161161 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
162162 SECTION 1. NEW LAW A new section of law to be codified
163163 in the Oklahoma Statutes as Section 3-146 of Title 70, unless there
164164 is created a duplication in numb ering, reads as follows:
165165 A. This act shall be known and may be cited as the
166166 “Professional Teacher Charter Act ”.
167167 B. The purpose of the Professional Teacher Charter Act is to
168168 provide for the establishment of professional teacher charter
169169 schools to:
170170 1. Improve student learning;
171171 2. Increase learning opportunities for students;
172172 3. Allow experienced public school teachers t o establish
173173 themselves as independent education practitioners;
174174 4. Encourage the use of d ifferent and innovative teaching
175175 methods;
176176 5. Provide additional academic choices for parents and
177177 students;
178178 6. Increase parental knowledge and control of student

234234 C. For the purposes of this act:
235235 1. “Certified teacher” means a teacher who has been issued a
236236 certificate by the State Board of Education in accordance with the
237237 Oklahoma Teacher Preparation Act and rules of the Board;
238238 2. “Charter school” means a public school establi shed by
239239 contract pursuant to this act to provide learning that will improve
240240 student achievement and as define d in the Elementary and Secondary
241241 Education Act of 1965, (ESEA) as reauthorized by P.L. N o. 114-95,
242242 also known as the Every Student Succeeds Act ; and
243243 3. “Parent” means the natural or adoptive parent or legal
244244 guardian of a minor child.
245245 SECTION 2. NEW LAW A new section o f law to be codified
246246 in the Oklahoma Statutes a s Section 3-146.1 of Title 70, unless
247247 there is created a duplication in numbering, reads as follows:
248248 A. A certified teacher who has five (5) years of teaching
249249 experience or a consortium of certified teachers who each have five
250250 (5) years of teaching experi ence may sponsor a professional teacher
251251 charter school pursuant to the provisions of t his act.
252252 B. A certified teacher or consortium of certified teachers
253253 shall file with the State Board of Education a surety bond or letter
254254 of credit in an amount equal to Two Thousand Dollars ($2,000.00) per

307307 school. The surety bond or letter of credit amount may be adjusted
308308 based on actual enrollment of students in the professional teacher
309309 charter school as of August 1. In no case shall the amount of
310310 surety bond or letter of credit be less than Twenty -five Thousand
311311 Dollars ($25,000.00).
312312 C. A charter school established pursuant to the Oklahoma
313313 Charter Schools Act m ay convert to a professional teacher charter
314314 school subject to the provisions of this act.
315315 SECTION 3. NEW LAW A new section of law to be codified
316316 in the Oklahoma Statutes as Section 3-146.2 of Title 70, unless
317317 there is created a dup lication in numbering, reads as follows:
318318 A. A certified teacher or consortium of certified teachers
319319 seeking to establish a professional teacher c harter school pursuant
320320 to this act shall submit a written application to the State Board of
321321 Education. The Board shall make the application available on its
322322 website, and applications may be submitted online. The Board shall
323323 not charge an application fee. The application shall include:
324324 1. The name of the applicant(s) accomp anied by copies of
325325 certificates to teach issued by the Board and proof that the
326326 applicant(s) has five (5) years of teaching experience in this
327327 state;
328328 2. Proof of filing the surety bond or letter of credit required
329329 by Section 2 of this act; and

