3599 Section 3635. A. Subject to the final appro val of the
36100 eligibility application by the Oklahoma Department of Comm erce, a
37101 requirement that the incentive payments made pursuant to the
38102 provisions of this act the Filmed in Oklahoma Act of 2021 achieve
39103 the maximum positive impact for the Okla homa economy and subject to
40104 the Oklahoma workforce requirements of Section 7 3637 of this act
41105 title, the base incentive amount for a project filmed in this state
42106 shall be a maximum of twenty percent (20%) of the qualified
43107 production expenditure amount. An incentive for a project filmed in
44108 this state for wages paid to nonresident crew, not including above-
45109 the-line personnel, before July 1, 2023 April 1, 2023, shall be
46110 provided in the amount of seven and one-half percent (7.5%).

50111 B. In addition to the amount authorized by subsection A of this
51112 section, there may be an additional incentive amount, subject to the
52113 final approval of the Oklahoma Department of Commerce, in the
53114 maximum amount of:

55115 1. Three percent (3%) of the qualified production expenditure
56116 amount for projects where at least twenty-five percent (25%) of main
57117 crew principal photo graphy days are filmed on location, exc luding
58118 sound stage production, in any county of this state if the county
59119 has a population of less t han two hundred fifty thousand (250,000)
60120 persons according to the federal Federal Decennial Census or most
61121 recent population estimate;

123215 is paid pursuant to the provisions of this act shall contain a logo,
124216 as approved by the Oklahoma Department of Commerce, to be displayed
125217 in the end credits of the finished production for a period of at
126218 least five (5) seconds or, if the production does not contain end
127219 credits, the Oklahoma Department of Commerce shall obtain a
128220 commitment by the production company to provide equivalent value as
129221 determined by the Oklahoma Department of Commerce.

318+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
319+SECTION 4. AMENDATORY 68 O.S. 2021, Section 3635, is
320+amended to read as follows:
321+Section 3635. A. Subject to the final approval of the
322+eligibility application by the Oklahoma Department of Comm erce, a
323+requirement that the incentive payments made pursuant to the
324+provisions of this act the Filmed in Oklahoma Act of 2021 achieve
325+the maximum positive impact for the Oklahoma economy and subject to

461+SECTION 5. AMENDATORY 68 O.S. 2021, Section 3638, is
462+amended to read as follows:
463+Section 3638. All production projects for which any incentive
464+is paid pursuant to t he provisions of this act shall contain a logo
465+qualifying promotion of this state, as approved by the Oklahoma
466+Department of Commerce, to be displayed in the end credits of the
467+finished production or, if the production does not contain end
468+credits, the Oklahoma Department of Commerce shall obtain a
469+commitment by the produ ction company to provide equivalent value as
470+determined by the Oklahoma Department of Commerce which shall
471+include the following:
472+1. For a film production with end credits, a five (5) second
473+long static or animated logo , approved by the Department, in the end
474+credits before the below -the-line crew crawl for the life of the
475+project;
476+2. For a film production without end credits and television
477+series or projects, a five (5) second long static or animated logo,
478+approved by the Departme nt, during each broadcast worldwide for the
479+life of the project; or
