7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Sect ion 5087.1 of Title 74, unless there
8282 is created a duplication in numbering, reads as follows:
8383 This act shall be known and may be c ited as the “Oklahoma Rural
8484 Investment for Sow Farms Act of 2023 ”.
8585 SECTION 2. NEW LAW A new section of law to be codified

139139 A. The Oklahoma Department of Commerce is hereby authorized to
140140 establish and administer the Oklahoma Rural In vestment for Sow Farms
141141 Program.
142142 B. The purpose of the Oklahoma Rural Investment for Sow Farms
143143 Program is to create investment and jobs in the p ig industry that
144144 align with traditional farming animal care values and to offs et the
145145 costs of compliance with st ate and federal regulation s of
146146 agriculture facilitie s that currently use extreme confinement
147147 gestation stalls or crates for pregnant pigs, throug h the allocation
148148 of funds to farms, cooperatives, b usiness entities, and other
149149 agricultural entities to:
150150 1. Update breeding sow pig facilities currently using
151151 individual gestation crates (typically measuring six and six-tenths
152152 [6.6] feet by two [2] feet per sow) into group housing pens, o f a
153153 minimum thirty-seven and six-tenths (37.6) square feet of usable
154154 floor space per sow, for pregn ant pigs;
155155 2. Fund complete removal of gestation crates;
156156 3. Fund renovation of existing space and construction of group
157157 housing pens of a minimum thirty-seven and six-tenths (37.6) square
158158 feet of usable space per pregnant sow pig, and related structures,
159159 meeting Humane Farm Animal Car e size minimum space standard s; and
160160 4. Fund training of workers on methods of Humane Farm Animal
161161 Care standards for group housing techniques for pregnant pigs.
162162 C. The Program shall consist of the following categories:

214214 1. Removal of gestation crates;
215215 2. Installation of group housing pens and related technology;
216216 3. Training of management teams on humane methods, technology,
217217 and humane husbandry skills;
218218 4. Pledge from grant recipient that all uses of individual
219219 gestation crates shall be phased out permanently and in perpetuity
220220 within three (3) years of accepting funds. Evidence of gestation
221221 crate use at any point in the future shall require all grant funds
222222 to be returned to this state. The pledge applies to all breeding
223223 sow pig entities, corporations, cooperatives, and farms associated
224224 with an individual applicant;
225225 5. Additional rebates and incentives for participating farms
226226 that make the complete conversions within on e (1) year of grant
227227 application approval, to be established by the Department i n its
228228 regulations governing the program, based on a per sow scheme; and
229229 6. Credits per sow for sow farms of four pigs or more with pre -
230230 existing group, pasture -raised, hoop barns, or Certified Humane
231231 housing, prior to November 1, 2023.
232232 D. The Oklahoma Department of Commerce shall promulgate rules
233233 governing the Oklahoma Rural Investment for Sow Farms Program.

288288 A. There is hereby created in the State Treasury a revolving
289289 fund for the Oklahoma Department of Commerce to be designate d the
290290 “Oklahoma Rural Investment for Sow Farms Revolving Fund”. The fund
291291 shall be a continuing fund, not subject to fiscal year limitations,
292292 and shall consist of all monies received by the Oklahoma Department
293293 of Commerce to implement and maintain the Okla homa Rural Investment
294294 for Sow Farms Program.
295295 B. The Oklahoma Rural Investment for Sow Farms Revolving Fund
296296 shall consist of:
297297 1. Money received by the Oklahoma Department of Commerce in the
298298 form of a one-time forty-seven-million-dollar appropriation
299299 allocated by the State of Oklahoma for renovation and improvement of
300300 breeding sow pig housi ng facilities and such other monies
301301 specifically designated for the Oklahoma Rural Investment for Sow
302302 Farms Program. All monies accruing to the credit of the fund are
303303 hereby appropriated and may be budge ted and expended by the Oklahoma
304304 Department of Commerce for the Oklahoma Rural Investment for Sow
305305 Farms Program; and
306306 2. Interest attributable to investment of money in the fund.
307307 C. All appropriations received by the Depa rtment pursuant to
308308 the provisions of this section shall be deposited with the State
309309 Treasurer to be created or credited to the Oklahoma Rural Investment
310310 for Sow Farms Revolving Fund. Expenditures from the fund shall be
311311 made upon warrants issued by the Sta te Treasurer against claims

