25	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:

27	54		SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -302, is
28	55		amended to read as fo llows:
29		-
30	56		Section 2-302. A. Every person who manufactures, distributes,
31	57		dispenses, prescribes, administers or uses for scien tific purposes
32	58		any controlled dangerous substance within or into this state, or who
33	59		proposes to engage in the manufacture, distribution, dispensing,
34	60		prescribing, administering or use for scientific purposes o f any
35	61		controlled dangerous substance within or i nto this state shall
36	62		obtain a registration issued by the Director of the Oklahoma State
37	63		Bureau of Narcotics a nd Dangerous Drugs Control, in accordance with
38	64		rules promulgated by the Director . Persons registered by the

39	92		Director under Section 2 -101 et seq. of this title to manufacture,
40	93		distribute, dispense or conduct research with controlled dangerous
41	94		substances may possess, manufacture, distribute, dispense or conduct
42	95		research with those substances to the exten t authorized by their
43	96		registration and in confor mity with the other provision s of the
44	97		Uniform Controlled Dangerous Substances Act . Every wholesaler,
45	98		manufacturer or distributor of any drug product containing
46	99		pseudoephedrine or phenylpropanolamine, or thei r salts, isomers or

49	100		salts of isomers, shall obtain a registration issued by t he Director
50	101		of the Oklahoma State Bureau of Narcotics and Dangerous Drugs
51	102		Control in accordance with rules promulgated by the Director and as
52	103		provided for in Section 2 -332 of this title. Any person who
53	104		manufactures, distribute s, dispenses, prescribes, adm inisters or
54	105		uses for scientific purposes any controlled dangerous substances
55	106		within or into this state without first obtaining a registration
56	107		issued by the Director of the Oklahom a State Bureau of Narcotics and
57	108		Dangerous Drugs Control shall be subject to t he same statutory and
58	109		administrative jurisdiction of the Director as if that per son were
59	110		an applicant or registrant.

61	111		B. Out-of-state pharmaceutical suppliers who provide controll ed
62	112		dangerous substances to individuals within th is state shall obtain a
63	113		registration issued by the Director of the Oklahoma State Bureau of
64	114		Narcotics and Dangerous Drugs Control, in accordance with rules
65	115		promulgated by the Director . This provision shall a lso apply to

66	143		wholesale distributors who distribu te controlled dangerous
67	144		substances to pharmacies or other entities registered within this
68	145		state in accordance with rules promulgated by the Director.

70	146		C. Every person who owns in whole or in part a public or
71	147		private medical facility for which a majority of patients are issued
72	148		on a reoccurring monthly basis a prescription for opioids,
73	149		benzodiazepines, barbiturat es or carisoprodol, but not including
74	150		Suboxone buprenorphine with na loxone or buprenorphine as used for
75	151		medication-assisted treatment services, shall obtain a registration
76	152		issued by the Director of the Oklahoma State Bureau of Narcotics and
77	153		Dangerous Drugs Control.

79	154		D. Every manufacturer and distributor required to register
80	155		under the provisions of this section shall provide all data required
81	156		pursuant to 21 U.S.C., Section 827(d)(1) on a monthly basis to the
82	157		Oklahoma State Bureau of Narcotics and Dangerous Drugs Control .
83	158		Controlled dangerous substances in Schedule I shall be reported in
84	159		accordance with rules promulgated by the Director . Reporting of
85	160		controlled dangerous substances pursuant to 21 U.S.C., Section
86	161		827(d)(1) shall include, but not be limited to:

88	162		1. The manufacturer’s or distributor’s name, address, phone
89	163		number, DEA registration number and controlled dangerous substance
90	164		registration number issued by the Bureau;

94	165		2. The name, address and DEA registration number of the entity
95	166		to whom the controlled dangerous substance was sold;

97	194		3. The date of the sale of the controlled dangerous substance;

99	195		4. The name and National Drug Code of the controlled dangerous
100	196		substance sold; and

102	197		5. The number of containers and the strength and quantity of
103	198		controlled dangerous substances in each container sold.

105	199		E. The information maintaine d and provided pursuant to
106	200		subsection D of this section shall be confidential and not open to
107	201		the public. Access to the information shall, at the discretion of
108	202		the Director, be limited to:
109		-
110	203		1. Peace officers certified pursuant to the provisions of
111	204		Section 3311 of Title 70 of the Oklahoma Statutes who are employed
112	205		as investigative agents of the Oklahoma State B ureau of Narcotics
113	206		and Dangerous Drugs Control or the Office of the Attorney General;
114		-
115	207		2. The United States Drug Enforcement Administration Diversi on
116	208		Group Supervisor; and
117		-
118	209		3. A multicounty grand jury properly convened pursuant to the
119	210		provisions of the Mul ticounty Grand Jury Act.
120		-
121	211		F. Manufacturers, distributors, home care agencies, hospices,
122	212		home care services, medical facility owners referred to i n
123	213		subsection C of this section and scientific researchers shall obtain
124	214		a registration annually. Other practitioners shall obtain a
125	215		registration for a period to be determined by the Director that will
126	216		be for a period not less than one (1) year nor more tha n three (3)

