74124 SECTION 1. AMENDATORY 59 O.S. 2021, Section 328.3, is
75125 amended to read as follows:

77126 Section 328.3. As used in the State Dental Act, the follow ing
78127 words, phrases, or terms, unless the context otherwis e indicates,
79128 shall have the follo wing meanings:

81129 1. “Accredited dental college” means an institution whose
82130 dental educational pro gram is accredited by the Commission on Dental
83131 Accreditation of the Am erican Dental Association;

85132 2. “Accredited dental hygie ne program” means a dental hygiene
86133 educational program which is accredited by the Commission on Dental

91162 3. “Accredited dental assisting program ” means a dental
92163 assisting program whi ch is accredited by the Commission on Dental
93164 Accreditation of the American Dental Association;

95165 4. “Advanced procedure” means a dental procedure for which a
96166 dental hygienist has received special training in a course of study
97167 approved by the Board ;

99168 5. “Board” means the Board of Dentistry;

101169 5. 6. “Certified dental assistant” means a dental assistant who
102170 has earned and maintains current certified dental assistant
103171 certification from the Dental Assisting National Board (D ANB);

105172 6. 7. “Coronal polishing” means a procedure limited to the
106173 removal of plaque and stain from exposed tooth surfaces, utilizing a
107174 slow speed hand piece with a prophy/polishing cup or brush and
108175 polishing agent and is not prophylaxis. To be considered
109176 prophylaxis, examination for calculus an d scaling must be done by a
110177 hygienist or dentist;

112178 7. 8. “Deep sedation” means a drug-induced depression of
113179 consciousness during which patients cannot be easily aro used but
114180 respond purposefully following repeated or painfu l stimulation. The
115181 ability to independently maintain ventilator fu nction may be
116182 impaired. Patients may require assistance in maintaining a patent
117183 airway, and spontaneous ventilation may be inadequ ate.

120212 8. 9. “Dentistry” means the practice o f dentistry in all of its

124215 college who has been issued a license by the Board to practice
125216 dentistry as defined in Section 328.19 of this title;

127217 10. 11. “Dental ambulatory surgical center (DASC)” means a
128218 facility that operates exclusively for the pur pose of furnishing
129219 outpatient surgical services to patients. A DASC shall have the
130220 same privileges and requirements as a dental office and additionally

135222 11. 12. “Dental office” means an establishme nt owned and
136223 operated by a dentist for the practice of dentistry, which may be
137224 composed of reception r ooms, business offices, private offices,
138225 laboratories, and den tal operating rooms where dental operations are

141227 12. 13. “Dental hygiene” means the science and practice of the
142228 promotion of oral health and prevention and treatment of oral
143229 disease through the provision of educational, therapeutic, clinical ,
144230 and preventive services ;

146231 14. “Dental hygienist” means an individual who has fulfilled
147232 the educational requirements and is a graduate of an accredited
148233 dental hygiene program and who has pa ssed an examination and has
149234 been issued a license by the Board and who is authorized to practice

152263 13. 15. “Dental assistant or oral maxillofacial surgery
153264 assistant” “Dental assistant” or “oral maxillofacial surgery
154265 assistant” means an individual working for a dentist, under the
155266 dentist’s direct supervision or direct visual supervision, and
156267 performing duties in the dental office or a treatmen t facility
157268 including the limited treatment of patients in accordance with the
158269 provisions of the State Dental Act. A dental assistant or oral
159270 maxillofacial surgery assistant may a ssist a dentist with the
160271 patient; provided, this shall be done only under the direct
161272 supervision or direct visual supervision and control of the dentist
162273 and only in accordance with the educational requirements and rules
163274 promulgated by the Board;

165275 14. 16. “Dental laboratory” means a location, whether in a
166276 dental office or not, where a dentist or a dental laboratory
167277 technician performs dental laboratory technology;

169278 15. 17. “Dental laboratory technician ” means an individual
170279 whose name is duly filed in the off icial records of the Board, which
171280 authorizes the technician, upon the laborat ory prescription of a
172281 dentist, to perform dental laboratory technology, which services
173282 must be rendered only to the prescribing dentist and not to t he
174283 public;

