7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 70 O.S. 2021, Section 13 -116, is
7979 amended to read as follows:
8080 Section 13-116. A. School district personnel shall be
8181 prohibited from using corporal punishment on any students identified
8282 with the most significant cognitive disabilities according to
8383 criteria established by the State Department of Education unless
8484 addressed in an annual indi vidualized education program (IEP)
8585 developed a disability in accordance with the Individu als with
8686 Disabilities Education Act (IDEA) or Section 504 of the
8787 Rehabilitation Act of 1973 .

139139 B. A waiver to the provisions of subsection A of this section
140140 shall be granted if the parent or legal guardian of a student
141141 provides written consent.
142142 C. As used in this section, “corporal punishment” means the
143143 deliberate infliction of physical pain by hitting, paddling,
144144 spanking, slapping, or any other physical force used as a means of
145145 discipline.
146146 SECTION 2. This act shall become effective July 1, 2023.
147147 SECTION 3. It being immediately necessary for the preservation
148148 of the public peace, health , or safety, an emergency is hereby
149149 declared to exist, by reason whereof thi s act shall take effect and
150150 be in full force from and after its pa ssage and approval.
