75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY Section 2, Chapter 190, O.S.L.
77	77	2022 (63 O.S. Supp. 2022, Section 1 -745.32), is amended to read as
78	78	follows:
79	79	Section 1-745.32. As used in this act:
80	80	1. “Abortion” has the same meaning as provided by Section 1 -730
81	81	of this title;
82	82	2. “Fetal heartbeat” means cardiac activity or the steady and
83	83	repetitive rhythmic contractio n of the fetal heart within the
84	84	gestational sac;
85	85	2. 3. “Gestational age” means the amount of time that has
86	86	elapsed from the first day of a woman’s last menstrual period;

138	138	3. 4. “Gestational sac” means the structure comprising the
139	139	extraembryonic membranes that e nvelop the unborn child and that is
140	140	typically visible by ultrasound after the fourth week of pregnancy;
141	141	4. 5. “Physician” means an individual licensed to practice
142	142	medicine in this state including a medical doctor and a doctor of
143	143	osteopathic medicine ;
144	144	5. 6. “Pregnancy” means the human female reprodu ctive condition
145	145	that:
146	146	a. begins with fertiliza tion,
147	147	b. occurs when the woman is carrying the developing human
148	148	offspring, and
149	149	c. is calculated from the first day of the woman’s last
150	150	menstrual period;
151	151	6. 7. “Standard medical practice” means the degree of skill,
152	152	care, and diligence that an obstetrician of ordinary judgment,
153	153	learning, and skill would employ in like circumstances;
154	154	7. 8. “Unborn child” means a human fetus or embryo in any stage
155	155	of gestation from fertilizatio n until birth; and
156	156	8. 9. “Woman” and “women” include any person whose biological
157	157	sex is female including any person with XX chromosomes and any
158	158	person with a uterus, regardless of any gender identit y that the
159	159	person attempts to assert or claim .

211	211	SECTION 2. AMENDATORY Section 1, Chapter 321, O.S.L.
212	212	2022 (63 O.S. Supp. 2022, Section 1 -745.51), is amended to read as
213	213	follows:
214	214	Section 1-745.51. As used in this act:
215	215	1. “Abortion” means the act of using, prescribing,
216	216	administering, procuring, or selling of any instrument, medicine,
217	217	drug, or any other substance, device, or means with the purp ose to
218	218	terminate the pregnan cy of a woman, with knowledge that the
219	219	termination by any of those means will with reasonable likelihood
220	220	cause the death of an unborn child. It does not include the use,
221	221	prescription, administration, procuring, or selling of Pl an B,
222	222	morning-after pills, or any other type of contraception or emergency
223	223	contraception. An act is not an abortion if the act is performed
224	224	with the purpose to:
225	225	a. save the life or preserve the healt h of the unborn
226	226	child,
227	227	b. remove a dead unborn child cau sed by spontaneous
228	228	abortion, or
229	229	c. remove an ectopic pregnancy
230	230	has the same meaning as provided by S ection 1-730 of this title;
231	231	2. “Fertilization” means the fusion of a human spermatozoon
232	232	with a human ovum;
233	233	3. “Medical emergency” means a condition in whi ch an abortion
234	234	is necessary to preserve the life of a pregnant woman whose life is