178284 16. 18. “Dental laboratory technology” means using materials

180313 of dental restorations, appliances or other devices to be worn in a
181314 human mouth;

183315 17. 19. “Dental specialty” means a specialized practice of a
184316 branch of dentistry, recogni zed by the Board, where the dental
185317 college and specialty program are accredited by the Commission on
186318 Dental Accreditation (CODA), or a dental specialty recognized by the
187319 Board, requiring a minimum num ber of hours of approved education and
188320 training and/or recognition by a nationally recognized association
189321 or accreditation board;

191322 18. 20. “Direct supervision” means the supervisory dentist is
192323 in the dental office or treatment facility and, during the
193324 appointment, personally examines the patient, diagnoses any
194325 conditions to be treated, and authorizes the procedu res to be
195326 performed by a dental hygienist, dental assistant, or oral
196327 maxillofacial surgery assistant. The supervising dentist is
197328 continuously on-site and physically present in the dental office or
198329 treatment facility while the procedures are being performe d and,
199330 before dismissal of the patient, evaluates the results of the dental
200331 treatment;

202332 19. 21. “Direct visual supervision ” means the supervisory
203333 dentist has direct ongoing visual oversight which shall be
204334 maintained at all times during any procedure author ized to be
205335 performed by a dental assistant or an oral maxillofacial surgery

208364 20. 22. “Expanded duty” means a dental procedure for which a
209365 dental assistant has received special training in a course of study
210366 approved by the Board ;

212367 23. “Fellowship” means a program designed for post-residency
213368 graduates to gain knowledge and experience in a specialized field;

215369 21. 24. “General anesthesia” means a drug-induced loss of
216370 consciousness during which patients a re not arousable, even b y
217371 painful stimulation. The ability to independently maintain
218372 ventilator function is often impaired. Patients often require
219373 assistance in maintaining a patent airway, and positive pressure
220-

222374 ventilation may be required because of dep ressed spontaneous
223375 ventilation or drug-induced depression of neuromuscular function.
224376 Cardiovascular function may be impaired;

226377 22. 25. “General supervision” means the supervisory dentist has
227378 diagnosed any conditions to be tre ated within the past thirteen ( 13)
228379 months, has personally authorized the procedures to be performed by
229380 a dental hygienist, and will evaluate the results of the dental
230381 treatment within a reasonab le time as determined by the na ture of
231382 the procedures performed, the needs of the patient, an d the
232383 professional judgment of the supervisory dentist. General
233384 supervision may only be used to supervise a hygienist and may not be
234385 used to supervise an oral max illofacial surgery assistant or dental
235386 assistant except as provided by Section 7 of this act;

237414 23. 26. “Indirect supervision ” means the supervisory dentist is
238415 in the dental office or treatment facility and has personally
239416 diagnosed any conditions to be treated, authorizes the procedures to
240417 be performed by a dental hygienist, remains in the dental o ffice or
241418 treatment facility while the procedur es are being performed, and
242419 will evaluate the results of the dental treatment within a
243420 reasonable time as determined by the nature of the procedures
244421 performed, the needs of the patient, and the professional jud gment
245422 of the supervisory dentist. Indirect su pervision may not be used
246423 for an oral maxillofacial surgery assistant or a dental assistant;

248424 24. 27. “Investigations” means an investigation procee ding,
249425 authorized under Sections 328.15A and 328.43a of this ti tle, to
250426 investigate alleged violations of the State Dental Act or the rules
251427 of the Board;

253428 25. 28. “Laboratory prescription” means a written description,
254429 dated and signed by a dentist, of dental laboratory technology to be
255430 performed by a dental laboratory technician;
256-
257431 26. 29. “Minimal sedation” means a minimally depressed level of
258432 consciousness, produced by a pharmacological method, that retains
259433 the patient’s ability to independently and continuou sly maintain an
260434 airway and respond normally to tactile stimul ation and verbal
261435 command. Although cognitive function and coordination may be
262436 modestly impaired, ventilator and cardiovascular functions are
263437 unaffected;

