7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law not to be
7979 codified in the Oklahoma Statu tes reads as follows:
8080 This act shall be known and m ay be cited as the “Safety Training
8181 for Employees Performing Construction Work with Governmental
8282 Entities”.
8383 SECTION 2. NEW LAW A new section of law to be codified
8484 in the Oklahoma Statutes as Section 401 of Title 61, unless there is
8585 created a duplication in numbering, reads as follows:
8686 A. For the purposes of this section:
8787 1. “Construction contract” means a contract or agreement for
8888 the performance of general constru ction for a governmental entity;

140140 2. “Construction safety training ” means a construction and
141141 general industry safety training class approved by the fede ral
142142 Occupational Safety and Health Administration that is at least ten
143143 (10) hours in duration;
144144 3. “Contractor” means a person, firm, or corporation
145145 contracting with a gove rnmental entity for general construction;
146146 4. “Employee” means an individual paid by a contractor or
147147 subcontractor to perform genera l construction work or services;
148148 5. “General construction ” means:
149149 a. erecting or preparing to erect a structure, including
150150 a building, bridge, roadway, public utility facility,
151151 or related structure,
152152 b. remodeling, extending, repairing, or demolishing a
153153 structure, or
154154 c. otherwise improving real property or a str ucture
155155 related to real property;
156156 6. “Governmental entity” means this state, or a political
157157 subdivision of this state, including a municipality, county, public
158158 school district, or authority;
159159 7. “On site” means the locations where individuals are working
160160 or involved in the act of working; and
161161 8. “Subcontractor” means a person, firm, or corporation
162162 contracting with a contractor for general c onstruction.

214214 B. To the extent consistent with federal law, a governmental
215215 entity that enters into a construction contract shall require that
216216 the contractor ensure that all employees wo rking on site of the
217217 general construction site that is the subject of the construction
218218 contract have completed construction safety training. Before an
219219 employee works on the general construction site, the contractor
220220 shall receive and provide to the governm ental entity a certificate
221221 of training completion fo r the employee.
222222 C. A governmental entity that enters into a construction
223223 contract shall include in the contract notice and penalty provisions
224224 that:
225225 1. Require the governmental entity to provide the cont ractor
226226 with written notice, hand delivered or by cer tified mail, of a
227227 violation of subsection B of this section by the contractor;
228228 2. Require the contractor to comply with subsection B of this
229229 section by the twentieth business day after the date the contr actor
230230 receives any notice of noncompliance with that subsecti on;
231231 3. Inform a contractor t hat the governmental entity may impose
232232 an administrative penalty if the contractor fails to comply with
233233 subsection B of this section after the twentieth business day after
234234 the date the contractor receives any notice of noncompliance wit h
235235 that subsection; and
236236 4. Explain that a penalty amount may be withheld from a payment
237237 otherwise owed to the contractor under the cons truction contract.

289289 D. The amount of a penalty impo sed under paragraph 3 of
290290 subsection C of this section is One Hundred Dollars ($100.00) per
291291 day for each employee working in noncompliance.
292292 E. Each governmental entity shall develop procedures for the
293293 administration of this section.
294294 SECTION 3. This act shall become effective November 1, 2023.
