75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 10 O.S. 2021, Section 405.4, is
77	77	amended to read as follows:
78	78	Section 405.4. A. Any person with a bachelor ’s degree or
79	79	postgraduate degree shall be considered as having met the
80	80	educational requirements for a director of a full -time child care
81	81	center required by the Department of Human S ervices. Nothing in
82	82	this section shall be construed as to affect annual continuing
83	83	education requirements. The director of a child care center may
84	84	also qualify as a master teacher for children of all ages.
85	85	B. Any person replacing a master teacher at a c hild care center
86	86	shall be granted a one -year probationary period to fulfill the
87	87	educational qualifications required by the Department for a master

139	139	teacher. The Department may extend the probationary period an
140	140	additional year as long as the person is activ ely pursuing that
141	141	goal.
142	142	C. Licensed child care facilities opened or expanded before
143	143	November 1, 2016, shall have thirty -five (35) square feet of floor
144	144	area per infant in rooms occupied only by infants. New constr uction
145	145	and existing space not previously l icensed for child care after
146	146	November 1, 2016, shall have forty (40) square feet of floor area
147	147	per infant in rooms occupied only by infants.
148	148	D. The Director of th e Department shall not require child care
149	149	centers to have a master teacher for every classroom. However, the
150	150	Director may establish a ratio for master teachers to children .
151	151	SECTION 2. This act shall become effective November 1, 2023.
