73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY 21 O. S. 2021, Section 1289.24a, is
75	75	amended to read as follows:
76	76	Section 1289.24a. 1. The State Legislature declares that the
77	77	lawful design, marketing, manufacturing, or sale of firearms or
78	78	ammunition to the pu blic is not unreasonably dangerous activity and
79	79	does not constitute a nuisan ce.
80	80	2. The authority to bring suit and right to recover against any
81	81	firearms or ammunition manufacturer, trade association, or dealer by
82	82	or on behalf of any governmental unit crea ted by or pursuant to an
83	83	act of the Legislature or the Constitution, or any department,
84	84	agency, or authority thereof, for damages, abatement , or injunctive
85	85	relief resulting from or relating to the lawful design,
86	86	manufacturing, marketing, or sale of firearm s or ammunition to the

138	138	public shall be reserved exclusively to the state. T his paragraph
139	139	shall not prohibit a political subdivision or loca l government
140	140	authority from bringing an action against a firearms or ammunition
141	141	manufacturer or dealer for breach of contract or warranty as to
142	142	firearms or ammunition purchased by the politica l subdivision or
143	143	local government authority. This bill shall no t be construed to
144	144	prohibit an individual from bringing a cause of action based upon an
145	145	existing recognized theory of law.
146	146	3. A person may not bring , file, or maintain any civil action
147	147	or special proceedin g against a firearm, firearm accessory, or
148	148	ammunition manufacturer, distributor, dealer , importer, exporter, or
149	149	trade association, or the owners , shareholders, directors, and
150	150	employees of any such entity, for recovery of damage s, punitive
151	151	damages, restitution, fines, penalties, inju nctive or declaratory
152	152	relief, or other remedy based on the legal theory that the marketing
153	153	or advertising of a firea rm, firearm accessories, or ammunition was
154	154	the cause of any personal injury, death, or property damage or
155	155	caused or contributed to the creation o r maintaining of a public
156	156	nuisance.
157	157	SECTION 2. This act shall become effective November 1, 2023.
