44	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
45	52		SECTION 1. NEW LAW A new section of law to be codified
46	53		in the Oklahoma Statutes as Section 2229.1C of Title 74, unless
47	54		there is created a duplication in numbering, reads as follows:
48	55		A. By January 1, 2024, all properties held in fee title, lea se
49	56		or otherwise, including interests in land, real estate options, or
50	57		real estate contracts designated for Hugo Lake Park are hereby
51	58		transferred to the Oklahoma Tourism and Recreation Department.
52	59		B. Appropriate conveyances and other documents shall be
53	60		executed by January 1, 2024, to effectuate the transfer of Hugo Lake
54	61		Park.
55	62		C. The Department shall establish appropriat e funds and
56	63		accounts, including a revolving fund in the Office of Management and
57		-	Enterprise Services, for servi cing the fiscal operations of the
58		-	park. Such funds and accounts shall be subject to the direct
59		-	supervision, management , and control of the Department.

	91	+	Enterprise Services, for servi cing the fiscal operations of the
	92	+	park. Such funds and accounts shall be subject to the direct
	93	+	supervision, management , and control of the Department.
86	94		D. The Department shall not be responsible for any claims
87	95		arising under The Governmental Tort Claims Ac t accrued prior to
88	96		January 1, 2024, claims arising from any other actions accrued pri or
89	97		to January 1, 2024, or tort claims arising prior to January 1, 2024,
90	98		for which no claim has accrued upon the date of transfer. The
91	99		Department shall not be responsible for any claims arising out of
92	100		construction begun before January 1, 2024, at Hugo Lake Park.
93	101		E. 1. The Department shall succeed to any contractua l rights
94	102		and responsibilities of the previous operators of Hugo Lake Park,
95	103		including but not limi ted to:
96	104		a. any responsibilities for payment of rents or other
97	105		obligations, and
98	106		b. any responsibilities related to contractual agreem ents
99	107		with nonprofit organiz ations.
100	108		2. The Department may enter into one or more contracts for
101	109		management services of the state park. The duties and benefits
102	110		arising under any contract for management services of any part of
103	111		the previous operators that is in effect on January 1, 2024, shall
104	112		be assigned to the Department. The contract may be renewable at the
105	113		option of the Department but not to exceed a cumulative period of
106	114		fifty (50) years.
107		-	F. The Department shall promulgate the rules necessary for the
108		-	transfer of property from Hugo Lake Park to the Oklahoma state park
109		-	system.

136	145		SECTION 2. This act shall become effective Nove mber 1, 2023.
