7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 74 O.S. 2021, Section 902, is
7979 amended to read as follows:
8080 Section 902. As used in Section 901 et seq. of this title:
8181 (1) “System” means the Oklahoma Public Employees Retirement
8282 System as established by this act Section 901 et seq. of this title
8383 and as it may hereafter be amended;
8484 (2) “Accumulated contributions ” means the sum of all
8585 contributions by a member to the System which shall be credited to
8686 the member’s account;
8787 (3) “Act” means Sections 901 to 932, inclusive, of this title;

139139 (4) “Actuarial equivalent ” means a deferred income be nefit of
140140 equal value to the accumulated deposits or benefits when computed
141141 upon the basis of the actuarial tables in use by the System;
142142 (5) “Actuarial tables” means the actuarial tables approved and
143143 in use by the Board at any given time;
144144 (6) “Actuary” means the actuary or firm of a ctuaries employed
145145 by the Board at any given time;
146146 (7) “Beneficiary” means any person named by a member to receive
147147 any benefits as provided for by Section 901 et seq. of this title.
148148 If there is no beneficiary living at time of member employee’s
149149 death, the member’s estate shall be the beneficiary;
150150 (8) “Board” means the Oklahoma Public Employees Retirement
151151 System Board of Trustees;
152152 (9) “Compensation” means all salary and wages, as defined by
153153 the Board of Trustees, including amou nts deferred under deferred
154154 compensation agreements entered into between a member and a
155155 participating employer, but exclusive of. Compensation shall not
156156 mean payment for overtime, payable to a member of the System for
157157 personal services performed for a par ticipating employer but shall
158158 not include, compensation or reim bursement for traveling, or moving
159159 expenses, or any compensation in excess of the maximum compensation

212212 (a) For compensation for service prior to January 1, 1988,
213213 the maximum compensation level shall be Twe nty-five
214214 Thousand Dollars ($25,000 .00) per annum.
215215 For compensation for service on or after January 1,
216216 1988, through June 30, 1994, the maximum compensation
217217 level shall be Forty Thousand Dollars ($40,000.00) per
218218 annum.
219219 For compensation for service on or aft er July 1, 1994,
220220 through June 30, 1995, the maximum compensation level
221221 shall be Fifty Thousand Dol lars ($50,000.00) per
222222 annum; for compensation for service on or after July
223223 1, 1995, through June 30, 1996, the maximum
224224 compensation level shall be Sixty Thous and Dollars
225225 ($60,000.00) per annum ; for compensation for service
226226 on or after July 1, 1996, through June 30, 1997, the
227227 maximum compensation level shall be Seventy Thousand
228228 Dollars ($70,000.00) per annum; and for compensation
229229 for service on or after July 1, 1997, through June 30,
230230 1998, the maximum compensation level shall be Eighty
231231 Thousand Dollars ($80, 000.00) per annum. For
232232 compensation for services on or after July 1, 1998,
233233 there shall be no maximum compensation level for
234234 retirement purposes.

286286 (b) Compensation for retirement purposes shall include any
287287 amount of elective salary reduction under Section 4 57
288288 of the Internal Revenue Code of 1986 and any amount of
289289 nonelective salary reduction under Section 414(h) of
290290 the Internal Revenue Code of 1986.
291291 (c) Notwithstanding any provision to the contr ary, the
292292 compensation taken into account for any employee in
293293 determining the contribution or benefit accruals for
294294 any plan year is limited subject to the annual
295295 compensation limit under Section 401(a)(17) of the
296296 federal Internal Revenue Code.
297297 (d) Current appointed members of the O klahoma Tax
298298 Commission whose salary is constitu tionally limited
299299 and is less than the highest salary allowed by law for
300300 his or her position shall be allowed, within nine ty
301301 (90) days from the effective date of this act March
302302 21, 2001, to make an election to use the highest
303303 salary allowed by law for the position to whic h the
304304 member was appointed for the purposes of making
305305 contributions and determination of retirement
306306 benefits. Such election shall be irrevocab le and be
307307 in writing. Reappointment to t he same office shall
308308 not permit a new election. Members appointed to th e
309309 Oklahoma Tax Commission after the effective date of

