7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 59 O.S. 2021, Se ction 567.8, is
8181 amended to read as fol lows:
8282 Section 567.8. A. The Oklahoma Board of Nur sing shall have the
8383 power to take any or all of the following action s:
8484 1. To deny, revoke or suspend any:
8585 a. licensure to practice as a Licensed Practical Nurse,
8686 single-state or multistate,
8787 b. licensure to practice as a Registered Nurse, single -
8888 state or multistate,
8989 c. multistate privilege to practice in Oklahoma,

148148 2. To assess administr ative penalties; and
149149 3. To otherwise discip line applicants, licensees or Advanced
150150 Unlicensed Assistants.
151151 B. The Board shall may impose a disciplinary action against the
152152 person pursuant to the provisions of subsection A of this section
153153 upon proof that the person:
154154 1. Is guilty of deceit or material mis representation in
155155 procuring or attempting to procure:
156156 a. a license to practice registered nursing, licensed
157157 practical nursing, or a license to practice advanced
158158 practice registered nursing with or without eit her
159159 prescriptive authority recognition or author ization to
160160 order, select, obtain and administer drugs, or
161161 b. certification as an Advanced Unlicensed Assistant;
162162 2. Is guilty of a felony, o r any offense substantially related
163163 to the qualifications, functions or duties of any licensee or
164164 Advanced Unlicensed Assistant, or any offense an essential element

216216 of which is fraud, dishonesty, or an act of violence, whether or not
217217 sentence is imposed, o r any conduct resulting in the revocation of a
218218 deferred or suspended sentence or probation imposed pursuant to such
219219 conviction. For the purposes of this paragraph, "substantially
220220 related" means the nature of criminal conduct for which the person
221221 was convicted has a direct bearing on the fitness or ability to
222222 perform one or more of the duties or responsibilities necessa rily
223223 related to the occupation;
224224 3. Fails to adequately care for patients or to conform t o the
225225 minimum standards of acceptable nursing or Ad vanced Unlicensed
226226 Assistant practice that, in the opinion of the Boa rd, unnecessarily
227227 exposes a patient or other per son to risk of harm;
228228 4. Is intemperate in the use of found to be misusing or abusing
229229 alcohol or drugs, which use misuse or abuse the Board determines
230230 endangers or could endanger patients;
231231 5. Is found to be misusing or abusing alcohol or drugs, which
232232 misuse or abuse the Board determines does not endanger and could not
233233 endanger patients. However, the Board shall not impose a
234234 disciplinary action against the person pursuant to the provisions of
235235 subsection A of this section solely on the basis of this paragraph
236236 if the person can show proof of actively participating in substance
237237 abuse treatment or counseling or if the person agrees to participate
238238 in the Board's peer assistance program under Section 567.17 of this

291291 6. Exhibits through a pattern of practice or other behavior
292292 actual or potential inability to practice nursing with sufficient
293293 knowledge or reasonable skills and safety due to impai rment caused
294294 by illness, use of alcohol, drugs, chemicals or any oth er substance,
295295 or as a result of any mental or physical condition, including
296296 deterioration through the aging process or los s of motor skills,
297297 mental illness, or disability that results in i nability to practice
298298 with reasonable judgment, skill or safety; prov ided, however, the
299299 provisions of this paragraph shall not be utilized in a manner that
300300 conflicts with the provisions of th e Americans with Disabilities
301301 Act;
302302 6. 7. Has been adjudicated as mentally incompetent, mentally
303303 ill, chemically dependent or dangerou s to the public or has been
304304 committed by a court of competent jurisdiction, within or without
305305 this state;
306306 7. 8. Is guilty of unprofessional conduct as defined in the
307307 rules of the Board;
308308 8. 9. Is guilty of any act that jeopardizes a patient 's life,
309309 health or safety as defined in the rules of the Board;
310310 9. 10. Violated a rule promulgated by the Board, an order of
311311 the Board, or a state or federal law relating to the practice of
312312 registered, practical or advanced practice registered nursing or
313313 advanced unlicensed assisting, or a state or federal narcotics or
314314 controlled dangerous substance law including, but not limited to