267465 27. 30. “Mobile dental anesthesia provid er” means a licensed
268466 and anesthesia-permitted dentist, physi cian or certified registered
269467 nurse anesthetist Certified Registered Nurse Anesthetist (CRNA) that
270468 has a mobile dental unit and prov ides anesthesia in dental offices
271469 and facilities in the state;

273470 28. 31. “Mobile dental clinic” means a permitted motor vehicle
274471 or trailer utilized as a dental clini c, and/or that contains dental
275472 equipment and is used to provide dental s ervices to patients on-site
276473 and shall not include a mobile dental anesthesia provider. A mobile
277474 dental clinic shall also mean and include a volunteer mobile dental
278475 facility that is directly affiliated with a church or religious
279476 organization as defined by Section 501(c)(3) or 501(d) of the United
280477 States Internal Revenue Code, the church or religious org anization
281478 with which it is affiliated is clearly indicated on the exterior of
282479 the mobile dental facility, and such facility does not receive any
283480 form of payment either directly or indirectly for work provided to
284481 patients other than donations through the af filiated church or
285482 religious organization; provided, that the volunteer mobile dental
286483 facility shall be exempt from any registration fee required under
287484 the State Dental Act;

289485 29. 32. “Moderate sedation” means a drug-induced depression of
290486 consciousness during which patients respond purposefully to verbal
291487 commands, either alone or accompanied by light tactile stimulation.

298520 supragingival and subgingival surfa ces of human teeth, utilizing
299521 instrumentation by scaler or periodontal curette on the crown and
300522 root surfaces of human teeth including rotary or power-driven
301523 instruments. This procedure may only be performed by a dentist or
302524 dental hygienist;

304525 31. 34. “Patient” or “patient of record” means an individual
305526 who has given a medical history and has been examin ed and accepted
306527 by a dentist for dental care;

311529 clinical and didactic training in general dentistry or other
312530 specialties or other specialists at the post-doctoral level

317534 supervision, indirect supervision or general supervision;

320536 patient care via telecommunications and other technology for the

357584 SECTION 2. AMENDATORY 59 O.S. 2021, Section 328.21, as
358585 amended by Section 3, Chapter 158, O.S.L. 2022 (59 O. S. Supp. 2022,
359586 Section 328.21), is amended to read as follows:

361587 Section 328.21. A. No person shall practice dentistry or
362588 dental hygiene without first applying for and obtaining a license
363589 from the Board of Dentistry.

365617 B. Application shall be made to the Board in writing and shall
366618 be accompanied by the fee established by the rules of the Board,
367619 together with satisfactory proof that the applicant:

369620 1. Is of good moral character;

371621 2. Is twenty-one (21) years of age, or over, at the time of
372622 making application to practice dentistry or eighteen (18) years of
373623 age, or over, if the applicant is to practice dental hygiene;

375624 3. Has passed a written theoretical examination and a clinical
376625 examination approved by the Board within the previous five (5)
377626 years; and

379627 4. Has passed a written jurisprudence examination over the
380628 rules and laws affecting dentistry in this state.

382629 C. An application from a candidate who desires to secure a
383630 license from the Board to practice dentistry or dental hygiene in
384631 this state shall be accompani ed by satisfactory proof that the
385632 applicant:

387633 1. Is a graduate of an accredited dental college, if the
388634 applicant is to practic e dentistry;

390635 2. Is a graduate of an accredited dental hygiene program, if
391636 the applicant is to pract ice dental hygiene; and

393637 3. Has passed all portions of the National Board Dental
394638 Examination or the National Board Dental Hygiene Examination.