361361 this act March 21, 2001, shall make such election,
362362 pursuant to this subparagraph, within ninety (90) days
363363 of taking office;
364364 (10) “Credited service” means the sum of partic ipating service,
365365 prior service and elected ser vice;
366366 (11) “Dependent” means a parent, child, or spouse of a member
367367 who is dependent upon the member for at least one -half (1/2) of the
368368 member’s support;
369369 (12) “Effective date” means the date upon which the Sy stem
370370 becomes effective by operation of law;
371371 (13) “Eligible employer” means the state and any county, county
372372 hospital, city or town, con servation districts, circuit engineer ing
373373 districts and any public or private trust in wh ich a county, city or
374374 town participates and is the primary beneficiary, is to be an
375375 eligible employer for the purpose of this act only, whose employees
376376 are covered by Social Security and are not covered by or eligible
377377 for another retirement plan authorized under the laws of this state
378378 which is in operation on the initial entry date. Emergency medical
379379 service districts may join the System upon proper application to the
380380 Board. Provided, affiliation by a cou nty hospital shall be in the
381381 form of a resolution a dopted by the board of control.
382382 (a) If a class or several classes of employees of any
383383 above-defined employers are covered by Social Security
384384 and are not covered by or e ligible for and will not

437437 under the laws of this state, which is in operation on
438438 the effective date, such employe r shall be deemed an
439439 eligible employer, but only with respect to that class
440440 or those classes of employees as defined in this
441441 section.
442442 (b) A class or several classes of employees who are
443443 covered by Social Securi ty and are not covered by or
444444 eligible for and will not become eligible for another
445445 retirement plan authorized under the laws of this
446446 state, which is in operation on the eff ective date,
447447 and when the qualifications for employ ment in such
448448 class or classes are set by state law; and when such
449449 class or classes of employees are employed by a county
450450 or municipal government pursuant to such
451451 qualifications; and when the services provi ded by such
452452 employees are of such nature that they qualify for
453453 matching by or contri butions from state or federal
454454 funds administered by an agency of state government
455455 which qualifies as a participating employer, then the
456456 agency of state government administe ring the state or
457457 federal funds shall be deemed an eligible employer,
458458 but only with respect to that class or those classes
459459 of employees as defined in this subsection; provided,

511511 that the required contributions to the ret irement plan
512512 may be withheld from the contributions of state or
513513 federal funds administer ed by the state agency and
514514 transmitted to the System on the same basis as the
515515 employee and employer contributions are transmitted
516516 for the direct employees of the state agency. The
517517 retirement or eligibilit y for retirement under t he
518518 provisions of law provid ing pensions for service as a
519519 volunteer firefighter shall not render any person
520520 ineligible for participation in the benefits provided
521521 for in Section 901 et seq. of this title. An employee
522522 of any public or private trust in which a county, city
523523 or town participates and is the primary benef iciary
524524 shall be deemed to be an eligible emplo yee for the
525525 purpose of this act Section 901 et seq. of this title
526526 only.
527527 (c) All employees of the George Nigh Rehabilitation
528528 Institute who elected to retain membership in the
529529 System, pursuant to Section 913.7 of this ti tle, shall
530530 continue to be eligible employees for the purposes of
531531 this act Section 901 et seq. of this title. The
532532 George Nigh Rehabilitation Institute shall be
533533 considered a participating employer only for such
534534 employees.

586586 (d) All employees of CompSource Mut ual Insurance Company
587587 who retain membership in the Oklahoma Public Employees
588588 Retirement System pursuant to Section 913.9 of thi s
589589 title shall continue to be eligible employees for the
590590 purposes of the Oklahoma Public Employees Retirement
591591 System. CompSource Mutual Insurance Company shall be
592592 considered a participating employer only for such
593593 employees.
594594 (e) All employees of a successor organization, as defined
595595 by Section 5-60.12 of Title 2 of the Oklahoma
596596 Statutes, who retain membership in the Oklahoma Public
597597 Employees Retirement System pursuant to Section 5-
598598 60.35 of Title 2 of the Oklahoma Statutes shall
599599 continue to be eligible employe es for the purposes of
600600 the Oklahoma Public Employees Retirement System. A
601601 successor organization shall be considered a
602602 participating employer only for such employ ees.
603603 (f) A participating employer of the Teachers ’ Retirement
604604 System of Oklahoma, who has one or more employees who
605605 have made an election pursuant to enabling legislation
606606 to retain membership in the System as a result of
607607 change in administration, shall be considered a
608608 participating employer of the Oklahoma Public
609609 Employees Retirement System only f or such employees;

