53 | 54 | | SECTION 1. AMENDATORY 85A O.S. 2021, Section 400, is |

55 | 56 | | Section 400. A. The Workers’ Compensation Court shall be |

56 | 57 | | renamed the Workers’ Compensation Court of Existing Claims for the |

151 | 154 | | (90%) of the compensation of a district court judge. |

152 | 155 | | 2. The Administrator shall employ and supervise the work of |
---|
153 | 156 | | employees of the Court and shall have the authority to expend funds |
---|
154 | 157 | | and contract on behalf of the Court. The Administrator may cont ract |
---|
155 | 158 | | with the Workers’ Compensation Commission to provide support |
---|
156 | 159 | | services or personnel needs nec essary to carry out the purposes of |
---|
157 | 160 | | the Court and shall supervise the work of any such personnel as |
---|
158 | 161 | | necessary to maintain the Court as a Court of Record. |
---|
159 | 162 | | G. The Court of Existing Claims shall contract with the |
---|
160 | 163 | | Workers’ Compensation Commission to integrate its case manage ment |
---|
161 | 164 | | and records Information Technology System into the s ystem of the |
---|
162 | 165 | | Workers’ Compensation Commission with such integration to be |
---|

198 | 202 | | contempt those persons who disobey a subpoena, or refuse to be sworn |
---|
199 | 203 | | or to answer as a witness, when lawfully ordered to do so. |
---|
200 | 204 | | J. The principal office of the Court shall be situated in the |
---|
201 | 205 | | City of Oklahoma City in quarters assigned by the Office of |
---|
202 | 206 | | Management and Enterprise Services. The Court may hold hearings in |
---|
203 | 207 | | any city of this state. |
---|
204 | 208 | | K. All county commissi oners and presiding district judges of |

205 | 209 | | this state shall make quarters available for the conducting of |
---|
206 | 210 | | hearings by a judge of the Court upon reque st by the Court. |
---|
207 | 211 | | L. Judges of the Workers’ Compensation Court of Existing Clai ms |

250 | 255 | | previous statute in effect on the date of an injury that occurred |
---|
251 | 256 | | before February 1, 2014. In the event that an insufficient number |
---|
252 | 257 | | of active judges are available to comprise the three-judge en banc |
---|
253 | 258 | | panel, retired or former judges of the dis trict court, Workers ’ |
---|
254 | 259 | | Compensation Court or Workers’ Compensation Court of Existing Claims |
---|
255 | 260 | | may be designated by the Presiding Judge of the Court of Existing |
---|
256 | 261 | | Claims as eligible t o serve on such panel. The Governor shall |

297 | 303 | | No accrued right, penalty incur red, or proceeding begun by virtue of |

298 | 304 | | a statute repealed by this act shall be abrogated by the terms of |
---|
299 | 305 | | this act. |

300 | 306 | | P. Annually, on or before the first day of July, commencing |
---|
301 | 307 | | with July 2019, the Administrator shall prepare a nd submit a report |
---|
302 | 308 | | for the prior calendar year to the Governor, the Chief Justice of |
---|
303 | 309 | | the Supreme Court, the President Pro Tempore of the Senate, and the |
---|
304 | 310 | | Speaker of the House of Representatives, and the Chairs of the |
---|
305 | 311 | | Senate and House Judiciary Committees, which shall include a |
---|
306 | 312 | | statement of the number of awards made an d the causes of the |
---|
307 | 313 | | accidents leading to the injuries for which the awards were made, |

308 | 314 | | total work load data of the Court , a detailed report of the work |

348 | 355 | | SECTION 2. It being immediately necessary for the preservation |

349 | 356 | | of the public peace, health or safety, an emergency is hereby |

350 | 357 | | declared to exist, by reason whereof this act shall take effect and |
---|
351 | 358 | | be in full force from and after its passage an d approval. |
