68	68	punishment from being used on any students identified
69	69	with a disability in accordance wi th certain acts;

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 70 O.S. 2021, Section 13 -116, is
79	79	amended to read as follows:
80	80	Section 13-116. A. School district personnel shall be
81	81	prohibited from using corporal punishment on any students identified
82	82	with the most significant cognitive disabilities according to
83	83	criteria established by the State Department of Education unless
84	84	addressed in an annual indi vidualized education program (IEP)
85	85	developed a disability in accordance with the Individu als with
86	86	Disabilities Education Act (IDEA) or Section 504 of the
87	87	Rehabilitation Act of 1973 .

139	139	B. A waiver to the provisions of subsection A of this section
140	140	shall be granted if the parent or legal guardian of a student
141	141	provides written consent.
142	142	C. As used in this section, “corporal punishment” means the
143	143	deliberate infliction of physical pain by hitting, paddling,
144	144	spanking, slapping, or any other physical force used as a means of
145	145	discipline.
146	146	SECTION 2. This act shall become effective July 1, 2023.
147	147	SECTION 3. It being immediately necessary for the preservation
148	148	of the public peace, health , or safety, an emergency is hereby
149	149	declared to exist, by reason whereof thi s act shall take effect and
150	150	be in full force from and after its pa ssage and approval.
