2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 12 O.S. 2021, Secti on 2803.1, is
3057 amended to read as follows:

3258 Section 2803.1. A. A statement made by a child who has not
3359 attained thirteen (13) sixteen (16) years of age at the time the
3460 statement is made, a child thirteen (13) sixteen (16) years of age
3561 or older who has a disability, or a person who is an incapacitated
3662 person as such term is defined by the provisions of Section 10-103
3763 of Title 43A of the Oklahoma Statutes, which describes any act of
3864 physical abuse against the child or incapacitated person or a ny act
3965 of sexual contact performed wi th or on the child or incapacitated

4093 person by another, is admissible in criminal and juvenile
4194 proceedings in the courts in this state if:

4395 1. The court finds, in a hearing conducted outside the presence
4496 of the jury, that the time, content, and totality of circumstances
4597 surrounding the taking of the statement provide sufficient indicia
4698 of reliability so as to render it the statement inherently

4999 trustworthy. In determining such trustworthiness, the court may
50100 consider, among other things, the following factors including but
51101 not limited to:

53102 a. the spontaneity and consistent repetition of the
54103 statement,
55-
56104 b. the mental state of the declarant,
57-
58105 c. whether the terminology used is u nexpected of a child
59106 of similar age or of an incapacitated person, and
60-
61107 d. whether a lack of motive to fabricate exists; and
62-
63108 2. The child or incapacitated person either:
64-
65109 a. testifies or is available to testify at the
66110 proceedings in open court or through an alternative
67111 method pursuant to the provisions of the Uniform Child
68112 Witness Testimony by Alternative Methods Act or
69113 Section 2611.2 of this title, or
70-
71114 b. is unavailable as defined in Section 2804 of this
72115 title as a witness. When the child or incapacitated
73116 person is unavailable, such the statement may be

77146 B. A statement may not be admitted under this section unless
78147 the proponent of the statement makes known to the adverse party an
79148 intention to offer the statement and the particulars of the
80149 statement at least ten (10) days in advance of the proceedings to
81150 provide the adverse party with an opportunity to prepare to answer
82151 the statement.

84152 C. As used in this section, “disability” means a physical or
85153 mental impairment which substantially limits one or more of the
86154 major life activities of the child or the child is regarded as
87155 having such an impairment by a competent medical professional.

89156 SECTION 2. This act shall become effective November 1 , 2023.