129	245		G. Every trainer or handler of a canine controlled dangerous
130	246		substances detector who, in th e ordinary course of such trainer’s or
131	247		handler’s profession, desires to possess any controlled dangerou s
132	248		substance, annually, shall obtain a reg istration issued by t he
133	249		Director for a fee of Seventy Dollars ($70.00) . Such persons shall
134	250		be subject to all ap plicable provisions of Section 2-101 et seq. of
135		-

137	251		this title and such applicable rules promulgated by the Director for
138	252		those individuals identifie d in subparagraph a o f paragraph 32 of
139	253		Section 2-101 of this title. Persons registered by the Director
140	254		pursuant to this subsection may possess controlled dangerous
141	255		substances to the extent authorized by their regis tration and in
142	256		conformity with the other provisions of the Uni form Controlled
143	257		Dangerous Substances Act.

145	258		H. The following persons shall not be required t o register and
146	259		may lawfully possess controlled dangerous substances under the
147	260		provisions of Section 2 -101 et seq. of this title:
148		-
149	261		1. An agent, or an employee thereof , of any registered
150	262		manufacturer, distributor, dispenser or us er for scientific purposes
151	263		of any controlled dangerous substance, if such agent is acting in
152	264		the usual course of such agent ’s or employee’s business or
153	265		employment;

155	266		2. Any person lawfully acting under the direction of a person
156	267		authorized to administer cont rolled dangerous substances u nder
157	268		Section 2-312 of this title;

159	296		3. A common or contract carrier or warehouser, or an employee
160	297		thereof, whose possession of any controlled dangerous substance is
161	298		in the usual course of such carrier ’s or warehouser’s business or
162	299		employment;

164	300		4. An ultimate user or a person in possession of any controlled
165	301		dangerous substance pursuant to a lawful order of a practitioner;
166		-
167	302		5. An individual pharmacist acting in the usual course of such
168	303		pharmacist’s employment with a pharmacy regist ered pursuant to the
169	304		provisions of Section 2-101 et seq. of this title;
170		-
171	305		6. A nursing home licensed by this state;
172		-
173	306		7. Any Department of Mental Health and Substance Abuse Services
174	307		employee or any person whose facility contracts with the Department
175	308		of Mental Health and Substance Abuse Services whose possession of
176	309		any dangerous drug, as defined in Section 353.1 of Title 59 of the
177	310		Oklahoma Statutes, is for the purpose of delivery of a mental health
178	311		consumer’s medicine to the consumer ’s home or residence;

182	312		8. Registered nurses and licensed practical nurses; and
183		-
184	313		9. An assisted living facility licensed by the State of
185	314		Oklahoma this state.

187	315		I. The Director may, by rule, waive the re quirement for
188	316		registration or fee for registration of certain manufacturers,
189	317		distributors, dispensers, prescribe rs, administrators or users for
190	318		scientific purposes if the Director finds it consistent with the
191	319		public health and safety.

193	347		J. A separate registration shall be required at each principal
194	348		place of business or professional practi ce where the applicant
195	349		manufactures, distributes, dispenses, prescribes, administers or
196	350		uses for scientific purposes controlled dang erous substances.

198	351		K. The Director is authorized to inspect the establish ment of a
199	352		registrant or applicant for registration in accordance with rules
200	353		promulgated by the Director.
201		-
202	354		L. No person engaged in a profession or occupation for which a
203	355		license to engage in such activity is provided by la w shall be
204	356		registered under the Uni form Controlled Dangerous Substances Act
205	357		unless such person holds a valid licens e of such person’s profession
206	358		or occupation.
207		-
208	359		M. Registrations shall be issued on the first day of Nove mber
209	360		of each year. Registrations may be issued at other times, however,
210	361		upon certification of the professional licensing bo ard.
211		-
212	362		N. The licensing boards of all professions and occupations to
213	363		which the use of controlled dangerous substances is incidental s hall
214	364		furnish a current list to the Director, not later than the first day
215	365		of October of each year, of the persons holding va lid licenses. All
216	366		such persons except persons exempt from registration requirements
217	367		under subsection H of this section shall be sub ject to the
218	368		registration requirements of Section 2-101 et seq. of this ti tle.

220	369		O. The licensing board of any professional de fined as a mid-
221	370		level practitioner shall notify and furnish to the Director, not

225	399		professional holds a valid license, a current listing of individu als
226	400		licensed and registered with their respective b oards to prescribe,
227	401		order, select, obtain and administer controlled dangerous
228	402		substances. The licensing board shall immediately not ify the
229	403		Director of any action subsequently taken against any such
230	404		individual.

232	405		P. Beginning November 1, 2010, each registra nt that prescribes,
233	406		administers or dispenses methadone shall be required to check the
234	407		prescription profile of the patient on the cen tral repository of the
235	408		Oklahoma State Bureau of Narcotics and Dangerous D rugs Control.

237	409		SECTION 2. This act shall become effective Novemb er 1, 2023.
