72	123		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

74	124		SECTION 1. AMENDATORY 59 O.S. 2021, Section 328.3, is
75	125		amended to read as follows:
76		-
77	126		Section 328.3. As used in the State Dental Act, the follow ing
78	127		words, phrases, or terms, unless the context otherwis e indicates,
79	128		shall have the follo wing meanings:
80		-
81	129		1. “Accredited dental college” means an institution whose
82	130		dental educational pro gram is accredited by the Commission on Dental
83	131		Accreditation of the Am erican Dental Association;

85	132		2. “Accredited dental hygie ne program” means a dental hygiene
86	133		educational program which is accredited by the Commission on Dental
87	134		Accreditation of the America n Dental Association;

91	162		3. “Accredited dental assisting program ” means a dental
92	163		assisting program whi ch is accredited by the Commission on Dental
93	164		Accreditation of the American Dental Association;

95	165		4. “Advanced procedure” means a dental procedure for which a
96	166		dental hygienist has received special training in a course of study
97	167		approved by the Board ;

99	168		5. “Board” means the Board of Dentistry;
100		-
101	169		5. 6. “Certified dental assistant” means a dental assistant who
102	170		has earned and maintains current certified dental assistant
103	171		certification from the Dental Assisting National Board (D ANB);
104		-
105	172		6. 7. “Coronal polishing” means a procedure limited to the
106	173		removal of plaque and stain from exposed tooth surfaces, utilizing a
107	174		slow speed hand piece with a prophy/polishing cup or brush and
108	175		polishing agent and is not prophylaxis. To be considered
109	176		prophylaxis, examination for calculus an d scaling must be done by a
110	177		hygienist or dentist;

112	178		7. 8. “Deep sedation” means a drug-induced depression of
113	179		consciousness during which patients cannot be easily aro used but
114	180		respond purposefully following repeated or painfu l stimulation. The
115	181		ability to independently maintain ventilator fu nction may be
116	182		impaired. Patients may require assistance in maintaining a patent
117	183		airway, and spontaneous ventilation may be inadequ ate.

120	212		8. 9. “Dentistry” means the practice o f dentistry in all of its
121	213		branches;

123	214		9. 10. “Dentist” means a graduate of an accredited dental
124	215		college who has been issued a license by the Board to practice
125	216		dentistry as defined in Section 328.19 of this title;

127	217		10. 11. “Dental ambulatory surgical center (DASC)” means a
128	218		facility that operates exclusively for the pur pose of furnishing
129	219		outpatient surgical services to patients. A DASC shall have the
130	220		same privileges and requirements as a dental office and additionally
131	221		must be an accredited facility by the app ropriate entity;

135	222		11. 12. “Dental office” means an establishme nt owned and
136	223		operated by a dentist for the practice of dentistry, which may be
137	224		composed of reception r ooms, business offices, private offices,
138	225		laboratories, and den tal operating rooms where dental operations are
139	226		performed;

141	227		12. 13. “Dental hygiene” means the science and practice of the
142	228		promotion of oral health and prevention and treatment of oral
143	229		disease through the provision of educational, therapeutic, clinical ,
144	230		and preventive services ;

146	231		14. “Dental hygienist” means an individual who has fulfilled
147	232		the educational requirements and is a graduate of an accredited
148	233		dental hygiene program and who has pa ssed an examination and has
149	234		been issued a license by the Board and who is authorized to practice
150	235		dental hygiene as hereinafter define d;

152	263		13. 15. “Dental assistant or oral maxillofacial surgery
153	264		assistant” “Dental assistant” or “oral maxillofacial surgery
154	265		assistant” means an individual working for a dentist, under the
155	266		dentist’s direct supervision or direct visual supervision, and
156	267		performing duties in the dental office or a treatmen t facility
157	268		including the limited treatment of patients in accordance with the
158	269		provisions of the State Dental Act. A dental assistant or oral
159	270		maxillofacial surgery assistant may a ssist a dentist with the
160	271		patient; provided, this shall be done only under the direct
161	272		supervision or direct visual supervision and control of the dentist
162	273		and only in accordance with the educational requirements and rules
163	274		promulgated by the Board;

165	275		14. 16. “Dental laboratory” means a location, whether in a
166	276		dental office or not, where a dentist or a dental laboratory
167	277		technician performs dental laboratory technology;

169	278		15. 17. “Dental laboratory technician ” means an individual
170	279		whose name is duly filed in the off icial records of the Board, which
171	280		authorizes the technician, upon the laborat ory prescription of a
172	281		dentist, to perform dental laboratory technology, which services
173	282		must be rendered only to the prescribing dentist and not to t he
174	283		public;

