---|
323 | 323 | | 219(f)(1) of Title 26 of the Internal Revenue Code that is received |
---|
324 | 324 | | by a covered employee from a participating employer. |

384 | 384 | | 2. To collect fees to defray the costs of a dministering the |

---|
386 | 386 | | 3. To enter into contracts nec essary or desirable fo r the |
---|
387 | 387 | | establishment and administ ration of the Program; |

388 | 388 | | 4. To hire, retain, and termin ate third-party service providers |
---|
389 | 389 | | for the Program including, but not limited to, consultant s, |
---|
390 | 390 | | investment managers or ad visors, trustees, custodians, insurance |
---|
391 | 391 | | companies, record keepers, administrators, actuaries, counsel, |
---|
392 | 392 | | auditors, and other professionals; provided, that each service |
---|
393 | 393 | | provider shall be authorized to do business in this state. Fo r |
---|
394 | 394 | | purposes of selecting a th ird-party service provider, t he Office of |
---|
395 | 395 | | the State Treasurer shall be exempt from the Oklahoma Central |
---|
396 | 396 | | Purchasing Act; provided, that a competitive process shall be |
---|

458 | 458 | | to operate the Program in accordance with the provisions of this |

459 | 459 | | act. Any guidelines or procedures affectin g the Program may be |
---|
460 | 460 | | implemented after reasonable noti ce to the public and a public |
---|
461 | 461 | | comment period, in a manner similar to the requirements of the |
---|
462 | 462 | | Administrative Procedures Act. However, the A dministrative |
---|
463 | 463 | | Procedures Act shall not apply for purposes of th is section; and |
---|
464 | 464 | | 9. If applicable, to establish and maintain the Program by |
---|
465 | 465 | | contracting with another state, partnering with one or more states |
---|
466 | 466 | | to create a joint auto -IRA program, allowing state s to participate |
---|
467 | 467 | | in the Program, or forming a consortium with o ne or more other |
---|
468 | 468 | | states in which certain aspects of th e Program of each state are |
---|
469 | 469 | | combined for administrative convenience and efficiency. |
