59-SECTION 1. NEW LAW A n ew section of law to be codified
60-in the Oklahoma Statutes as Sectio n 1698.406 of Title 69, unless
61-there is created a duplicatio n in numbering, reads as follows:
62-The interchange of Interstate 35 and State Highway 51 in Payne
63-County shall be designated as “The Honorable Secretary Gary M.
64-Ridley Memorial Interchange ”. The Department of Transportation
65-shall cause suitable markers bearing that nam e to be placed on the
66-interchange.

93-SECTION 2. This act shall become effecti ve November 1, 2023.
147+SECTION 1. NEW LAW A new section of law to be codified
148+in the Oklahoma Statutes as Section 6971 of Title 36, unless there
149+is created a duplication in nu mbering, reads as follows:
150+As used in this act:
151+1. “Brand-name drug” means a prescription drug approved under
152+21 U.S. Code Section 355(b), as amended, or 42 U.S. Code Section
153+262, as amended;
154+2. “Drug group” means a group of medications that work
155+similarly, have a similar che mical makeup, or treat similar
156+conditions;
157+3. “Insurer” means any entity authorized to provide hea lth
158+insurance or health benefits pursuant to the laws o f this state and
159+any entity or person engaged in the business of making contract s for
160+accident or health insurance;
161+4. “Manufacturer” means any person or entity that holds the
162+national drug code for a prescription drug and is either engaged in
163+the production, preparation, propagation, compounding, conversion,
164+or processing of dru g products in this state ;
165+5. “Market introduction” means the month and year in which the
166+manufacturer acquired or first marketed the drug for sale in the
167+United States;
168+6. “National drug code” means the numerical code maintained by
169+the Food and Drug Administration that include s the labeler code,
170+product code, and package code;

222+7. “Pharmacy benefits manager” or “PBM” means a pharmacy
223+benefits manager as defined p ursuant to Section 6960 of Title 36 of
224+the Oklahoma Statues;
225+8. “Reporting entity” means any manufacturer, insurer, pharmacy
226+benefits manager, wholesale drug distributor , or any other entity
227+required to report to the Insurance Department under the provisions
228+of this act;
229+9. “Wholesale acquisition cost” means the list price of the
230+manufacturer charged to wholesalers or direct purchases in the
231+United States on December 31 of the reference year, as reported i n
232+the wholesale price guides or other publications of drug or
233+biological pricing data. This shall not include pr ompt pay or other
234+discounts, rebates, or reductions in price . The current or proposed
235+wholesale acquisition cost is the amount that requires reporting
236+under the provisions of this act;
237+10. “Wholesale acquisition cost unit” or “WAC unit” means the
238+lowest identifiable quantity of a drug or biological that is
239+dispensed, exclusive of any diluent without reference to volume
240+measures pertaining to liquids. I f reporting by drug group, it is
241+the total number of wholesa le acquisition cost units in the drug
242+group; and
243+11. “Wholesale drug distri butor” means a person or entity
244+engaging in the sale of presc ription drugs to persons o ther than a
245+consumer or patient and l icensed by the State Board of Pharmacy.

300+Any pharmacy benefits manager (PBM) that operates in t his state
301+shall, within sixty (60) days of receiving notice by the Insurance
302+Department pursuant to Section 3 of this act, and to the extent
303+allowed by law, report annuall y to the Department, indicating the
304+specific drugs for which reporting is requir ed, the following
305+information:
306+1. The minimum and maximum wholesale acquisition cost (WAC) for
307+each indicated drug and drug group for which the PBM has negotiated
308+directly with the manufacturer in the immediately p receding calendar
309+year;
310+2. The minimum and m aximum WAC for each indicated drug and drug
311+group for which the PBM has negotiated directly with the
312+manufacturer in the current calendar year;
313+3. The number of WAC unit s for which the PBM negotiated
314+directly with the manufacturer in the immediately prec eding calendar
315+year, for business in this state, in total and for e ach payer type
316+as deemed necessary by the Department;
317+4. The projected number of WAC units for which th e PBM expects
318+to negotiate directly with the manufacturer in the current calendar
319+year, for business in this state, in total and for each payer type
320+as deemed necessary by the Department;