178	284		16. 18. “Dental laboratory technology” means using materials
179	285		and mechanical devices for the cons truction, reproduction or repair

183	315		17. 19. “Dental specialty” means a specialized practice of a
184	316		branch of dentistry, recogni zed by the Board, where the dental
185	317		college and specialty program are accredited by the Commission on
186	318		Dental Accreditation (CODA), or a dental specialty recognized by the
187	319		Board, requiring a minimum num ber of hours of approved education and
188	320		training and/or recognition by a nationally recognized association
189	321		or accreditation board;
190		-
191	322		18. 20. “Direct supervision” means the supervisory dentist is
192	323		in the dental office or treatment facility and, during the
193	324		appointment, personally examines the patient, diagnoses any
194	325		conditions to be treated, and authorizes the procedu res to be
195	326		performed by a dental hygienist, dental assistant, or oral
196	327		maxillofacial surgery assistant. The supervising dentist is
197	328		continuously on-site and physically present in the dental office or
198	329		treatment facility while the procedures are being performe d and,
199	330		before dismissal of the patient, evaluates the results of the dental
200	331		treatment;

202	332		19. 21. “Direct visual supervision ” means the supervisory
203	333		dentist has direct ongoing visual oversight which shall be
204	334		maintained at all times during any procedure author ized to be
205	335		performed by a dental assistant or an oral maxillofacial surgery

208	364		20. 22. “Expanded duty” means a dental procedure for which a
209	365		dental assistant has received special training in a course of study
210	366		approved by the Board ;

212	367		23. “Fellowship” means a program designed for post-residency
213	368		graduates to gain knowledge and experience in a specialized field;

215	369		21. 24. “General anesthesia” means a drug-induced loss of
216	370		consciousness during which patients a re not arousable, even b y
217	371		painful stimulation. The ability to independently maintain
218	372		ventilator function is often impaired. Patients often require
219	373		assistance in maintaining a patent airway, and positive pressure

222	374		ventilation may be required because of dep ressed spontaneous
223	375		ventilation or drug-induced depression of neuromuscular function.
224	376		Cardiovascular function may be impaired;

226	377		22. 25. “General supervision” means the supervisory dentist has
227	378		diagnosed any conditions to be tre ated within the past thirteen ( 13)
228	379		months, has personally authorized the procedures to be performed by
229	380		a dental hygienist, and will evaluate the results of the dental
230	381		treatment within a reasonab le time as determined by the na ture of
231	382		the procedures performed, the needs of the patient, an d the
232	383		professional judgment of the supervisory dentist. General
233	384		supervision may only be used to supervise a hygienist and may not be
234	385		used to supervise an oral max illofacial surgery assistant or dental
235	386		assistant except as provided by Section 7 of this act;

237	414		23. 26. “Indirect supervision ” means the supervisory dentist is
238	415		in the dental office or treatment facility and has personally
239	416		diagnosed any conditions to be treated, authorizes the procedures to
240	417		be performed by a dental hygienist, remains in the dental o ffice or
241	418		treatment facility while the procedur es are being performed, and
242	419		will evaluate the results of the dental treatment within a
243	420		reasonable time as determined by the nature of the procedures
244	421		performed, the needs of the patient, and the professional jud gment
245	422		of the supervisory dentist. Indirect su pervision may not be used
246	423		for an oral maxillofacial surgery assistant or a dental assistant;
247		-
248	424		24. 27. “Investigations” means an investigation procee ding,
249	425		authorized under Sections 328.15A and 328.43a of this ti tle, to
250	426		investigate alleged violations of the State Dental Act or the rules
251	427		of the Board;
252		-
253	428		25. 28. “Laboratory prescription” means a written description,
254	429		dated and signed by a dentist, of dental laboratory technology to be
255	430		performed by a dental laboratory technician;
256		-
257	431		26. 29. “Minimal sedation” means a minimally depressed level of
258	432		consciousness, produced by a pharmacological method, that retains
259	433		the patient’s ability to independently and continuou sly maintain an
260	434		airway and respond normally to tactile stimul ation and verbal
261	435		command. Although cognitive function and coordination may be
262	436		modestly impaired, ventilator and cardiovascular functions are
263	437		unaffected;

267	465		27. 30. “Mobile dental anesthesia provid er” means a licensed
268	466		and anesthesia-permitted dentist, physi cian or certified registered
269	467		nurse anesthetist Certified Registered Nurse Anesthetist (CRNA) that
270	468		has a mobile dental unit and prov ides anesthesia in dental offices
271	469		and facilities in the state;

