65	65	An Act relating to wildlife; amending 29 O.S. 2021,
66	66	Section 5-213, as amended by S ection 1, Chapter 253,
67	67	O.S.L. 2022 (29 O.S. Supp. 2022, Section 5-213),
68	68	which relates to air bows; allowing for a physically
69	69	disabled person to use air bows under certain
70	70	conditions; and providing an effective date.

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 29 O.S. 2021, Section 5 -213, as
77	77	amended by Section 1, Chapter 253, O.S.L. 2022 (29 O.S. Supp. 2022,
78	78	Section 5-213), is amended to read as follow s:
79	79	Section 5-213. A. The use of crossbows and conventional
80	80	longbows with a device that permits the bow to be held mechanically
81	81	at full or partial draw, shall be a legal hunting meth od during any
82	82	open season when convent ional longbows are a legal means of take.
83	83	B. The use of air bows shall b e a legal hunting method duri ng
84	84	any open season when rifles are a legal means of take , except as
85	85	provided in subsection C of this section. No person may hunt or
86	86	take during the open season with an air bow unless the person has

139	139	Commission for a one-time fee of Twenty D ollars ($20.00).
140	140	C. A permanently physically disabled person may use an air bow
141	141	as a legal hunting method during any open season when archery is a
142	142	legal means of take.
143	143	D. At such time as the Federal Aid in Wildlife Restorati on Act
144	144	is amended to expand the excise tax on sporting arms and ammunition
145	145	to include air bows and air guns, the stamp pursuant to s ubsection B
146	146	of this section shall no longer be re quired, and authorization for
147	147	the continual use of air bows as a legal mean s of take shall be
148	148	established by rules pr omulgated by the Commission.
149	149	SECTION 2. This act shall become effective November 1, 2023.