380+Department;
381+7. Total discounts, dispensing fees, and other fees paid o r
382+allowed to pharmacies, prescription dru g networks, or pharmacy
383+services administrat ive organizations in the immediately preceding
384+calendar year, for b usiness in this state, in total and for each
385+payer type as deemed necessary by the Department;
386+8. Projected total discounts, dispensing fees, an d other fees
387+that the PBM expects to pay or allow to pharmacies, prescription
388+drug networks, or pharmacy servic es administrative organizations in
389+the current calendar year, for business in this state, in total and
390+for each payer type as deemed necessary by the Department;
391+9. Total net income receiv ed in the immediately preceding
392+calendar year for business in this state, in total and for each
393+payer type as deemed necessary by the Department;

445+10. Projected net incom e that the PBM expects to receive in the
446+current calendar year for business in this s tate, in total and for
447+each payer type as deemed necessary by the D epartment; and
448+11. Any other information as prescribed by the Department.
449+SECTION 3. NEW LAW A new sec tion of law to be codified
450+in the Oklahoma Statutes as Secti on 6973 of Title 36, unless there
451+is created a duplication in numb ering, reads as follows:
452+A. 1. A manufacturer shall notify the Insurance Department if
453+it is increasing the wholesale acquisition cost of a brand-name drug
454+by more than twenty percent (20%) per wholesale acqu isition cost
455+unit (WAC unit) during any twelve -month period, or if it is
456+increasing the wholesale acquisition cost of a generic drug priced
457+at Ten Dollars ($10.00) or more per WAC unit by more than twenty
458+percent (20%) during any twelve month period. The notice shall be
459+provided, in writing, at least sixty (60) days prior to the planned
460+effective date of the increase.
461+2. A manufacturer that is required to notify the Department
462+under this subsection shall report to the Department , at least
463+thirty (30) days before the planned effective date of the increase,
464+the following:
465+a. drug identification details, including the drug group,
466+b. four (4) year sales history in WAC units for sales in
467+this state and in the United States,
468+c. the wholesale acquisition cost of the drug,

522+e. cost associated with sales in the United States by
523+drug and drug group.
524+B. 1. A manufacturer shall notify the Department if it intends
525+to introduce a new drug in the United States that has a wholesa le
526+acquisition cost of more than Six Hundred Seventy Dollars ($670.00)
527+per WAC unit. The notice shall be p rovided, in writing, at least
528+sixty (60) days prior to market introduction.
529+2. A manufacturer that is required to notify the Department
530+under this subsection shall report to the Department , at least
531+thirty (30) days before the planned effective date of the increase,
532+the following:
533+a. drug identification details, including the drug group,
534+b. patient volume, revenue, and price, and
535+c. wholesale acquisition cost at introduction.
536+SECTION 4. NEW LAW A new section of law to be codified
537+in the Oklahoma Statutes as Section 6974 of Title 36, unless there
538+is created a duplication in numb ering, reads as follows:
539+Any wholesale drug distributor operating in this sta te shall
540+report annually to the Insurance Department, within sixty (60) days
541+after receiving notice from the Department indicating the specific
542+drugs for which reporting is re quired, the following information:

604+3. The number of WAC units for which the distributor negotiated
605+directly with the manufacturer in the immedi ately preceding calendar
606+year, for business in this state , in total and for each pa yer type
607+as deemed necessary by the Department;
608+4. The projected number of WAC units for which the distributor
609+expects to negotiate directly with the manufacturer in the current
610+calendar year, for business in this state, in total and for each
611+payer type as deemed necessary b y the Department;
612+5. Total rebates, discounts, and price c oncessions received o r
613+negotiated directly with the manufacturer in the immediately
614+preceding calendar year, for business in this state, in total and
615+for each payer type as de emed necessary by the Department;
616+6. Projected total rebates, discounts, and pri ce concessions
617+that the distributor expects to receive or to negotiate directly

677+8. Projected total di scounts, dispensing fees, and other fees
678+that the PBM expects to pay or allow to pharmacies, prescription
679+drug networks, or pharmacy services administrative organizations in
680+the current calendar year, for bus iness in this state, i n total and
681+for each payer type as deemed necessary by the Department;
682+9. Total net income received in the immediately preceding
683+calendar year for busines s in this state, in total and for e ach
684+payer type as deemed necessary by the De partment;
685+10. Projected net income that the distributor expects to
686+receive in the current c alendar year for business in this state, in
687+total and for each payer type as deemed necessary by the Department;
688+and
689+11. Any other information as prescribed by th e Department.