381381 3. The designated point of cont act between the professional
382382 teacher charter school and the State Board of Education.
383383 B. 1. The State Board of Education may disapprove an
384384 application that does not meet one or more of the requirements set
385385 forth in this section or Se ction 4 of this act.
386386 2. The State Board of Education shall approve an application
387387 that meets the requirements of this section and Section 4 of this
388388 act within thirty (30) days of receipt of the application and grant
389389 the applicant a charter contract . If an application that meet s the
390390 requirements of this section and Section 4 of this act is not
391391 approved within thirty (30) days of receipt, the applicant(s) shall
392392 have a cause of action in district court. The court may award costs
393393 and reasonable attorney fees to the prevailing party.
394394 C. A professional teacher charter school established pursuant
395395 to the provisions of this act may be organized as a sole
396396 proprietorship or any other business entity authorized to do
397397 business in this state.
398398 D. A professional teache r charter school shall be govern ed by
399399 the certified teacher or consortium of certified teachers who
400400 applied for the school pursuant to this section and shall have
401401 exclusive control over curriculum selection, development, and
402402 delivery. Provided, however, a professional teacher charter school
403403 may have a non-teacher advisory board.

455455 E. A professional teacher charter school contract shall be a
456456 continuing contract.
457457 F. If a certified teacher or consortium o f certified teachers
458458 granted a professional teacher cha rter school contract pursuant to
459459 the provisions of this section is no longer willing or a ble to
460460 operate the charter school , another certified teacher or consortium
461461 of teachers who meets the requirements of subsection A of Section 2
462462 of this act may apply to the State Board of Education to assum e the
463463 terms of the charter contract. The State Board of Education shall
464464 approve the transfer of the charter contract if the applicati on
465465 meets the requirements of this section and Section 4 of this act.
466466 SECTION 4. NEW LAW A new sect ion of law to be codified
467467 in the Oklahoma Statutes as Section 3-146.3 of Title 70, unless
468468 there is created a duplication in numb ering, reads as follows:
469469 A. A professional teacher charter school established p ursuant
470470 to this act:
471471 1. May provide a comprehensive program of instruction for
472472 prekindergarten, kindergarten, or any grade between grades one and
473473 twelve;
474474 2. Shall ensure that each enrolled student takes a nati onally
475475 norm-referenced test approved by the State Board of Education once
476476 each school year. Individual student test results shall be
477477 delivered to the student’s parents along with aggregated charter
478478 school results. Aggregate test data shall be remitted to the State

532532 3. Shall post on its website a statement describing the extent
533533 to which the charter school’s curriculum complies with or departs
534534 from the subject matter standards adopted by the State Board of
535535 Education pursuant to Section 11-103.6 of Title 70 of the Oklahoma
536536 Statutes;
537537 4. Shall post on its webs ite information regarding curricu lum
538538 and instructional materials to be used by charter school students
539539 and teachers;
540540 5. Shall adopt bylaws that:
541541 a. ensure compliance with all federal regulations and
542542 state and local rules and statutes relating to health,
543543 safety, civil rights, and insuranc e, and
544544 b. require that the charter school be as equally free and
545545 open to all students as traditional public schools;
546546 6. Shall have independent control over curriculum and personnel
547547 decisions;
548548 7. May enter into contracts, sue, and be sued; and
549549 8. Shall not levy taxes or issue bonds.
550550 B. A professional teacher charter school establi shed pursuant
551551 to this act shall not be subject to any provision of the Oklahoma
552552 Charter Schools Act except as provided for in this act. A

605605 1. Be required to participate in the testing required by the
606606 Oklahoma School Testing Program Act; however, the charter schoo l may
607607 choose to participate;
608608 2. Be required to participate in the accountability system
609609 established pursuant to Section 1 210.545 of Title 70 of the Oklahoma
610610 Statutes; however, the charter school may choose to participate;
611611 3. Be required to employ persons who have a valid certificate
612612 issued by and in accordance with the rules of the State Bo ard of
613613 Education;
614614 4. Be required to comply with the minimum salary and benefits
615615 set forth in Section 18 -114.14 of Title 70 of the Oklahoma Statutes;
616616 5. Be required to comply with employer -employee bargaining
617617 provisions set forth in Sections 5 09.1 through 509.10 of Title 70 of
618618 the Oklahoma Statutes; and
619619 6. Be required to comply with provisions regarding the length
620620 of the school day as provided for in Sect ion 1-111 of Title 70 of
621621 the Oklahoma Statutes or th e length of the schoo l year as provided
622622 for in Section 1-109 of Title 70 of t he Oklahoma Statutes.
623623 C. 1. A professional teacher charter school established
624624 pursuant to this act shall be a statewide charter school , and the
625625 geographic boundaries of each professional teacher charter school
626626 shall be the borders of the state.
627627 2. Any student between the ages of five (5) on or before
628628 September 1 and twenty-one (21) years on or before September 1 shall