407673 a. a fixed prosthetic component of t he preparation of an
408674 anterior all porcelain crown and the preparation of a
409675 three-unit posterior bridge,

411676 b. a periodontal component on a live patient or manikin,

413677 c. an endodontic component,

415678 d. an anterior class III and posterior class II
416679 restorative component on a live patient or manikin,

418680 e. a diagnosis and treatment planning section as approved
419681 by the Board, as specified in Section 328.15 of this
420682 title, and

422683 f. the Board may determine equivalencies based on
423684 components of other exams for the purpose of
424685 credentialing; or

426686 2. For dental hygienists licensing the following components on
427687 a live patient or manikin:

429688 a. clinical patient treatments with an evaluation of
430689 specific clinical skills, and
431-
432690 b. evaluation of the candidate’s compliance with
433691 professional standard s during the treatment as

446725 E. When the applicant and the accompanying proof are found
447726 satisfactory, the Boa rd shall notify the applicant to appear for the
448727 jurisprudence examination at the t ime and place to be fixed by the
449728 Board. A dental stu dent or a dental hygiene student in the
450729 student’s last semester of a dental or dental hygiene program,
451730 having met all other requirements, may make application and take the
452731 jurisprudence examination with a letter from the dean of the dental
453732 school or director of th e hygiene program stating that the applicant
454733 is a candidate for graduation within the next six (6) months.

456734 F. The Board shall require every applicant for a license to
457735 practice dentistry or dental hygiene to submit, for the files of the
458736 Board, a copy of a dental degree or dental hygiene degree, an
459737 official transcript, a recent photograph duly identified and
460738 attested, and any other information as required by the Board.
461-
462739 G. Any applicant who fails to pass the jurisprudence
463740 examination may apply for a second e xamination, in which case the
464741 applicant shall pay a reexamination fee as established by the
465742 statutes or rules of the State Dental Act.

10591684 or indirect supervision of a dentist . The level of supervision,
10601685 whether direct, indirect, or general, for the advanced procedure of
10611686 elder care and public health pursuant to Section 7 of this act shall
10621687 be at the discretion of the supervisory dentist. Authorization for
10631688 general supervision shall be limited to a maximum of thirteen (13)
10641689 months following an examination by the supervisory dentist of a
10651690 patient of record. For the purposes of this paragra ph, “patient of
10661691 record” means an individual who has given a medical history and has
10671692 been examined and accepted by a dentist for dental care.

10691693 C. 1. A dentist may authoriz e procedures to be performed by a
10701694 dental hygienist, without complying with the provis ions of paragraph
10711695 3 of subsection B of this section, if:

11061746 for advanced procedures that may be performed by a dental hygienist
11071747 who has satisfactorily completed a course of study regarding the
11081748 performance of such procedures upon receipt of the advanced
11091749 procedures designated on his or her license. The advance advanced
11101750 procedures shall include the administration of local anesthesia and,
11111751 the administration of nitrous oxide analgesia ;

11711848 C. Upon receipt of the advanced procedure permit, the dental
11721849 hygienist may provide hygiene treatments to a n ew or existing
11731850 patient in a facility listed in subsection A of this section,
11741851 utilizing mobile or other applicable dental equipment. In addition
11751852 to a written record and patient file, the hygienist shall complete a
11761853 visual recording of the patient ’s mouth through video or live
11771854 teledentistry to aid the dentist in completing an evaluation and
11781855 diagnosis of the patient. The video recording shall be maintained
11791856 as part of the patient record.

11831884 D. A dentist shall complete an in-person, live, or recorded
11841885 teledentistry assessment, diagnosi s, and treatment plan for the
11851886 patient taking into consideration the needs, health, and physical
11861887 abilities of the patient a minimum of every thirteen (13) months.

11881888 E. The supervising dentist shall maintain all patient records
11891889 including teledentistry recordi ngs for a period of seven (7) years.

11911890 F. A dental assistant having a minimum of two (2) years of
11921891 active dental assisting practice may apply to the Board for an
11931892 expanded duty permit for elder care and public health. Upon receipt
11941893 of the expanded duty permit , the dental assistant may assist a
11951894 hygienist while providing treatment in a facility listed in
11961895 subsection A of this section under the general supervision of the
11971896 supervising dentist. The patient records shall list the dental
11981897 assistant providing treatment while assisting the dental hygienist.

12001898 SECTION 8. This act shall become e ffective July 1, 2023.

12021899 SECTION 9. It being immediately necessary for the preservation
12031900 of the public peace, health or safety, an emergency is hereby