366366 prescribing, dispensing or administering opioid drugs in excess of
367367 the maximum limits authorized in Section 2 -309I of Title 63 of the
368368 Oklahoma Statutes;
369369 10. 11. Has had disciplinary actions taken against the
370370 individual's registered or practical nursing license, advanced
371371 unlicensed assistive certification, or any professional or
372372 occupational license, registration or certification in this or an y
373373 state, territory or country;
374374 11. 12. Has defaulted or been terminated from the peer
375375 assistance program for any reason;
376376 12. 13. Fails to maintain professional boundaries with
377377 patients, as defined in the Board rules; or
378378 13. 14. Engages in sexual miscond uct, as defined in Board
379379 rules, with a current or former patient or key party, inside or
380380 outside the health care setting.
381381 C. 1. If the results of a criminal history records search
382382 conducted under Section 567.18 of this title reveal that the subject
383383 person has been convicted of, pled guilty or no contest to, or
384384 received a deferred sentence for, a felony or misdemeanor offense
385385 for any of the following offenses in any state or federal
386386 jurisdiction, the Board shall revoke or deny all applicable
387387 licenses, privileges, certifications, authoriza tions, and authority
388388 listed in paragraph 1 of subsection A of this section :

440440 a. abuse, neglect, or financial exploitation of any
441441 person entrusted to the care or possession of such
442442 person,
443443 b. rape, incest, sodomy, or any crime that resulted in
444444 the person being registered on a sex offender registry
445445 at any time,
446446 c. child abuse,
447447 d. murder or attempted murder,
448448 e. manslaughter,
449449 f. kidnapping,
450450 g. human trafficking,
451451 h. aggravated assault and battery,
452452 i. assault and battery with a da ngerous weapon, or
453453 j. arson in the first degree.
454454 2. If less than five (5) years have elapsed since the
455455 completion of a sentence, and the results of a criminal history
456456 records search reveal that the subject person has been convicted of,
457457 or pled guilty or no contest to, a felony or misdemeanor offense for
458458 any of the following offen ses, in any state or federal jurisdiction,
459459 the Board shall revoke or deny all applicable licens es, privileges,
460460 certifications, authoriza tions, and authority listed in paragraph 1
461461 of subsection A of this section :
462462 a. assault,

515515 c. indecent exposure and indecent exhibition, except
516516 where such offense disqualifi es the applicant as a
517517 registered sex offender,
518518 d. pandering,
519519 e. burglary in the first or second degree,
520520 f. robbery in the first or second degree,
521521 g. robbery or attempted robbery with a dangerous weapon,
522522 or imitation firearm,
523523 h. arson in the second degree,
524524 i. unlawful manufacture , distribution, prescription, or
525525 dispensing of a Schedule I through V drug as defined
526526 by the Uniform Controlled Dangerous Substances Act,
527527 j. grand larceny, or
528528 k. petit larceny or shop lifting.
529529 D. Any person who supplies t he Board information in good faith
530530 shall not be liable in any w ay for damages with respect to giving
531531 such information.
532532 D. E. The Board may cause to be investigated all reported
533533 violations of the Oklahoma Nursing Practice Act. Information
534534 obtained during an investigation into possible violations of the
535535 Oklahoma Nursing Practice Act shall be kept confidential, but may be
536536 introduced by the state in administrative proceedings before the
537537 Board, whereupon the information admitted becomes a public record.

589589 Public records maintained by the agency are administrative records,
590590 not public civil or criminal records.
591591 Confidential investigative r ecords shall not be subject to
592592 discovery or subpoena in any civil or criminal proceeding, except
593593 that the Board may give such info rmation to law enforcement and
594594 other state agencies as neces sary and appropriate in the discharge
595595 of the duties of that agency and only under circumstances that
596596 ensure against unauthorized access to the information.
597597 E. F. The Board may authorize the Executiv e Director to issue a
598598 confidential letter of concern to a licensee when evidence does not
599599 warrant formal proceedings, but t he Executive Director has noted
600600 indications of possible errant conduct that could lead to serious
601601 consequences and formal action.
602602 F. G. All individual proceedings before the Board shall be
603603 conducted in accordance with the Administrative Procedures Act.
604604 G. H. At a hearing the accused shall have the right to appear
605605 either personally or by counsel, or both, to produce witnesses and
606606 evidence on behalf of the accused, to cross-examine witnesses and to
607607 have subpoenas issued by the designated Board staff. If th e accused
608608 is found guilty of the charges the Board may refuse to issue a
609609 renewal of license to the applicant, revoke or suspend a licens e, or
610610 otherwise discipline a licensee.