681681 teacher charter school.
682682 3. A professional teacher charter school shall not limit
683683 enrollment or discriminate based on race, sex, or religion.
684684 4. The State Board of Education shall not restrict the number
685685 of students a professional teacher charter sch ool may enroll.
686686 5. A professional teacher charter school may establish
687687 enrollment criteria based on objective academic standards and
688688 educational emphasis.
689689 6. By July 1 each year, a professional teacher charter school
690690 shall determine and post on its websi te the capacity for each grade
691691 level offered by the school. If capacity is insufficient to enroll
692692 all eligible students, the school shall select students through a
693693 lottery selection process.
694694 D. A professional teacher charter school may provide student
695695 transportation.
696696 SECTION 5. NEW LAW A new section of law to be codified
697697 in the Oklahoma Statutes as Section 3-146.4 of Title 70, unless
698698 there is created a duplication in numb ering, reads as follows :
699699 A. There is hereby created in the S tate Treasury a revol ving
700700 fund for the State Department of Education to be designated the
701701 “Professional Teacher Charter Student Revolving Fund”. The fund
702702 shall be a continuing fund, not subject to fiscal year limitati ons,
703703 and shall consist of all monies received by the State Department of

755755 Education from the surety bond or irrevoca ble letter of credit
756756 required by subsection B of Section 2 of this act. All monies
757757 accruing to the credit of the fund are hereby appropriate d and may
758758 be budgeted and expended by the State Department of Education for
759759 the purpose set forth in subsection B o f this section. Expenditures
760760 from the fund shall be made upon warrants issued by the State
761761 Treasurer against claims filed as prescribed by l aw with the
762762 Director of the Office of Management and Enterp rise Services for
763763 approval and payment.
764764 B. 1. In the event that a professional teacher charter school
765765 established pursuant to the Professional Teacher Charter Act created
766766 in Section 1 of this ac t permanently ceases operations prior t o the
767767 end of a school year, the surety bond or irrevocable letter of
768768 credit required by subsection B of Section 2 of this act shall be
769769 paid to the Professional Teacher Charter Student Revolving Fund
770770 created in subsection A of this section. The State Department of
771771 Education shall distribute the funds on a pro-rata basis to the
772772 school districts or public charter schools established pursuant to
773773 the Oklahoma Charter Schools Act in which students who had been
774774 attending a professional teacher charter school enro ll.
775775 2. a. If a professional teacher charter school is
776776 established as a non-profit sole proprietorship or
777777 other business entity pursuant to subsection C of
778778 Section 3 of this act and permanently ceases

837837 shall be given to public charter schools in which
838838 students who had been attending a professional teach er
839839 charter school enroll.
840840 b. If a professional teacher charter school is
841841 established as a for -profit sole proprietorship or
842842 other business entity pursuant to subsection C of
843843 Section 3 of this act and permanently ceases
844844 operations, any real or personal property purchased by
845845 the charter school with public funds shall be retained
846846 by the sole proprietorship or other business entity.
847847 SECTION 6. NEW LAW A new section of law to be codified
848848 in the Oklahoma Statutes as Section 3-146.5 of Title 70, unless
849849 there is created a duplication i n numbering, reads as follows:
850850 A. For the purpose of calculating weighted average daily
851851 membership pursuant to Section 18-201.1 of Title 70 of the Oklahoma
852852 Statutes and State Aid pursuant to Section 18 -200.1 of Title 70 of
853853 the Oklahoma Statutes, the weighted average daily me mbership for the

