81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 10 O.S. 2021, Section 403, as
83	83	amended by Section 1, Chapter 99, O.S.L. 2022 (10 O.S. Supp. 2022,
84	84	Section 403), is amended to read as follows:
85	85	Section 403. A. The provisions of the Oklahoma Child Care
86	86	Facilities Licensing Act, other than the criminal history records
87	87	search and Child Care Restricted Registry provisions of Section
88	88	404.1 of this title, shall not apply to:
89	89	1. Care provided in a child ’s own home or by relatives;

142	142	neighbors for the occasio nal care of their children;
143	143	3. Care provided by an attorney-in-fact authorized by Section
144	144	700 of this title who exercises parental or legal authority on a
145	145	continuous basis for not less than twenty -four (24) hours and
146	146	without compensation for the intended duration of the power of
147	147	attorney;
148	148	4. Programs in which school-aged children three (3) years of
149	149	age and older are participating in home -schooling;
150	150	5. Programs that serve children three (3) years of age a nd
151	151	older and that are operated during typical schoo l hours by a public
152	152	school district;
153	153	6. Programs that serve children three (3) years of age and
154	154	older and that are operated during typical school hours by a private
155	155	school that offers elementary education in grades kindergarten
156	156	through third grade;
157	157	7. Summer youth camps, summer programs or after-school programs
158	158	for children who are at least four (4) years of age, that are
159	159	accredited by a national standard -setting agency or church camp
160	160	accreditation progra m, or are accredited by, chartered by or
161	161	affiliated with a national non-profit organization;
162	162	8. Programs in which children attend on a drop -in basis and
163	163	parents are on the premises and readily accessible;

215	215	9. A program of specialized activity or instructi on for
216	216	children that is not designed or intended fo r child care purposes
217	217	and operates not more than ten (10) hours per week including, but
218	218	not limited to, scouts, 4-H clubs and summer resident youth camps,
219	219	programs that limit children from enrolling in mul tiple sessions
220	220	because of the type of activity or a ges accepted and single-activity
221	221	programs such as academics, athletics, gy mnastics, hobbies, art,
222	222	music, dance and craft instruction;
223	223	10. Any child care facility that:
224	224	a. provides care and supervision for fifteen (15) ten
225	225	(10) or fewer hours per week,
226	226	b. operates less than ten (10) weeks annually, or
227	227	c. operates in the summer for less than eight (8) hours
228	228	per day, or
229	229	d. provides care and supervision for school -aged children
230	230	only in a center-based program for twenty-one (21) or
231	231	fewer hours a week and is loc ated in a county with a
232	232	population of less than one hundred thousand (100,000)
233	233	according to the latest Federal Decennial Census;
234	234	11. Facilities whose primary purpose is medical treatment;
235	235	12. Boarding schools that have education as their primary
236	236	purpose and that are recognized as accredited by the State Board of
237	237	Education. To be exempt, such programs shall:

290	290	residential living,
291	291	b. not have been granted nor have assumed legal custody
292	292	of any child attending the facility, and
293	293	c. adhere to standard educational holiday and seasonal
294	294	recess periods to permit s tudents reasonable
295	295	opportunities to return to their primary places of
296	296	residence with parents or legal guardians;
297	297	13. Day treatment programs and maternity h omes operated by a
298	298	licensed hospital;
299	299	14. Juvenile facilities certified b y the Office of Juvenile
300	300	Affairs or certified by any other state agency authorized by law to
301	301	license such facilities;
302	302	15. A program where children are not enrolled by the parents
303	303	and are free to come and go;
304	304	16. A program in tribal land as defined at 2 5 U.S.C.A. 1903
305	305	(10); and
306	306	17. A program on a military base or federal property , or a
307	307	facility licensed as a family child care pr ovider by a branch of the
308	308	United States Department of D efense or by the United S tates Coast
309	309	Guard.
310	310	B. The provisions of the Oklahoma Child Care Facilities
311	311	Licensing Act shall be equally incumbent upon all private and public
312	312	child care facilities.

364	364	C. Unlicensed child care facilities and programs listed in
365	365	paragraphs 4 through 15 of subsectio n A of this section, and their
366	366	employees, volunteers, or other individuals who have access to
367	367	children, shall be subject to the criminal history records search
368	368	and Child Care Restricted Registry provisions of Section 404.1 of
369	369	this title. An unlicensed chi ld care facility or p rogram may
370	370	request a waiver from such requirements from the Department. Any
371	371	approved waiver shall be made public by the Department and the
372	372	unlicensed facility or program on enrollment forms and websites.
373	373	SECTION 2. This act shall become effective Nov ember 1, 2023.