273	470		28. 31. “Mobile dental clinic” means a permitted motor vehicle
274	471		or trailer utilized as a dental clini c, and/or that contains dental
275	472		equipment and is used to provide dental s ervices to patients on-site
276	473		and shall not include a mobile dental anesthesia provider. A mobile
277	474		dental clinic shall also mean and include a volunteer mobile dental
278	475		facility that is directly affiliated with a church or religious
279	476		organization as defined by Section 501(c)(3) or 501(d) of the United
280	477		States Internal Revenue Code, the church or religious org anization
281	478		with which it is affiliated is clearly indicated on the exterior of
282	479		the mobile dental facility, and such facility does not receive any
283	480		form of payment either directly or indirectly for work provided to
284	481		patients other than donations through the af filiated church or
285	482		religious organization; provided, that the volunteer mobile dental
286	483		facility shall be exempt from any registration fee required under
287	484		the State Dental Act;

289	485		29. 32. “Moderate sedation” means a drug-induced depression of
290	486		consciousness during which patients respond purposefully to verbal
291	487		commands, either alone or accompanied by light tactile stimulation.

300	522		root surfaces of human teeth including rotary or power-driven
301	523		instruments. This procedure may only be performed by a dentist or
302	524		dental hygienist;

304	525		31. 34. “Patient” or “patient of record” means an individual
305	526		who has given a medical history and has been examin ed and accepted
306	527		by a dentist for dental care;

311	529		clinical and didactic training in general dentistry or other
312	530		specialties or other specialists at the post-doctoral level
313	531		recognized by the Commission on De ntal Accreditation (CODA) or the

316	533		33. 36. “Supervision” means direct supervision, direct visual
317	534		supervision, indirect supervision or general supervision;

319	535		34. 37. “Teledentistry” means the remote delivery of dental
320	536		patient care via telecommunications and other technology for the
321	537		exchange of clinical information and i mages for dental consultation,
322	538		preliminary treatment planning and patient monitoring; and

357	584		SECTION 2. AMENDATORY 59 O.S. 2021, Section 328.21, as
358	585		amended by Section 3, Chapter 158, O.S.L. 2022 (59 O. S. Supp. 2022,
359	586		Section 328.21), is amended to read as follows:
360		-
361	587		Section 328.21. A. No person shall practice dentistry or
362	588		dental hygiene without first applying for and obtaining a license
363	589		from the Board of Dentistry.

365	617		B. Application shall be made to the Board in writing and shall
366	618		be accompanied by the fee established by the rules of the Board,
367	619		together with satisfactory proof that the applicant:

369	620		1. Is of good moral character;

371	621		2. Is twenty-one (21) years of age, or over, at the time of
372	622		making application to practice dentistry or eighteen (18) years of
373	623		age, or over, if the applicant is to practice dental hygiene;

375	624		3. Has passed a written theoretical examination and a clinical
376	625		examination approved by the Board within the previous five (5)
377	626		years; and
378		-
379	627		4. Has passed a written jurisprudence examination over the
380	628		rules and laws affecting dentistry in this state.

382	629		C. An application from a candidate who desires to secure a
383	630		license from the Board to practice dentistry or dental hygiene in
384	631		this state shall be accompani ed by satisfactory proof that the
385	632		applicant:
386		-
387	633		1. Is a graduate of an accredited dental college, if the
388	634		applicant is to practic e dentistry;
389		-
390	635		2. Is a graduate of an accredited dental hygiene program, if
391	636		the applicant is to pract ice dental hygiene; and
392		-
393	637		3. Has passed all portions of the National Board Dental
394	638		Examination or the National Board Dental Hygiene Examination.

398	639		D. Pursuant to Section 328.15 of this title, the Board may
399	640		affiliate as a member state, and accept regional ex ams from the

449	728		Board. A dental stu dent or a dental hygiene student in the
450	729		student’s last semester of a dental or dental hygiene program,
451	730		having met all other requirements, may make application and take the
452	731		jurisprudence examination with a letter from the dean of the dental
453	732		school or director of th e hygiene program stating that the applicant
454	733		is a candidate for graduation within the next six (6) months.

456	734		F. The Board shall require every applicant for a license to
457	735		practice dentistry or dental hygiene to submit, for the files of the
458	736		Board, a copy of a dental degree or dental hygiene degree, an
459	737		official transcript, a recent photograph duly identified and
460	738		attested, and any other information as required by the Board.