661661 (14) “Employee” means any officer or employee of a
662662 participating employer, whose employment is not seasonal o r
663663 temporary and whose employment r equires at least one thous and
664664 (1,000) hours of work per year and whose s alary or wage is equa l to
665665 the hourly rate of the monthly m inimum wage for state employees.
666666 For those eligible employers outlined in Section 910 of th is title,
667667 the rate shall be equal to the hourly rate of the monthly minimum
668668 wage for that employer. Each employer, whose minim um wage is less
669669 than the state’s minimum wage, shall inform the System of the
670670 minimum wage for that employer. This notification shall be by
671671 resolution of the gove rning body.
672672 (a) Any employee of the county extension agents who is not
673673 currently participatin g in the Teachers’ Retirement
674674 System of Oklahoma shall be a member of this System.
675675 (b) Eligibility shall not include any employee who is a
676676 contributing member of t he United States Civil Ser vice
677677 Retirement System.
678678 (c) It shall be mandatory for an officer, a ppointee or
679679 employee of the office of district attorney to become
680680 a member of this Syste m if he or she is not currently
681681 participating in a county retirement system . Provided
682682 further, that if an officer, appointee or employee of
683683 the office of district atto rney is currently
684684 participating in such county retirement system, he or

737737 is eligible for such county retireme nt system. Any
738738 eligible officer, appointee or employee of the office
739739 of district attorney sh all be given credit for prior
740740 service as defined in this section. The provisions
741741 outlined in Section 917 of this title shall app ly to
742742 those employees who have pre viously withdrawn their
743743 contributions.
744744 (d) Eligibility shall also not in clude any officer or
745745 employee of the Oklahoma Employment S ecurity
746746 Commission, except for those officers and e mployees of
747747 the Commission electing to tr ansfer to this System
748748 pursuant to the provisions of Section 910.1 of this
749749 title or any other class of offi cers or employees
750750 specifically exempted by the laws of thi s state,
751751 unless there be a consolidation as provide d by Section
752752 912 of this title. Employee s of the Oklahoma
753753 Employment Security Commission who are ine ligible for
754754 enrollment in the Oklahoma Employment Security
755755 Commission Retirement Plan, that was in effec t on
756756 January 1, 1964, shall become members of this System.
757757 (e) Any employee employed by the Legislati ve Service
758758 Bureau, State Senate or House of Representatives for
759759 the full duration of a regular legislative session

812812 regardless of classification as a temporary employee
813813 and may participate in the System during the regular
814814 legislative session at the option of the employe e.
815815 For purposes of this subparagraph, the det ermination
816816 of whether an employee is employed for the full
817817 duration of a regular legislative session shall be
818818 made by the Legislative Service Bureau i f such
819819 employee is employed by the Legislative Service
820820 Bureau, the State Senate if such employee is employ ed
821821 by the State Senate, or by the House of
822822 Representatives if such employee is employed by the
823823 House of Representatives. Each regular legislative
824824 session during which the legislative employee or an
825825 employee of the Legislative Service Bureau
826826 participates full time shall be counted as six (6)
827827 months of full-time participating service.
828828 (i) Except as otherwise provided by this
829829 subparagraph, once a temporar y session employee
830830 makes a choice to participate or not, the choice
831831 shall be binding for all future legisl ative
832832 sessions during which the employee is emplo yed.
833833 (ii) Notwithstanding the provisions of divisio n (i) of
834834 this subparagraph, any employee, who is e ligible