744+A. Each insurer designat ed by the Insurance Department as a
745+reporting entity shall report annually to the Department, to the
746+extent allowed by law, spending on prescription drugs before
747+enrollee cost sharing, in tota l and per prescription drug user, and
748+spending on the top twenty-five (25) prescription drugs prescribed
749+in this state, in total and individually, as determined by the
750+Insurance Department. The repor t shall include:
751+1. The greatest total spending before enrollee cost sharing in
752+the immediately preceding calendar year;
753+2. The greatest total spending per user of any drug before
754+enrollee cost sharing in the immediately preceding calendar year;
755+3. The highest year-over-year increase in total spending before
756+enrollee cost sharing; and
757+4. The highest year-over-year increase in total spend ing per
758+user of any drug before enrollee cost sharing.
759+B. For each drug and drug group, the insurer shall report to
760+the Department, within sixty (60) days of the close of ea ch calendar
761+year, the following information:
762+1. For drugs that accounted for the highest total spending
763+before enrollee cost sharing in the last calendar year:
764+a. total spending before enrollee cost sharing in the
765+immediately preceding calendar year,
766+b. projected total spending before enrollee cost sharing
767+in the current calendar year,

973+C. Disclosure of all information repo rted under this section is
974+subject to the protections described in Section 6 of this act.
975+SECTION 6. NEW LAW A new s ection of law to be codified
976+in the Oklahoma Statutes as Section 6976 of Title 36, unless there
977+is created a duplication in numbering, reads as foll ows:
978+A. Beginning on January 1, 2024, each reporti ng entity shall
979+register with the Insurance De partment no later th an January 31 of
980+each calendar year, in a form and manner specifi ed by the
981+Department.
982+B. 1. Each reporting entity shall pay an annual a ssessment, in
983+an amount to be determined by the Department but not to be less than
984+One Hundred Dollars ($100.00) for each individual entity required to
985+pay an assessment under this act, to support the operational costs
986+of the Department in implementing the provisions of this act. The
987+costs shall include staff salaries, administrative expe nses, data
988+system expenses, and consulting fees of the De partment. The total
989+annual assessments shall be based on the total annual allocation
990+authorized by the Legislature for the operational costs of the
991+Department under this act, as indicated in t he fiscal year budget of

1043+the Department. The amount to be assessed shall be reduced by the
1044+difference between the total annual authorized allocation for the
1045+next fiscal year and the beginning fund balance in the Department’s
1046+account for the prior fiscal year. Any assessment reduction s hall
1047+be applied proportiona tely to the categorical groups assesse d.
1048+2. The assessments shall be p laced in State Insurance
1049+Commissioner Revolving Fund pursuant to Section 307.3 of Title 36 of
1050+the Oklahoma Statutes.
1051+C. The Department shall send request for payment of the
1052+assessment to all reporting entities under this act by certified

1054+assessments shall be due to the Department within thirty (30) days
1055+of receipt of the request for payment. Any reporting entity that
1056+fails to pay the assessment pursuant to th is act shall be subject to
1057+the penalties described under Section 7 of this act.
1058+SECTION 7. NEW LAW A new section of law to be codified
1059+in the Oklahoma Statutes as Section 6977 of Title 36, unless there
1060+is created a duplication in numb ering, reads as follows:
1061+A. The reporting entity sha ll certify required reporting under
1062+this act as accurate under penalty of perjury.
1063+B. Failure of a reporting entity to comply with the provisions
1064+of this act may result in a civil penalty, at the discr etion of the
1065+Insurance Commissioner. Civil penalties under this act shall not
1066+exceed Thirty Thousand Dollars ($30,000.00) per day that the

