57 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

58 | 51 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 3242, is |
---|
59 | 52 | | amended to read as follows: |
---|
60 | 53 | | Section 3242. A. An eligible provider, as described in |
---|
61 | 54 | | subsection B of this section, in addition to the rate of payment |
---|
62 | 55 | | that the provider would otherwise receive for Medica id ground |
---|
63 | 56 | | emergency medical transportation services, shall receive |
---|
64 | 57 | | supplemental Medicaid reimbursement to the ex tent provided by law. |
---|
97 | 89 | | 2. Is a provider that is enrolle d as a Medicaid provider for |
---|
98 | 90 | | the period being claimed; and |
---|
99 | 91 | | 3. Is owned or operated by the state, a political subdivision |
---|
100 | 92 | | or local government, that employs or contracts with persons w ho are |
---|
101 | 93 | | licensed to provide emergency me dical services in the State of |
---|
102 | 94 | | Oklahoma, and includes private entities to the extent permissible |
---|
103 | 95 | | under federal law. |
---|
104 | 96 | | C. An eligible provider ’s supplemental reimbursement pursuant |
---|
105 | 97 | | to this section shall be calculated an d paid as follows: |
---|
106 | 98 | | 1. The supplemental reimbursement to an eligible prov ider, as |
---|
107 | 99 | | described in subsection B of this section, shall be e qual to |
---|
108 | 100 | | a. for services reimburse d through fee-for-service |
---|
109 | 101 | | contracts, the amount of federal financial |
---|
110 | 102 | | participation received because of the claims submitted |
---|
111 | 103 | | pursuant to paragraph 3 of subsection F of this |
---|
112 | 104 | | section, and |
---|
113 | 105 | | b. for services reimbursed through cap itated contracts, |
---|
114 | 106 | | an amount to be determined in accordance with the |
---|
115 | 107 | | approved directed payment pre -print, based on claims |
---|
148 | 139 | | Medicaid program, exceed one hundred percent (100%) of actual costs, |
---|
149 | 140 | | as determined pursuant to the Medicaid state plan, for ground |
---|
150 | 141 | | emergency medical transportation services; and |
---|
151 | 142 | | 3. The supplemental Medicaid reimbursement provide d by this |
---|
152 | 143 | | section shall be distributed exclusively to eligible p roviders under |
---|
153 | 144 | | a payment methodology based on ground emergency medical |
---|
154 | 145 | | transportation services p rovided to Medicaid beneficiaries by |
---|
155 | 146 | | eligible providers on a per-transport basis or other federa lly |
---|
156 | 147 | | permissible basis. T he Oklahoma Health Care Authority shall obtain |
---|
157 | 148 | | approval from the Centers for Medicare and Medicaid Services for the |
---|
158 | 149 | | payment methodology to be utilized, and shall not make any payment |
---|
159 | 150 | | pursuant to this section prior to obtaining that approval. |
---|
160 | 151 | | D. 1. It is the Legislature’s intent in enacting th is section |
---|
161 | 152 | | to provide the suppleme ntal reimbursement described in this section |
---|
162 | 153 | | without any expenditure from the state General Revenue Fund. An |
---|
163 | 154 | | eligible provider, as a condition of receiving s upplemental |
---|
164 | 155 | | reimbursement pursuant to this section, shall enter into, and |
---|
165 | 156 | | maintain, an agreement w ith the Authority for the purposes of |
---|
199 | 189 | | paragraph 3 of subsec tion B of this section an d certified to the |
---|
200 | 190 | | state as provided in subsection E of this section. |
---|
201 | 191 | | E. Participation in the reimbursement program provided by this |
---|
202 | 192 | | section by an eligible provider as set forth in s ubsection B of this |
---|
203 | 193 | | section is voluntary. If an applicable governmental entity elects |
---|
204 | 194 | | to seek supplemental reim bursement pursuant to this section on |
---|
205 | 195 | | behalf of an eligible provider, the governmental entity sh all do the |
---|
206 | 196 | | following: |
---|
207 | 197 | | 1. Certify |
---|
208 | 198 | | a. certify, in conformity with the requirements of 42 |
---|
209 | 199 | | C.F.R. § 433.51, that the claimed expenditures for the |
---|
210 | 200 | | ground emergency medical transportation services ar e |
---|
211 | 201 | | eligible for federal financial participation ;, |
---|
212 | 202 | | 2. Provide |
---|
213 | 203 | | b. provide evidence supporting the certification as |
---|
214 | 204 | | specified by the Oklahoma Health Care Authority ;, |
---|
215 | 205 | | 3. Submit |
---|
250 | 239 | | is entitled, and any other records required by the |
---|
251 | 240 | | Centers for Medicare and Medicaid Services ; or |
---|
252 | 241 | | 2. Enter into and maintain an intergovernmental agree ment with |

253 | 242 | | the Authority, as specified by the Authority. |

254 | 243 | | F. 1. The Authority sha ll promptly seek any necessary fed eral |
---|
255 | 244 | | approvals for the implementation of this section. Th e Authority may |
---|
256 | 245 | | limit the program to those costs t hat are allowable expenditures |
---|
257 | 246 | | under Title XIX of the Social Security Act, 4 2 U.S.C. § 1396 et seq. |
---|
258 | 247 | | If federal approval is not obtained for impleme ntation of this |
---|
259 | 248 | | section, this section shall not be impleme nted. |
---|
260 | 249 | | 2. The Authority shall submit claims for fe deral financial |
---|
261 | 250 | | participation for the expenditures for the services delineat ed in |
---|
262 | 251 | | subsection E of this section tha t are allowable expenditures under |
---|
263 | 252 | | federal law. |
---|
264 | 253 | | 3. The Authority shall submit any necessary materials to the |
---|
265 | 254 | | federal government to provide as surances that claims for federal |
---|
293 | | - | financial participation wil l include only those expenditures that |
---|
294 | | - | are allowable under federal law. |
---|
295 | | - | SECTION 2. It being immediately necessary for the preservation |
---|
296 | | - | of the public peace, health or safety, an emergency is hereby |
---|
297 | | - | declared to exist, by reason whereof this act shall take effect and |
---|
298 | | - | be in full force from and af ter its passage and approval. |