887887 provisions of this subparagraph and who was
888888 employed by the State Senate or House of
889889 Representatives after January 1, 1989, may file
890890 an election, in a man ner specified by the Board,
891891 to participate as a me mber of the System prior to
892892 September 1, 1989.
893893 (iii) Notwithstanding the provisions of division (i) of
894894 this subparagraph, a temporary legislative
895895 session employee who elected to become a member
896896 of the System may withdraw from the System
897897 effective the day said such employee elected to
898898 participate in the System upon writt en request to
899899 the Board. Any such request mus t be received by
900900 the Board prior to October 1, 1990. All employee
901901 contributions made by the te mporary legislative
902902 session employee shall be returned to the
903903 employee without interest w ithin four (4) months
904904 of receipt of the written request.
905905 (iv) A member of the System who did not initially
906906 elect to participate as a member of the System
907907 pursuant to this subparagraph shall be able to
908908 acquire service perfo rmed as a temporary
909909 legislative session employee for periods of

961961 service performed prior to the date upon w hich
962962 the person became a member of the Syste m if:
963963 a. the member files an election with the Syst em
964964 not later than December 31, 2000, to
965965 purchase the prior service; and
966966 b. the member makes payment to the System o f
967967 the actuarial cost of the service credit
968968 pursuant to subsection A of Section 913.5 of
969969 this title. The provisions of Section 913.5
970970 of this title shall be applicable to the
971971 purchase of the servic e credit, including
972972 the provisions for determining service
973973 credit in the event of incomplete payment
974974 due to cessation of payments, death,
975975 termination of employment or retirement, but
976976 the payment may extend for a period not to
977977 exceed ninety-six (96) months;
978978 (15) “Entry date” means the date on which an eligible empl oyer
979979 joins the System. The first entry date p ursuant to Section 901 et
980980 seq. of this title shall be January 1, 1964;
981981 (16) “Executive Director” means the managing officer of the
982982 System employed by the Board under Section 901 et se q. of this

10351035 (17) “Federal Internal Revenue Code ” means the federal Internal
10361036 Revenue Code of 1954 or 1986, as amended and as applicable to a
10371037 governmental plan as in effect on July 1, 1999;
10381038 (18) “Final average compen sation” means the average annual
10391039 compensation, including amo unts deferred under deferred compensation
10401040 agreements entered into between a member and a p articipating
10411041 employer, up to, but not exceeding the maximum compensation levels
10421042 as provided in paragraph ( 9) of this section received during the
10431043 highest three (3) of the last ten (10) years of participating
10441044 service immediately preceding retirement or termi nation of
10451045 employment and with respect to members wh ose first participating

11091109 (20) “Fund” means the Oklahoma Public Employees Retirement Fund

13331333 (24) “Normal retirement date” means the date on which a member
13341334 may retire with full retirement benefits as p rovided in Section 901
13351335 et seq. of this title, such date being whichever occurs first:

13381338 (1) sixty-second birthday with respect to members

16511651 (26) “Participating service” means the period of employment

16531653 (27) “Prior service” means the period of employment of a member
16541654 by an eligible employer prio r to the member’s entry date for which
16551655 credit is granted a member under Section 901 et seq. of this title;

17131713 manner as specified by the member pursuant to Section 901 et seq. of

17161716 (30) “Retirement coordinator” means the individual designat ed
17171717 by each participating employer through whom System transactions and
17181718 communication shall be directed;
17191719 (31) “Social Security” means the old-age survivors and
17201720 disability section of the Federal federal Social Security Act;
17211721 (32) “Total disability” means a physical or mental disability
17221722 accepted for disability benefits by the Federal federal Social
17231723 Security System;
17241724 (33) “Service-connected disability benefits ” means military
17251725 service benefits which are for a s ervice-connected disability rated
17261726 at twenty percent (20%) or more by the V eterans Administration or
17271727 the Armed Forces of the United States;
17281728 (34) “Elected official” means a person elected to a state
17291729 office in the legislative or executive branch of state gov ernment or
17301730 a person elected to a county office for a definite number of ye ars

17891789 (37) “Public safety officers of the Grand River Dam Authority”
17901790 means those persons hired by the Grand River Dam Authority on or
17911791 after the effective date of this act March 21, 2001, who are
17921792 certified by the Council on Law Enforcement Education and Traini ng
17931793 or an equivalent certifying entity for law enfor cement personnel
17941794 training and who perform law enforcement functions as part of their
17951795 regularly assigned duties and responsib ilities on a full-time basis.
17961796 With respect to any public safety officer hired by the Grand River
17971797 Dam Authority on or after the effective date of this act March 21,
17981798 2001, any earned benefits or credits toward retirement benefits from
17991799 previous participation within the Okl ahoma Public Employees
18001800 Retirement System or the Oklahoma Law Enfor cement Retirement System
18011801 shall remain within that s ystem.

