80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Sect ion 5087.1 of Title 74, unless there
82	82	is created a duplication in numbering, reads as follows:
83	83	This act shall be known and may be c ited as the “Oklahoma Rural
84	84	Investment for Sow Farms Act of 2023 ”.
85	85	SECTION 2. NEW LAW A new section of law to be codified
86	86	in the Oklahoma Statutes as Sect ion 5087.2 of Title 74, unless there

139	139	A. The Oklahoma Department of Commerce is hereby authorized to
140	140	establish and administer the Oklahoma Rural In vestment for Sow Farms
141	141	Program.
142	142	B. The purpose of the Oklahoma Rural Investment for Sow Farms
143	143	Program is to create investment and jobs in the p ig industry that
144	144	align with traditional farming animal care values and to offs et the
145	145	costs of compliance with st ate and federal regulation s of
146	146	agriculture facilitie s that currently use extreme confinement
147	147	gestation stalls or crates for pregnant pigs, throug h the allocation
148	148	of funds to farms, cooperatives, b usiness entities, and other
149	149	agricultural entities to:
150	150	1. Update breeding sow pig facilities currently using
151	151	individual gestation crates (typically measuring six and six-tenths
152	152	[6.6] feet by two [2] feet per sow) into group housing pens, o f a
153	153	minimum thirty-seven and six-tenths (37.6) square feet of usable
154	154	floor space per sow, for pregn ant pigs;
155	155	2. Fund complete removal of gestation crates;
156	156	3. Fund renovation of existing space and construction of group
157	157	housing pens of a minimum thirty-seven and six-tenths (37.6) square
158	158	feet of usable space per pregnant sow pig, and related structures,
159	159	meeting Humane Farm Animal Car e size minimum space standard s; and
160	160	4. Fund training of workers on methods of Humane Farm Animal
161	161	Care standards for group housing techniques for pregnant pigs.
162	162	C. The Program shall consist of the following categories:

215	215	2. Installation of group housing pens and related technology;
216	216	3. Training of management teams on humane methods, technology,
217	217	and humane husbandry skills;
218	218	4. Pledge from grant recipient that all uses of individual
219	219	gestation crates shall be phased out permanently and in perpetuity
220	220	within three (3) years of accepting funds. Evidence of gestation
221	221	crate use at any point in the future shall require all grant funds
222	222	to be returned to this state. The pledge applies to all breeding
223	223	sow pig entities, corporations, cooperatives, and farms associated
224	224	with an individual applicant;
225	225	5. Additional rebates and incentives for participating farms
226	226	that make the complete conversions within on e (1) year of grant
227	227	application approval, to be established by the Department i n its
228	228	regulations governing the program, based on a per sow scheme; and
229	229	6. Credits per sow for sow farms of four pigs or more with pre -
230	230	existing group, pasture -raised, hoop barns, or Certified Humane
231	231	housing, prior to November 1, 2023.
232	232	D. The Oklahoma Department of Commerce shall promulgate rules
233	233	governing the Oklahoma Rural Investment for Sow Farms Program.

288	288	A. There is hereby created in the State Treasury a revolving
289	289	fund for the Oklahoma Department of Commerce to be designate d the
290	290	“Oklahoma Rural Investment for Sow Farms Revolving Fund”. The fund
291	291	shall be a continuing fund, not subject to fiscal year limitations,
292	292	and shall consist of all monies received by the Oklahoma Department
293	293	of Commerce to implement and maintain the Okla homa Rural Investment
294	294	for Sow Farms Program.
295	295	B. The Oklahoma Rural Investment for Sow Farms Revolving Fund
296	296	shall consist of:
297	297	1. Money received by the Oklahoma Department of Commerce in the
298	298	form of a one-time forty-seven-million-dollar appropriation
299	299	allocated by the State of Oklahoma for renovation and improvement of
300	300	breeding sow pig housi ng facilities and such other monies
301	301	specifically designated for the Oklahoma Rural Investment for Sow
302	302	Farms Program. All monies accruing to the credit of the fund are
303	303	hereby appropriated and may be budge ted and expended by the Oklahoma
304	304	Department of Commerce for the Oklahoma Rural Investment for Sow
305	305	Farms Program; and
306	306	2. Interest attributable to investment of money in the fund.
307	307	C. All appropriations received by the Depa rtment pursuant to
308	308	the provisions of this section shall be deposited with the State
309	309	Treasurer to be created or credited to the Oklahoma Rural Investment
310	310	for Sow Farms Revolving Fund. Expenditures from the fund shall be
311	311	made upon warrants issued by the Sta te Treasurer against claims