662662 H. I. A person whose license is revoked may not apply for
663663 reinstatement during t he time period set by the Board. The Board on
664664 its own motion may at any time reconsider its action.
665665 I. J. Any person whose license is revoked or who applies for
666666 renewal of registration and who is rejected by the Board shall have
667667 the right to appeal from such action pursuant to the Administrative
668668 Procedures Act.
669669 J. K. 1. Any person who has been determined by the Board to
670670 have violated any provisions of the Oklahoma Nursing Practice Act or
671671 any rule or order issued pursuant thereto shall be liable for an
672672 administrative penalty not to exceed Five Hundred Dollars ($500.00)
673673 for each count for which any holder of a certificate or license has
674674 been determined to be in violation of the Oklahoma Nurs ing Practice
675675 Act or any rule promulgated or order issued pursuant thereto.
676676 2. The amount of the penalty shall be assessed by the Board
677677 pursuant to the provisions of this section, after notice and an
678678 opportunity for hearing is given to the accused. In det ermining the
679679 amount of the penalty, the Board shall include, but n ot be limited
680680 to, consideration of the nature, circumstances, and gravity of the
681681 violation and, with respect to the person found to have committed
682682 the violation, the degree of culpability, t he effect on ability of
683683 the person to continue to practice, and an y show of good faith in
684684 attempting to achieve compliance with the provisions of the Oklahoma
685685 Nursing Practice Act.

737737 K. L. The Board shall retain jurisdiction over any person
738738 issued a license, certificate or temporary license pursuant to the
739739 Oklahoma Nursing Practice Act, regardless of whether the license,
740740 certificate or temporary license has expired, lapsed or been
741741 relinquished during or a fter the alleged occurrence or conduct
742742 prescribed by the Oklahoma Nursing Practice Act.
743743 L. M. In the event disciplinary action is imposed, any person
744744 so disciplined shall be responsible for any and all costs associated
745745 with satisfaction of the discipline imposed.
746746 M. N. In the event disciplinary action is im posed in an
747747 administrative proceeding, the Board shall have the au thority to
748748 recover the monies expended by the Board in pursuing any
749749 disciplinary action, including but not limited to costs of
750750 investigation, probation or monitoring fees, administrative cos ts,
751751 witness fees, attorney fees and court costs. This authority s hall
752752 be in addition to the Board 's authority to impose discipline as set
753753 out in subsection A of this section.
754754 N. O. The Executive Director shall immediately su spend the
755755 license of any person upon proof that the person has been sentenced
756756 to a period of continuous incarceration serving a penal sentence for
757757 commission of a misdemeanor or felony. The suspension shall remain
758758 in effect until the Board acts upon the l icensee's written
759759 application for reinstatement of the license.

811811 O. P. When a majority of the of ficers of the Board, which
812812 constitutes the President, Vice President and Secretary/Treasurer,
813813 find that preservation of the public healt h, safety or welfare
814814 requires immediate action, summary suspension of licensure or
815815 certification may be ordered before t he filing of a sworn complaint
816816 or at any other time before the outcome of an individual proceeding.
817817 The summary suspension of licensure or certification may be or dered
818818 without compliance with the requirements of the Oklahoma Open
819819 Meeting Act. Within seve n (7) days after the summary suspension,
820820 the licensee shall be notified by letter that summary suspension has
821821 occurred. The summary sus pension letter shall includ e notice of the
822822 date of the proposed hearing to be held in accordance with Oklahoma
823823 Administrative Code 485:10-11-2 and the Administrative Procedures
824824 Act, within ninety (90) days of the date of the summary suspension
825825 letter, and shall be signed by one of t he Board officers.
826826 P. Q. In any proceeding in which the Board is required to serve
827827 an order on an individual, the Board may send such material to the
828828 individual's address of record with the Board. If the order is
829829 returned with a notation by the United State s Postal Service
830830 indicating that it is undeliverable for any reason, and the records
831831 of the Board indicate that the Board has not received any change of
832832 address since the order was sent, as required by the rules of the
833833 Board, the order and any subsequent m aterial relating to the same
834834 matter sent to the most recent address on file with the Board shall
