77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law not to be
79	79	codified in the Oklahoma Statu tes reads as follows:
80	80	This act shall be known and m ay be cited as the “Safety Training
81	81	for Employees Performing Construction Work with Governmental
82	82	Entities”.
83	83	SECTION 2. NEW LAW A new section of law to be codified
84	84	in the Oklahoma Statutes as Section 401 of Title 61, unless there is
85	85	created a duplication in numbering, reads as follows:
86	86	A. For the purposes of this section:
87	87	1. “Construction contract” means a contract or agreement for
88	88	the performance of general constru ction for a governmental entity;

140	140	2. “Construction safety training ” means a construction and
141	141	general industry safety training class approved by the fede ral
142	142	Occupational Safety and Health Administration that is at least ten
143	143	(10) hours in duration;
144	144	3. “Contractor” means a person, firm, or corporation
145	145	contracting with a gove rnmental entity for general construction;
146	146	4. “Employee” means an individual paid by a contractor or
147	147	subcontractor to perform genera l construction work or services;
148	148	5. “General construction ” means:
149	149	a. erecting or preparing to erect a structure, including
150	150	a building, bridge, roadway, public utility facility,
151	151	or related structure,
152	152	b. remodeling, extending, repairing, or demolishing a
153	153	structure, or
154	154	c. otherwise improving real property or a str ucture
155	155	related to real property;
156	156	6. “Governmental entity” means this state, or a political
157	157	subdivision of this state, including a municipality, county, public
158	158	school district, or authority;
159	159	7. “On site” means the locations where individuals are working
160	160	or involved in the act of working; and
161	161	8. “Subcontractor” means a person, firm, or corporation
162	162	contracting with a contractor for general c onstruction.

214	214	B. To the extent consistent with federal law, a governmental
215	215	entity that enters into a construction contract shall require that
216	216	the contractor ensure that all employees wo rking on site of the
217	217	general construction site that is the subject of the construction
218	218	contract have completed construction safety training. Before an
219	219	employee works on the general construction site, the contractor
220	220	shall receive and provide to the governm ental entity a certificate
221	221	of training completion fo r the employee.
222	222	C. A governmental entity that enters into a construction
223	223	contract shall include in the contract notice and penalty provisions
224	224	that:
225	225	1. Require the governmental entity to provide the cont ractor
226	226	with written notice, hand delivered or by cer tified mail, of a
227	227	violation of subsection B of this section by the contractor;
228	228	2. Require the contractor to comply with subsection B of this
229	229	section by the twentieth business day after the date the contr actor
230	230	receives any notice of noncompliance with that subsecti on;
231	231	3. Inform a contractor t hat the governmental entity may impose
232	232	an administrative penalty if the contractor fails to comply with
233	233	subsection B of this section after the twentieth business day after
234	234	the date the contractor receives any notice of noncompliance wit h
235	235	that subsection; and
236	236	4. Explain that a penalty amount may be withheld from a payment
237	237	otherwise owed to the contractor under the cons truction contract.

289	289	D. The amount of a penalty impo sed under paragraph 3 of
290	290	subsection C of this section is One Hundred Dollars ($100.00) per
291	291	day for each employee working in noncompliance.
292	292	E. Each governmental entity shall develop procedures for the
293	293	administration of this section.
294	294	SECTION 3. This act shall become effective November 1, 2023.
