7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
7878 SECTION 1. AMENDATORY 22 O.S. 2021, Section 1101, as
7979 amended by Section 1, Chapter 117, O.S.L. 2022 (22 O.S. Supp. 2022,
8080 Section 1101), is amended to read as follows:
8181 Section 1101. A. Except as otherwise provided by law, bail , by
8282 sufficient sureties, shall be admitted upon all arres ts in criminal
8383 cases where the offense is not punishable by death and in such cases
8484 it may be taken by any of the persons or courts authorized by law to
8585 arrest, to imprison offenders or to perform pretrial servi ces, or by
8686 the clerk of the district court or his or her deputy, or by the
8787 judge of such courts.

139139 B. In criminal cases where the defendant is currently an
140140 escaped prisoner from the Department of Correction s, the defendant
141141 must be processed back into the De partment of Corrections prior to
142142 bail being set on new criminal charges.
143143 C. All persons shall be bailab le by sufficient sureties, except
144144 that bail may be denied for:
145145 1. Capital offenses when the proof of guilt is evident, or the
146146 presumption thereof is gr eat;
147147 2. Violent offenses;
148148 3. Offenses where the maximum sentence may be life imprisonment
149149 or life imprisonment without parole;
150150 4. Felony offenses where the person charged with the offense
151151 has been convicted of two or more felony offenses arising out of
152152 different transactions; and
153153 5. Controlled dangerous substances offenses where the maximum
154154 sentence may be at least ten (10) years’ imprisonment.
155155 On all offenses specified in paragraphs 2 through 5 of this
156156 subsection, the proof of guilt must be evident, or the presumption
157157 must be great, and i t must be on the grounds that no condition of
158158 release would assure the safety of the community or any person.
159159 D. There shall be a rebuttable presumption that no condit ion of
160160 release would assure the safety of the commu nity if the state shows
161161 by clear and convincing evidence that the person was arrested for a
162162 violation of Section 741 of Title 21 of the Oklahoma Statutes.

214214 E. If the person was arrested for any crime provided for in the
215215 Protection from Domestic Abuse Act o r a violent crime provided for
216216 in Section 571 of Title 57 of the Oklahoma Statutes, the court shall
217217 be responsible for assessing prior patterns of abuse and shall
218218 present written findings on the bail amount.
219219 F. No court in this state shall discontinue the use of cash
220220 bail; provided, however, any court may utilize own reco gnizance
221221 bonds, electronic monitoring, and other means in addition to cash
222222 bail.
223223 SECTION 2. This act shall become effective November 1, 2023.