905905 first year of operation of a professional teacher charter school
906906 established pursuant to the prov isions of this act shall be
907907 determined by multiplying the actual enrollme nt of students as of
908908 August 1 by 1.333. The professional teacher cha rter school shall
909909 receive revenue equal to that which would be generated by the
910910 estimated weighted average daily membership calculated pursuant to
911911 this paragraph. At midyear, the allocation for the professional
912912 teacher charter school shall be adjusted using the first quarter
913913 weighted average daily membership for the professional teacher
914914 charter school calculated pursuant to Section 18-201.1 of Title 70
915915 of the Oklahoma Statutes .
916916 B. A professional teacher charter school shall not be elig ible
917917 to receive state-dedicated, local, or county revenue; provided, a
918918 professional teacher charter school may be eligible to receive any
919919 other aid, grants, or revenues allowed to other schools. A
920920 professional teacher charter school shall be considered a local
921921 education agency for purposes of funding.
922922 C. The State Board of Education shall determine the policy and
923923 procedure for making payments to a professional teacher charter
924924 school.
925925 D. A professional teacher charter school shall use the Oklahoma
926926 Cost Accounting System to report financial transactions to the State
927927 Board of Education.

979979 E. Any unexpended funds received by a professional teacher
980980 charter school may be reserved and used for future purposes.
981981 SECTION 7. NEW LAW A new sect ion of law to be cod ified
982982 in the Oklahoma Statutes as S ection 3-146.6 of Title 70, unless
983983 there is created a duplication in numbering, reads as follows:
984984 The State Board of Ed ucation shall promulgate rules to implement
985985 the provisions of this act and to expedite the creation an d
986986 maintenance of professional teache r charter schools.
987987 SECTION 8. AMENDATORY 70 O.S. 2021, Sec tion 3-138, is
988988 amended to read as follows:
989989 Section 3-138. A board of education of a school district or an
990990 employee of the district who has control over personnel actions
991991 shall not take unlawful reprisal action against an emp loyee of the
992992 school district for the reason that the employee is directly or
993993 indirectly involved in an application to establish a charter school
994994 pursuant to the Oklahoma Charter Schools Act or the Profes sional
995995 Teacher Charter Act created in Section 1 of th is act. As used in
996996 this section, “unlawful reprisal” means an action that is taken by a
997997 board of education or a school distr ict employee as a direct result

10531053 SECTION 9. AMENDATORY 70 O.S. 2021, Section 3-144, is
10541054 amended to read as follows:
10551055 Section 3-144. A. There is hereby created in the State
10561056 Treasury a fund to be designated the “Charter Schools Incentive
10571057 Fund”. The fund shall be a continuing fund , not subject to fiscal
10581058 year limitations, and shall co nsist of all monies appropriated by
10591059 the Legislature, gifts, grants, devises , and donations from any
10601060 public or private source. The State Dep artment of Education shall
10611061 administer the fund for the purpose of providing financial support
10621062 to charter school appl icants and charter schools established
10631063 pursuant to the Oklahoma Charter Schools Act or the Professional
10641064 Teacher Charter Act created pursuant to Section 1 of this act for
10651065 start-up costs and costs associa ted with renovating or remodeling
10661066 existing buildings a nd structures for use by a charter school. The
10671067 State Department of Education is aut horized to allocate funds on a
10681068 per-pupil basis for purpo ses of providing matching funds for the
10691069 federal State Charter School Facilities Incentive Grants Program
10701070 created pursuant to the No Child Left Behind Act, 20 USCA, Secti on
10711071 7221d.
10721072 B. The State Board o f Education shall adopt rules to implement
10731073 the provisions of this section, including application and
10741074 notification requirements.
10751075 SECTION 10. This act shall become effective July 1, 2023.