18651865 (2) Effective January 1, 2004, except as other wise provided for
18661866 elected officials in Section 913.4 of this title and except for
18671867 those members making con tributions pursuant to paragraphs (c), (d),
18681868 (e), and (f), (g), and (h) of subsection (1) of Section 919.1 of
18691869 this title, any member who shall retire s hall be entitled to receive
18701870 an annual retirement benefit equal to two and one-half percent (2
18711871 1/2%) of the member’s final average compensation as determined
18721872 pursuant to paragraph (18) of Section 902 of this title, multiplie d
18731873 by the number of full years of participating service after January
18741874 1, 2004, that have been credited to the member in accordance with
18751875 the provisions of Section 913 of this title and only for those full
18761876 years of participating service for which contribution s have been
18771877 made pursuant to para graph (g) of subsection (1) of Secti on 919.1 of
18781878 this title. The two and one-half percent (2 1/2%) multipl ier shall

19421942 (3) The minimum final average compensation for any person who
19431943 becomes a member of the Oklahoma Public Employees Retirement System
19441944 on or after July 1, 1995 and who had:
19451945 a. and who had twenty (20) or more years of credited
19461946 service within the System as of the membe r’s
19471947 retirement date shall be no less t han Thirteen
19481948 Thousand Eight Hundred Dollars ($13,800.00) per annum,
19491949 b. and who had at least fifteen (15 ) but not more than
19501950 nineteen (19) years of cred ited service within the
19511951 System as of the member’s retirement date sh all be no
19521952 less than Six Thousand Nine Hundred Dollars
19531953 ($6,900.00) per annum, or

20122012 (4) Provided, further, any memb er who has elected a vested

20182018 (5) Any member who is a correctional offic er or a probation and
20192019 parole officer employed by the Department o f Corrections at the time
20202020 of retirement and who retires on or before June 30, 2000, s hall be
20212021 entitled to receive an annua l retirement benefit equal to tw o and
20222022 one-half percent (2 1/2%) of the final average compensation of the
20232023 member not to exceed Twenty -five Thousand Dollars ($25,000.00) an d
20242024 two percent (2%) of the final average salary in excess of Twenty-

21652165 Department of Corrections m ay make the employee contribution and

21672167 (6) Any member who is a correctional officer, a probation and
21682168 parole officer or a fugitive apprehension agent employed by the
21692169 Department of Corrections at the time of retirem ent and who retires
21702170 on or after July 1, 2002, shall be entitled to receive an annual
21712171 retirement benefit equal to two a nd one-half percent (2 1/2%) of the
21722172 final average compensation of the member, but not exceeding the
21732173 maximum compensation level as provided in paragraph (18) of Section
21742174 902 of this title, multiplied by the number of years of service as a
21752175 correctional officer, a probation and parole officer or a fugit ive
21762176 apprehension agent, and any years in excess of twenty (20) years as
21772177 such an officer or age nt, or years credited to the member in

23912391 described by paragraph (37) of Section 902 of this ti tle hired on or
23922392 after the effective date of this act July 1, 2016, by the Grand
23932393 River Dam Authority and who r etires on or after the effective date
23942394 of this act July 1, 2016, shall have retirement benefits for each
23952395 year of full-time-equivalent participating service as a correcti onal
23962396 officer, a probation and parol e officer or a fugitive apprehension
23972397 agent, or Grand River Dam public safety officer computed on two and
23982398 one-half percent (2 1/2%) of the final average compensation based
23992399 upon those years as a correctional officer, a prob ation and parole
24002400 officer, a fugitive apprehension agent or a Grand River D am public
24012401 safety officer. For purpose s of this paragraph, “final average
24022402 compensation” shall be determined by computing the averag e annual

24762476 (9) Any member who is :
24772477 a. initially on or after July 1, 200 2, employed as a
24782478 firefighter for the Oklahoma Military Department of

