5750 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5851 SECTION 1. AMENDATORY 63 O.S. 2021, Section 3242, is
5952 amended to read as follows:
6053 Section 3242. A. An eligible provider, as described in
6154 subsection B of this section, in addition to the rate of payment
6255 that the provider would otherwise receive for Medica id ground
6356 emergency medical transportation services, shall receive
6457 supplemental Medicaid reimbursement to the ex tent provided by law.
58+B. A provider shall be eligible for supplemental reimbursement
59+only if the provider meets the following conditions during the state
60+fiscal year:
61+1. Provides ground emergency medical transportat ion services to
62+Medicaid beneficiaries;

92-B. A provider shall be eligible for supplemental reimbursement
93-only if the provider meets the following conditions during the state
94-fiscal year:
95-1. Provides ground emergency medi cal transportation services to
96-Medicaid beneficiaries;
9789 2. Is a provider that is enrolle d as a Medicaid provider for
9890 the period being claimed; and
9991 3. Is owned or operated by the state, a political subdivision
10092 or local government, that employs or contracts with persons w ho are
10193 licensed to provide emergency me dical services in the State of
10294 Oklahoma, and includes private entities to the extent permissible
10395 under federal law.
10496 C. An eligible provider ’s supplemental reimbursement pursuant
10597 to this section shall be calculated an d paid as follows:
10698 1. The supplemental reimbursement to an eligible prov ider, as
10799 described in subsection B of this section, shall be e qual to
108100 a. for services reimburse d through fee-for-service
109101 contracts, the amount of federal financial
110102 participation received because of the claims submitted
111103 pursuant to paragraph 3 of subsection F of this
112104 section, and
113105 b. for services reimbursed through cap itated contracts,
114106 an amount to be determined in accordance with the
115107 approved directed payment pre -print, based on claims
108+submitted pursuant to paragraph 3 of subsection F of
109+this section;
110+2. In no instance shall the amount certified pursuant to
111+paragraph 1 of subsection E of this section, when combined with the
112+amount received from all other sources of reimbursement from th e

143-submitted pursuant to paragraph 3 of subsection F of
144-this section;
145-2. In no instance shall the amount certified pursuant to
146-paragraph 1 of subsection E of this section, when combined with the
147-amount received from all other sources of reimbursement from the
148139 Medicaid program, exceed one hundred percent (100%) of actual costs,
149140 as determined pursuant to the Medicaid state plan, for ground
150141 emergency medical transportation services; and
151142 3. The supplemental Medicaid reimbursement provide d by this
152143 section shall be distributed exclusively to eligible p roviders under
153144 a payment methodology based on ground emergency medical
154145 transportation services p rovided to Medicaid beneficiaries by
155146 eligible providers on a per-transport basis or other federa lly
156147 permissible basis. T he Oklahoma Health Care Authority shall obtain
157148 approval from the Centers for Medicare and Medicaid Services for the
158149 payment methodology to be utilized, and shall not make any payment
159150 pursuant to this section prior to obtaining that approval.
160151 D. 1. It is the Legislature’s intent in enacting th is section
161152 to provide the suppleme ntal reimbursement described in this section
162153 without any expenditure from the state General Revenue Fund. An
163154 eligible provider, as a condition of receiving s upplemental
164155 reimbursement pursuant to this section, shall enter into, and
165156 maintain, an agreement w ith the Authority for the purposes of
157+implementing this sectio n and reimbursing the state for the costs of
158+administering this section.
159+2. The nonfederal shar e of the supplemental rei mbursement
160+submitted to the federal Cen ters for Medicare and Medicaid Ser vices
161+for purposes of claiming federal financial participation shall be
162+paid only with funds from the governme ntal entities described in

193-implementing this sectio n and reimbursing the state for the costs of
194-administering this section.
195-2. The nonfederal shar e of the supplemental reimbursement
196-submitted to the federal Cen ters for Medicare and Medicaid Ser vices
197-for purposes of claiming federal financial participation shall be
198-paid only with funds from the governme ntal entities described in
199189 paragraph 3 of subsec tion B of this section an d certified to the
200190 state as provided in subsection E of this section.
201191 E. Participation in the reimbursement program provided by this
202192 section by an eligible provider as set forth in s ubsection B of this
203193 section is voluntary. If an applicable governmental entity elects
204194 to seek supplemental reim bursement pursuant to this section on
205195 behalf of an eligible provider, the governmental entity sh all do the
206196 following:
207197 1. Certify
208198 a. certify, in conformity with the requirements of 42
209199 C.F.R. § 433.51, that the claimed expenditures for the
210200 ground emergency medical transportation services ar e
211201 eligible for federal financial participation ;,
212202 2. Provide
213203 b. provide evidence supporting the certification as
214204 specified by the Oklahoma Health Care Authority ;,
215205 3. Submit
206+c. submit data as specified by the Authority to determine
207+the appropriate amounts to claim as expenditures
208+qualifying for federal financial par ticipation;, and
209+4. Keep
210+d. keep, maintain, and have readily retrievable any
211+records specified by the Authority to fully d isclose
212+reimbursement amounts to which the eligible provider

243-c. submit data as specified by the Authority to determine
244-the appropriate amounts to claim as expenditures
245-qualifying for federal financial par ticipation;, and
246-4. Keep
247-d. keep, maintain, and have readily retrievable any
248-records specified by the Auth ority to fully disclose
249-reimbursement amounts to which the eligible provider
250239 is entitled, and any other records required by the
251240 Centers for Medicare and Medicaid Services ; or
252241 2. Enter into and maintain an intergovernmental agree ment with
253242 the Authority, as specified by the Authority.
254243 F. 1. The Authority sha ll promptly seek any necessary fed eral
255244 approvals for the implementation of this section. Th e Authority may
256245 limit the program to those costs t hat are allowable expenditures
257246 under Title XIX of the Social Security Act, 4 2 U.S.C. § 1396 et seq.
258247 If federal approval is not obtained for impleme ntation of this
259248 section, this section shall not be impleme nted.
260249 2. The Authority shall submit claims for fe deral financial
261250 participation for the expenditures for the services delineat ed in
262251 subsection E of this section tha t are allowable expenditures under
263252 federal law.
264253 3. The Authority shall submit any necessary materials to the
265254 federal government to provide as surances that claims for federal
255+financial participation will include only t hose expenditures that
256+are allowable under federal law.
257+SECTION 2. It being immediately necessary for the preservation
258+of the public peace, health or safety, an emergency is hereby
259+declared to exist, by reason whereof this act shall take e ffect and
260+be in full force from and af ter its passage and approval.