1119+this act.
1120+C. The Insurance Department may audit the data submitted to the
1121+Department by a reporting ent ity pursuant to the provisions of th is
1122+act, in a form and manner to be specifi ed by the Department. The
1123+reporting entity shall pay all costs associated with the audit .
1124+D. The Department may require a reporting entity to subm it a
1125+corrective action plan, i n a form and manner to be specified by the
1126+Department, to correct deficiencies in reporting pursuant to the
1127+provisions of this act.
1128+E. The Department is au thorized to call one or more public
1129+hearings on the price of prescription drugs in this state and may
1130+subpoena any reporting entity pursuant to the provisions of this
1131+act.
1132+SECTION 8. NEW LAW A new section of law to be codified
1133+in the Oklahoma Statutes as Section 6978 of Title 36, unless there
1134+is created a duplication in numb ering, reads as follows:
1135+A. Not later than July 1, 2024, the Insurance Department shall
1136+develop and publish on its websi te a report on emerging trends in
1137+prescription drug prices in this state and conduct an annual public
1138+hearing based on the report findings. To make clear the main
1139+components of prescription drug pricing along the supply chain, the
1140+report shall include, bu t not be limited to, ana lyses of
1141+manufacturer prices and price increases as reported under th is act,

1194+managers, and wholesale drug distributors, and the impacts on
1195+insurance premiums and consumer cost sharing. The data in the
1196+report shall not reveal information specific to any individual
1197+reporting entity.
1198+B. Except as provided in this section, the Department shall
1199+keep confidential all information submitted by an individual
1200+reporting entity and protect it from public disclosure. The
1201+Department may share such information with the Attorney General;
1202+provided, however that the Attorney General shall keep confidential
1203+any information shared by the Insurance Depa rtment. The information
1204+shall not be considered a record under the Oklahoma Open Records Act
1205+as defined pursuant to Section 24A.3 of Title 51 o f the Oklahoma
1206+Statutes.
1207+C. The Insurance Department shall promulgate rules to
1208+effectuate the provisions of this act.
1209+SECTION 9. AMENDATORY 51 O.S. 2021, Section 24A.3, as
1210+amended by Section 1, Chapter 402, O.S.L. 2022 (51 O.S. Supp. 2022,
1211+Section 24A.3), is amend ed to read as follows:
1212+Section 24A.3. As used in the Oklahoma Open Records Act:
1213+1. “Record” means all documents including, but not limited to,
1214+any book, paper, photograph, microfilm, data files created by or

1426+2. “Public body” shall include, but not be limited to, any
1427+office, department, board, bureau, commission, agency, trusteeship,
1428+authority, council, committee, trust or any entity created by a
1429+trust, county, city, village, town, township, d istrict, school
1430+district, fair board, court, executive office, advisory group, task
1431+force, study group or any subdivision thereof, s upported in whole or
1432+in part by public fund s or entrusted with the expenditure of public
1433+funds or administering or operating public property, and all
1434+committees, or subcommittees thereof. Except for the records
1435+required by Section 24A.4 of this title, “public body” public body
1436+does not mean judges , justices, the Council on Judicia l Complaints,
1437+the Legislature or legislators. “Public body” Public body shall not
1438+include an organization that is exempt from federal income tax under

1493+The Oklahoma State Sys tem of Higher Education . Such organization
1494+shall not receive di rect appropriations from the Oklahoma
1495+Legislature. The following persons shall not b e eligible to serve
1496+as a voting member of the governing bo ard of the organization:
1497+a. a member, officer, or employee of the Oklahoma State
1498+Regents for Higher Education ,
1499+b. a member of the board of regents or other governing
1500+board of the college or university th at is the sole
1501+beneficiary of the organization, or
1502+c. an officer or employee of the college or university
1503+that is the sole beneficiary of the organizati on;
1504+3. “Public office” means the physical lo cation where public
1505+bodies conduct business or keep record s;