26962696 retirement or early retirement under division (vii) of subparagraph
26972697 (d) of paragraph (24) of Section 902 of this title, shall have
26982698 retirement benefits for each year of full -time-equivalent
26992699 participating service as an emergency medical service personnel
27002700 computed on two and one -half percent (2 1/2%) of the final average
27012701 compensation based upon those years as an emergency medical service

27702770 (12) (13) Such annual retirement benefits shall be paid in
27712771 equal monthly installments, except that the Board may provide for
27722772 the payment of retirement benefi ts which total less than Two Hundred
27732773 Forty Dollars ($240.00) a year on other than a monthly basis.
27742774 (13) (14) Pursuant to the rules established by the Board, a
27752775 retiree receiving monthly benefits from the System may authorize
27762776 warrant deductions for any prod ucts currently offered to active
27772777 state employees through the Employees Benefits Council Oklahoma
27782778 Employees Insurance and Benefits Board , provided that product is
27792779 offered to state retirees as a group and has a minimum participation

28332833 shall retain a processing fee of two percent (2%) of the g ross
28342834 deductions for the products. Retirement benefit deductions shall be
28352835 made for membership dues for any statewide association for whi ch
28362836 payroll deductions are authorized pursuant to subsection B of
28372837 Section 34.70 of Title 62 of the Oklahoma Statutes for retired
28382838 members of any state -supported retirement system, upon proper
28392839 authorization given by the member to the board from which the memb er
28402840 or beneficiary is currently receiving retirement benefits.
28412841 B. A member shall be considered disabled if such member
28422842 qualifies for the payment of Social Security disability benefits, or
28432843 the payment of benefits pursuant to the Railroad Retirement Act of
28442844 1974, Section 231 et seq. of Title 45 of the United States Code, and
28452845 shall be eligible for benefits hereunder upon proof of such
28462846 disability, provided such m ember is an active regularly scheduled
28472847 employee with a participating employer at the time of injury o r
28482848 inception of illness or disease resulting in subsequent
28492849 certification of eligibility for Social Security disability be nefits
28502850 by reason of such injury, il lness or disease, providing such
28512851 disability is certified by the Social Security Administration within
28522852 one (1) year after the last date physically on the job and after
28532853 completion of at least eight (8) years of participatin g service or
28542854 combined prior and par ticipating service or resulting in subsequent
28552855 certification of eligibility of disability by the Railr oad

29072907 Retirement Board providing such certification is made by the
29082908 Railroad Retirement Board within one (1) year after the last date
29092909 physically on the job an d after completion of at least eight (8)
29102910 years of participating service or combined prior and partici pating
29112911 service. The member shall submit to the Retirement System the
29122912 Social Security Award Notice or the Railroad Retir ement Award Notice
29132913 certifying the date of entitlement for disability benefits, as
29142914 issued by the Social Security Administration, Departme nt of Health
29152915 and Human Services or the Railroad Retirement Board. Disability
29162916 benefits shall become effective on the dat e of entitlement as
29172917 established by the Social Security Administration or the Railroad
29182918 Retirement Board, but not before the first day of the month
29192919 following removal from the payroll, whichever is later, a nd final
29202920 approval by the Retirement System. Benefits shall be based upon
29212921 length of service and compensation as of the date of disability,
29222922 without actuarial reduction because of commencemen t prior to the
29232923 normal retirement date. The only optional form of b enefit payment
29242924 available for disability benefits is O ption A as provided for in
29252925 Section 918 of this title. Option A must be elected in accordance
29262926 with the provisions of Section 918 of this title. Benefit payments
29272927 shall cease upon the member ’s recovery from disability prior to the
29282928 normal retirement date. F uture benefits, if any, shall be pa id
29292929 based upon length of service and compensation as of the date of

