7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY 21 O. S. 2021, Section 1289.24a, is
7575 amended to read as follows:
7676 Section 1289.24a. 1. The State Legislature declares that the
7777 lawful design, marketing, manufacturing, or sale of firearms or
7878 ammunition to the pu blic is not unreasonably dangerous activity and
7979 does not constitute a nuisan ce.
8080 2. The authority to bring suit and right to recover against any
8181 firearms or ammunition manufacturer, trade association, or dealer by
8282 or on behalf of any governmental unit crea ted by or pursuant to an
8383 act of the Legislature or the Constitution, or any department,
8484 agency, or authority thereof, for damages, abatement , or injunctive
8585 relief resulting from or relating to the lawful design,
8686 manufacturing, marketing, or sale of firearm s or ammunition to the

138138 public shall be reserved exclusively to the state. T his paragraph
139139 shall not prohibit a political subdivision or loca l government
140140 authority from bringing an action against a firearms or ammunition
141141 manufacturer or dealer for breach of contract or warranty as to
142142 firearms or ammunition purchased by the politica l subdivision or
143143 local government authority. This bill shall no t be construed to
144144 prohibit an individual from bringing a cause of action based upon an
145145 existing recognized theory of law.
146146 3. A person may not bring , file, or maintain any civil action
147147 or special proceedin g against a firearm, firearm accessory, or
148148 ammunition manufacturer, distributor, dealer , importer, exporter, or
149149 trade association, or the owners , shareholders, directors, and
150150 employees of any such entity, for recovery of damage s, punitive
151151 damages, restitution, fines, penalties, inju nctive or declaratory
152152 relief, or other remedy based on the legal theory that the marketing
153153 or advertising of a firea rm, firearm accessories, or ammunition was
154154 the cause of any personal injury, death, or property damage or
155155 caused or contributed to the creation o r maintaining of a public
156156 nuisance.
157157 SECTION 2. This act shall become effective November 1, 2023.
