---|

154 | 154 | | 2. “Electronic” means relating to technology having electrical, |
---|
155 | 155 | | digital, magnetic, wireless, optical, electromagnetic, or similar |
---|
156 | 156 | | capabilities; |
---|
157 | 157 | | 3. “Employer” means a person that hires or contracts with a |
---|
158 | 158 | | worker to work for the p erson; |

159 | 159 | | 4. “No-business agreement” means a restrictive employment |

308 | 308 | | worker receives from a source other than the employer that: |

309 | 309 | | a. is designed to enhance the ability of the worker to |
---|
310 | 310 | | perform his or her work, |
---|
311 | 311 | | b. is not normally received by other workers, and |
---|
312 | 312 | | c. requires a significant and identifiable expendi ture by |
---|
313 | 313 | | the employer distinct from ordinary on-the-job |
---|

315 | 315 | | 16. “Stated rate of pay” means the compensation, calculated on |
---|

453 | 453 | | A. This act applies to a restrictive employment agreement. If |
---|
454 | 454 | | a restrictive employment agreement is p art of another agreement, |

455 | 455 | | this act does not affect other parts of th e other agreement. |

456 | 456 | | B. This act supersedes common law only to the extent that it |
---|
457 | 457 | | applies to a restric tive employment agreement but otherwise does not |
---|
458 | 458 | | affect principles of law and equity consistent with this act. |

459 | 459 | | C. This act does not affect agreements to take an action solely |
---|
460 | 460 | | to transfer, perfect, or enforce a patent, copyright, trade secret, |
---|