29852985 C. A member who incurred a disability pursuant to subsection B
29862986 of this section on or after July 1, 1999, and who has retired from
29872987 the System with an early retirement benefit pending certific ation
29882988 from the Social Security Admi nistration or the Railroad Retirement
29892989 Board shall receive a retirement benefit not less than the
29902990 disability retirement benefit provided by subsection B of this
29912991 section once the System receives a Social Security Award Noti ce or a
29922992 Railroad Retirement Award N otice pursuant to subsection B of this
29932993 section and a completed Application for Disability Benefits
29942994 application for disability benefits . In addition, such member shall
29952995 receive the difference, if any, betw een the early retirement benefit
29962996 and the disability benefit from the date the Social Security
29972997 Administration or the Railroad Retirement Board establishes
29982998 disability entitlement.
29992999 D. Any actively participating member of the System on or after
30003000 July 1, 1998, except for those employees provided in subparagraph
30013001 (e) of paragraph (14) of Section 902 of this tit le, whose employment
30023002 is less than full-time, shall have his or her final average
30033003 compensation calculated on an annualized basis using his or her
30043004 hourly wage subject to the maximum compensation limits; provide d,
30053005 however, any such member whose first particip ating service occurred

30683068 SECTION 3. AMENDATORY 74 O.S. 2021, Section 916.3, is
30693069 amended to read as follows:
30703070 Section 916.3. A. 1. Notwithstanding the provisions of
30713071 Sections 901 through 932 of this title, a monthly pension, as
30723072 provided in subsection B of this section, shall be paid on behalf of
30733073 any member who is a correctional officer or probation and parole
30743074 officer of the Department of Corrections and who is killed or
30753075 mortally wounded on or after January 1, 2000, during the performa nce
30763076 of the member’s duties for the Department or any employee of the
30773077 Department of Corrections who is killed or mortally wounded after
30783078 June 30, 2004, during the performance of the member ’s duties for the
30793079 Department.

31313131 2. The monthly pension described in t his section shall be paid
31323132 on behalf of any member first hired by any county that is a
31333133 participating employer in the System as a deputy sher iff or jailer
31343134 on or after November 1, 2020, and who is killed or mortally wounded
31353135 during the performance of the membe r’s duties as a deputy sheriff or
31363136 jailer.
31373137 3. The monthly pension described in this section shall be paid
31383138 on behalf of a licensed emergency medical personnel hired by any
31393139 participating employer for the fir st time as a licensed emergency
31403140 medical personnel on or after the effective date of this act, and
31413141 who is killed or mortally wounded during the per formance of the
31423142 member’s duties as an emergency medical personnel.
31433143 B. The monthly benefit shall be equal to:
31443144 1. Two and one-half percent (2 1/2%);
31453145 2. Multiplied by twenty (20) years of service, regardless of
31463146 the actual number of years of credited service performed by the
31473147 member prior to death, if the member had performed l ess than twenty
31483148 (20) years of credited s ervice, or the actual number of years of
31493149 credited service of the member if greater than twenty (20) y ears;
31503150 3. Multiplied by the member ’s final average compensation; and
31513151 4. Divided by 12.
31523152 C. The pension provided fo r in subsection A of this section

32243224 System, the Oklahoma Law Enforcement Retirement System, or the
32253225 Oklahoma Public Employees Retirement Sys tem. The surviving spouse

32843284 ($400.00) a month shall be paid to the surviving spouse or to the
32853285 person having the care and custody of such children if there i s no
32863286 surviving spouse or if the surviving spouse dies and until each
32873287 child reaches the age of eighteen (18) years o r reaches the age of
32883288 twenty-two (22) years if the child is enrolled full -time in and is
32893289 regularly attending a public or private school or any institution of
32903290 higher education.
32913291 F. The pension benefit provided in this s ection shall be made
32923292 prospectively only from the effective date of this act July 1, 2000.
32933293 The benefits shall be payable beginn ing the later of the first day
32943294 of the month following the date that such employee was killed or
32953295 dies from a mortal wound, as provided in this section, or the
32963296 effective date of th is act July 1, 2000.
32973297 G. The Board of Trustees of the Oklahoma Public Employees
32983298 Retirement System shall promulgate such rules as ar e necessary to
32993299 implement the provisions of this section.

