8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 10 O.S. 2021, Section 403, as
8383 amended by Section 1, Chapter 99, O.S.L. 2022 (10 O.S. Supp. 2022,
8484 Section 403), is amended to read as follows:
8585 Section 403. A. The provisions of the Oklahoma Child Care
8686 Facilities Licensing Act, other than the criminal history records
8787 search and Child Care Restricted Registry provisions of Section
8888 404.1 of this title, shall not apply to:
8989 1. Care provided in a child ’s own home or by relatives;

141141 2. Informal arrangements which par ents make with friends or
142142 neighbors for the occasio nal care of their children;
143143 3. Care provided by an attorney-in-fact authorized by Section
144144 700 of this title who exercises parental or legal authority on a
145145 continuous basis for not less than twenty -four (24) hours and
146146 without compensation for the intended duration of the power of
147147 attorney;
148148 4. Programs in which school-aged children three (3) years of
149149 age and older are participating in home -schooling;
150150 5. Programs that serve children three (3) years of age a nd
151151 older and that are operated during typical schoo l hours by a public
152152 school district;
153153 6. Programs that serve children three (3) years of age and
154154 older and that are operated during typical school hours by a private
155155 school that offers elementary education in grades kindergarten
156156 through third grade;
157157 7. Summer youth camps, summer programs or after-school programs
158158 for children who are at least four (4) years of age, that are
159159 accredited by a national standard -setting agency or church camp
160160 accreditation progra m, or are accredited by, chartered by or
161161 affiliated with a national non-profit organization;
162162 8. Programs in which children attend on a drop -in basis and
163163 parents are on the premises and readily accessible;

215215 9. A program of specialized activity or instructi on for
216216 children that is not designed or intended fo r child care purposes
217217 and operates not more than ten (10) hours per week including, but
218218 not limited to, scouts, 4-H clubs and summer resident youth camps,
219219 programs that limit children from enrolling in mul tiple sessions
220220 because of the type of activity or a ges accepted and single-activity
221221 programs such as academics, athletics, gy mnastics, hobbies, art,
222222 music, dance and craft instruction;
223223 10. Any child care facility that:
224224 a. provides care and supervision for fifteen (15) ten
225225 (10) or fewer hours per week,
226226 b. operates less than ten (10) weeks annually, or
227227 c. operates in the summer for less than eight (8) hours
228228 per day, or
229229 d. provides care and supervision for school -aged children
230230 only in a center-based program for twenty-one (21) or
231231 fewer hours a week and is loc ated in a county with a
232232 population of less than one hundred thousand (100,000)
233233 according to the latest Federal Decennial Census;
234234 11. Facilities whose primary purpose is medical treatment;
235235 12. Boarding schools that have education as their primary
236236 purpose and that are recognized as accredited by the State Board of
237237 Education. To be exempt, such programs shall:

289289 a. have classroom facilities that are not used for
290290 residential living,
291291 b. not have been granted nor have assumed legal custody
292292 of any child attending the facility, and
293293 c. adhere to standard educational holiday and seasonal
294294 recess periods to permit s tudents reasonable
295295 opportunities to return to their primary places of
296296 residence with parents or legal guardians;
297297 13. Day treatment programs and maternity h omes operated by a
298298 licensed hospital;
299299 14. Juvenile facilities certified b y the Office of Juvenile
300300 Affairs or certified by any other state agency authorized by law to
301301 license such facilities;
302302 15. A program where children are not enrolled by the parents
303303 and are free to come and go;
304304 16. A program in tribal land as defined at 2 5 U.S.C.A. 1903
305305 (10); and
306306 17. A program on a military base or federal property , or a
307307 facility licensed as a family child care pr ovider by a branch of the
308308 United States Department of D efense or by the United S tates Coast
309309 Guard.
310310 B. The provisions of the Oklahoma Child Care Facilities
311311 Licensing Act shall be equally incumbent upon all private and public
312312 child care facilities.

364364 C. Unlicensed child care facilities and programs listed in
365365 paragraphs 4 through 15 of subsectio n A of this section, and their
366366 employees, volunteers, or other individuals who have access to
367367 children, shall be subject to the criminal history records search
368368 and Child Care Restricted Registry provisions of Section 404.1 of
369369 this title. An unlicensed chi ld care facility or p rogram may
370370 request a waiver from such requirements from the Department. Any
371371 approved waiver shall be made public by the Department and the
372372 unlicensed facility or program on enrollment forms and websites.
373373 SECTION 2. This act shall become effective Nov ember 1, 2023.