462	739		G. Any applicant who fails to pass the jurisprudence
463	740		examination may apply for a second e xamination, in which case the
464	741		applicant shall pay a reexamination fee as established by the
465	742		statutes or rules of the State Dental Act.

552	884		man-made disaster, the Board shall have the authority through a
553	885		resolution to change or ma ke allowances in requirements of all
554	886		candidates for licensure and issue temporary lic enses for extended
555	887		periods of time or as needed until the event passes. The r esolution
556	888		shall have a beginning and an end date and shall automatically
557	889		expire no less than thirty (30) days after the end of the disaster
558	890		is declared by governmental officials.

648	1033		Commission on Recognition of Dental Special ties and Certifying

1046	1647		2. The procedures specified in subparagra phs b through o of
1047	1648		paragraph 1 of this subsection may be performed only by a dentist or

1061	1686		elder care and public health pursuant to Section 7 of this act shall
1062	1687		be at the discretion of the supervisory dentist. Authorization for
1063	1688		general supervision shall be limited to a maximum of thirteen (13)
1064	1689		months following an examination by the supervisory dentist of a
1065	1690		patient of record. For the purposes of this paragra ph, “patient of
1066	1691		record” means an individual who has given a medical history and has
1067	1692		been examined and accepted by a dentist for dental care.

1069	1693		C. 1. A dentist may authoriz e procedures to be performed by a
1070	1694		dental hygienist, without complying with the provis ions of paragraph
1071	1695		3 of subsection B of this section, if:
1072		-
1073	1696		a. the dental hygienist has at least two (2) years years’
1074	1697		experience in the practice of dental hygiene,
1075		-
1076	1698		b. the authorization to perform the procedures is in
1077	1699		writing and signed by the dentist, and
1078		-
1079	1700		c. the procedures are performed during an initia l visit
1080	1701		to a person in a treatment facility, or pursuant to
1081	1702		Section 7 of this act.

1083	1703		2. The person upon whom the procedures are performed must be
1084	1704		referred to a dentist af ter completion of the procedures performed
1085	1705		pursuant to paragraph 1 of this subsection.

1101	1743		teaching of dental hygiene or as otherwise authorize d by the Board.

1103	1744		E. The Board is authorized to :
1104		-
1105	1745		1. Prescribe prescribe, by rule, the educational requirements
1106	1746		for advanced procedures that may be performed by a dental hygienist
1107	1747		who has satisfactorily completed a course of study regarding the
1108	1748		performance of such procedures upon receipt of the advanced
1109	1749		procedures designated on his or her license. The advance advanced
1110	1750		procedures shall include the administration of local anesthesia and,
1111	1751		the administration of nitrous oxide analgesia ;
1112		-
1113	1752		2. Establish guidelines for courses of study necessary for a
1114	1753		dental hygienist to perform advanced procedures;
1115		-
1116	1754		3. Issue authorization to perform advanced procedures to those
1117	1755		dental hygienists who meet the eligibility requirements; and

1169	1847		advanced procedure permit for elder care and public health.

1171	1848		C. Upon receipt of the advanced procedure permit, the dental
1172	1849		hygienist may provide hygiene treatments to a n ew or existing
1173	1850		patient in a facility listed in subsection A of this section,
1174	1851		utilizing mobile or other applicable dental equipment. In addition
1175	1852		to a written record and patient file, the hygienist shall complete a
1176	1853		visual recording of the patient ’s mouth through video or live
1177	1854		teledentistry to aid the dentist in completing an evaluation and
1178	1855		diagnosis of the patient. The video recording shall be maintained
1179	1856		as part of the patient record.

1188	1888		E. The supervising dentist shall maintain all patient records
1189	1889		including teledentistry recordi ngs for a period of seven (7) years.

1191	1890		F. A dental assistant having a minimum of two (2) years of
1192	1891		active dental assisting practice may apply to the Board for an
1193	1892		expanded duty permit for elder care and public health. Upon receipt
1194	1893		of the expanded duty permit , the dental assistant may assist a
1195	1894		hygienist while providing treatment in a facility listed in
1196	1895		subsection A of this section under the general supervision of the
1197	1896		supervising dentist. The patient records shall list the dental
1198	1897		assistant providing treatment while assisting the dental hygienist.

1200	1898		SECTION 8. This act shall become e ffective July 1, 2023.

1202	1899		SECTION 9. It being immediately necessary for the preservation
1203	1900		of the public peace, health or safety, an emergency is hereby
1204	1901		declared to exist, by reason whereof this act shall take effect and
1205	1902		be in full force from a nd after its passage and approval.