35833583 (3) Each participating employ er shall pick up under the
35843584 provisions of Section 414(h)(2) of the Interna l Revenue Code of 1986
35853585 and pay the contribution which the me mber is required by law to make
35863586 to the System for all compensation earned a fter December 31, 1988.
35873587 Although the contributi ons so picked up are designated as member
35883588 contributions, such contributio ns shall be treated as contrib utions
35893589 being paid by the parti cipating employer in lieu of contributions by
35903590 the member in determining tax treatment under the Internal Revenue
35913591 Code of 1986 and such picked up contributions shall not be
35923592 includable in the gross income of the member until suc h amounts are
35933593 distributed or made available to the member or the beneficiary o f
35943594 the member. The member, by the terms of this System, shall not have
35953595 any option to choose to receive the contributions so picked up
35963596 directly and the picked up contributions mus t be paid by the
35973597 participating employer to the System.

36613661 Oklahoma, in accordance with Section 17 -104 of Title 70 of the
36623662 Oklahoma Statutes, to such member. Upon the refund of the
36633663 accumulated employee contributions referred to in this subsection,
36643664 all benefits and rights accrued to such member are terminated .

37283728 B. For the fiscal year ending June 30, 2005, the total employer
37293729 and employee contributions s hall equal thirteen and one-half percent
37303730 (13 1/2%) of the allowable monthly compensation of each member;
37313731 provided, however, each participating employer listed in this
37323732 section may set the amount of the employer and employee contri bution
37333733 to equal thirteen an d one-half percent (13 1/2%) of the allowable
37343734 monthly compensation of each member for co mpensation as provided in
37353735 paragraph (9) of Section 902 of this title; provided, the employer
37363736 contribution shall not exceed ten percent (10%) and the employee
37373737 contribution shall not exceed eight and one-half percent (8 1/2%).
37383738 C. The total employer and empl oyee contributions for fiscal
37393739 years following the fiscal year e nding June 30, 2005, shall be as

38013801 provided in paragraph (9) of Section 902 of th is title. The maximum
38023802 employer contribution of ten percent (10 %) in subsection B of this
38033803 section shall increase by one and one -half percent (1.5%) beginning
38043804 in the fiscal year ending June 30, 2006, and one percent (1%) for
38053805 each fiscal year thereafter unti l it reaches sixteen and one -half
38063806 percent (16.5%). For such ye ars, the employee contribution shall
38073807 not exceed eight and one -half percent (8 1/2%). Notwithstanding any
38083808 other provisions of this section to the contrary, for those members
38093809 described in division (v), or (vi) of subparagraph (d) of paragraph
38103810 (24) of Section 902 of this title, th e county participating employer
38113811 shall contribute sixteen and one-half percent (16 1/2%) and the
38123812 employee shall contribute eight percent (8%) for a total of twenty -
38133813 four and one-half percent (24 1/2%).
38143814 D. For members who make t he election pursuant to paragr aph (2)
38153815 of subsection A of Section 915 of this t itle, the employee
38163816 contribution shall increase by two and ninety-one one-hundredths
38173817 percent (2.91%). Such employee contribution increase shall be paid
38183818 by the employee.
38193819 E. Each participating employer pursuan t to the provisions of
38203820 this section may pick up under the provisions of Section 41 4(h)(2)
38213821 of the Internal Revenue Code of 1986 and pay the contribution which
38223822 the member is required by law to make to the System for all
38233823 compensation earned after December 31, 1989. Although the
38243824 contributions so picked up are designated as member contribut ions,

38763876 such contributions shall be treat ed as contributions being paid by
38773877 the participating employer in lieu of contributions by the member in
38783878 determining tax treatment under the Internal Revenue Code of 1986
38793879 and such picked up contributions shall not be in cludable in the
38803880 gross income of the mem ber until such amounts are distributed or
38813881 made available to the member or the beneficiary of the member. The
38823882 member, by the terms of t his System, shall not have any option to
38833883 choose to receive the contributions so pi cked up directly and the
38843884 picked up contributions must be paid by the participatin g employer
38853885 to the System.
38863886 F. Member contributions which are pi cked up shall be treated in
38873887 the same manner and to the same extent as member c ontributions made
38883888 prior to the date on which member contributions were pi cked up by
38893889 the participating employer. Me mber contributions so picked up shall
38903890 be included in gross sala ry for purposes of determining benefits and
38913891 contributions under the System.
38923892 G. The participating employer shall pay the member
38933893 contributions from the same source of funds used in paying salary to
38943894 the member, by effecting an equal cash reduction in gross s alary of
38953895 the member.