363363 filed as prescribed by law with the Director of the Office of
364364 Management and Enterprise Services for approval and payment.
365365 D. The monies deposited in the fund shall at no time become
366366 part of the general budget of the Department or any other state
367367 agency. Except for any administration costs incurred in developme nt
368368 and implementation of the Oklahoma Rural Investment for Sow Farms
369369 Program, no monies from the fund shall be transferred for any
370370 purpose to any other state agency or to any account of the Oklahoma
371371 Department of Commerce or be used for the purpose of cont racting
372372 with any other state agency or reimbursing any other state agency
373373 for any expense.
374374 SECTION 4. NEW LAW A new section of law to be codifie d
375375 in the Oklahoma Statutes as Sect ion 5087.4 of Title 74, unless there
376376 is created a duplication in numbering, reads as follows:
377377 A. The Oklahoma Department of Commerce shall require eligible
378378 applicants to submit information, forms , and reports as are
379379 necessary to properly and efficiently a dminister the Oklahoma Rural
380380 Investment for Sow Farms Program.
381381 B. Persons may apply to the Department for grant funds in
382382 accordance with rules promulgated by the Oklahom a Department of
383383 Commerce. Applications for grant fu nds shall be approved or denied
384384 by the Oklahoma Department of Commerce in accordance w ith criteria
385385 promulgated by the Oklahoma Department of Commerce pursuant to the

438438 standards set forth by H umane Farm Animal Care.
439439 C. Grant funds may be made available to eligible applicants
440440 pursuant to evaluation by the Depart ment based on the following
441441 criteria:
442442 1. Preference may be given to the applicants whose:
443443 a. swine operations are licensed or register ed with this
444444 state,
445445 b. employee or contractor qualifications include career -
446446 tech certification, or higher education degre es,
447447 including associate degrees , or
448448 c. commitment to humane treatment of farm animals, with
449449 respect to their lives and habits, has been
450450 demonstrated; or, desire to commit to humane
451451 facilities for pregnant pigs has been well documented
452452 and expressed; and
453453 2. Consideration shall not be given to applications for:
454454 a. the construction of individual gestation crates,
455455 farrowing crates, or any fa rm facilities unrelated to
456456 the humane housing of breeding sow pigs ,
457457 b. farms outside of this state,
458458 c. individual or group pens smaller than thirty-seven and
459459 six-tenths (37.6) square feet of usable floor space
460460 per sow pig,

512512 d. facilities, companies, farms, and cooperatives that
513513 will or plan to co-produce or co-locate pregnant sow
514514 pigs in confinement gestation stalls in o ther or
515515 associated barns in this state,
516516 e. facilities, companies, farms, and cooperatives th at do
517517 not pledge to phase out completely and in perpetuity
518518 within three (3) years of grant application date , or
519519 f. entities, facilities, corporations, or farms less than
520520 three (3) years old as of November 1, 202 3.
521521 D. 1. Any information subm itted to or compiled by the Oklahoma
522522 Department of Commerce wi th respect to the financial statem ents,
523523 trade secrets, or any other proprietary inform ation of persons,
524524 firms, associations, partnerships , agencies, corporations,
525525 institutions of higher education, nonpro fit research institutions ,
526526 or other entities pursuant to the Oklahoma Rural Investment for Sow
527527 Farms Program shall not be disclosed pursuan t to the Oklahoma Open
528528 Records Act or in public hea rings and shall be kept confidential ,
529529 except to the extent that the person or entity which provided such
530530 information or which is the subject of such info rmation consents to
531531 disclosure.
532532 2. An independent committee of reviewers, no fewer than three
533533 and no more than seven, comprised entirely a nd equally of qualified
534534 veterinarians, farmers, and experienced animal wellbeing ex perts,
535535 appointed by the Governor, shall be designated to analyze and