364	364	Management and Enterprise Services for approval and payment.
365	365	D. The monies deposited in the fund shall at no time become
366	366	part of the general budget of the Department or any other state
367	367	agency. Except for any administration costs incurred in developme nt
368	368	and implementation of the Oklahoma Rural Investment for Sow Farms
369	369	Program, no monies from the fund shall be transferred for any
370	370	purpose to any other state agency or to any account of the Oklahoma
371	371	Department of Commerce or be used for the purpose of cont racting
372	372	with any other state agency or reimbursing any other state agency
373	373	for any expense.
374	374	SECTION 4. NEW LAW A new section of law to be codifie d
375	375	in the Oklahoma Statutes as Sect ion 5087.4 of Title 74, unless there
376	376	is created a duplication in numbering, reads as follows:
377	377	A. The Oklahoma Department of Commerce shall require eligible
378	378	applicants to submit information, forms , and reports as are
379	379	necessary to properly and efficiently a dminister the Oklahoma Rural
380	380	Investment for Sow Farms Program.
381	381	B. Persons may apply to the Department for grant funds in
382	382	accordance with rules promulgated by the Oklahom a Department of
383	383	Commerce. Applications for grant fu nds shall be approved or denied
384	384	by the Oklahoma Department of Commerce in accordance w ith criteria
385	385	promulgated by the Oklahoma Department of Commerce pursuant to the

439	439	C. Grant funds may be made available to eligible applicants
440	440	pursuant to evaluation by the Depart ment based on the following
441	441	criteria:
442	442	1. Preference may be given to the applicants whose:
443	443	a. swine operations are licensed or register ed with this
444	444	state,
445	445	b. employee or contractor qualifications include career -
446	446	tech certification, or higher education degre es,
447	447	including associate degrees , or
448	448	c. commitment to humane treatment of farm animals, with
449	449	respect to their lives and habits, has been
450	450	demonstrated; or, desire to commit to humane
451	451	facilities for pregnant pigs has been well documented
452	452	and expressed; and
453	453	2. Consideration shall not be given to applications for:
454	454	a. the construction of individual gestation crates,
455	455	farrowing crates, or any fa rm facilities unrelated to
456	456	the humane housing of breeding sow pigs ,
457	457	b. farms outside of this state,
458	458	c. individual or group pens smaller than thirty-seven and
459	459	six-tenths (37.6) square feet of usable floor space
460	460	per sow pig,

513	513	will or plan to co-produce or co-locate pregnant sow
514	514	pigs in confinement gestation stalls in o ther or
515	515	associated barns in this state,
516	516	e. facilities, companies, farms, and cooperatives th at do
517	517	not pledge to phase out completely and in perpetuity
518	518	within three (3) years of grant application date , or
519	519	f. entities, facilities, corporations, or farms less than
520	520	three (3) years old as of November 1, 202 3.
521	521	D. 1. Any information subm itted to or compiled by the Oklahoma
522	522	Department of Commerce wi th respect to the financial statem ents,
523	523	trade secrets, or any other proprietary inform ation of persons,
524	524	firms, associations, partnerships , agencies, corporations,
525	525	institutions of higher education, nonpro fit research institutions ,
526	526	or other entities pursuant to the Oklahoma Rural Investment for Sow
527	527	Farms Program shall not be disclosed pursuan t to the Oklahoma Open
528	528	Records Act or in public hea rings and shall be kept confidential ,
529	529	except to the extent that the person or entity which provided such
530	530	information or which is the subject of such info rmation consents to
531	531	disclosure.
532	532	2. An independent committee of reviewers, no fewer than three
533	533	and no more than seven, comprised entirely a nd equally of qualified
534	534	veterinarians, farmers, and experienced animal wellbeing ex perts,
535	535	appointed by the Governor, shall be designated to analyze and
