27	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	58		SECTION 1. AMENDATORY 47 O.S. 2021, Section 953.2, is
30	59		amended to read as follows:

32	60		Section 953.2. A. The rates established by order of the
33	61		Corporation Commission shall deter mine the maximum fees and charges
34	62		for the storage and after-hours release of noncons ensual towed
35	63		vehicles, including incorporated and unincorporated areas, by a
36	64		wrecker or towing service licensed by the Department of Public
37	65		Safety and repair facilities as defined in Section 953 of Title 15
38	66		of the Oklahoma Statutes. No wrecker or towing service or repair

39	94		facilities shall charge any fee for nonconsensual towed vehicles and
40	95		storage which exceeds the maximum rates established by the
41	96		Commission. Such rates shall be in addition to any other rates,
42	97		fees or charges authorized, allowed or required by law, including
43	98		environmental remediation fees and services.

45	99		B. 1. Storage or after-hours release of a towed ve hicle, or
46	100		both, provided by a wrecker or towing servic e or by a repair

49	101		facility shall be recorded by the operator on a bill or invoice as
50	102		prescribed by rules of the Department.

52	103		2. Nothing herein shall limit the right of an operato r or
53	104		repair facility who has provided or caused to be provided stora ge or
54	105		after-hours release of a towed vehicle, or both, to require
55	106		prepayment, in part or in full, or guarantee of payment of any
56	107		charges incurred for providing such services.

58	108		3. This section shall not be construed to require an operator
59	109		or repair facility to charge a fee for the storage or after-hours
60	110		release, or both, of any towed vehicle.

62	111		4. The operator or repair facility is authorized to collect all
63	112		lawful fees in acceptable forms of payment such as through check,
64	113		credit card, automated clearing house transfer, o r debit card from
65	114		the owner, lienholder or agent of the towed vehicle or insurer
66	115		accepting liability for paying the claim for a vehicle or pur chasing
67	116		the vehicle as a total loss vehicle from the registered owner for
68	117		the performance of any an d all such services. An operator or repair

69	145		facility shall make the towed vehicle available for insp ection by
70	146		the owner, lien holder, agent of the towed vehicle , or insurer
71	147		accepting liability for paying the claim for a vehicle and shall
72	148		release the vehicle from storage upon authorization from the owner,
73	149		agent or lienholder of the vehicle or in the case of a total loss,
74	150		the insurer accepting liability for paying the claim for the v ehicle
75	151		or purchasing the vehicle where the vehicle is to be moved to an
76	152		insurance pool yard for sale.

78	153		C. The rates in subsections D through F of this section shall
79	154		be applicable until superseded by rates established by the
80	155		Commission.

82	156		D. Outdoor Storage Rates.

84	157		1. Rates in this subsection shall apply to the outdoor storage
85	158		of a towed vehicle. Rates may be applied from the time the t owed
86	159		vehicle is brought onto the outdoor sto rage facility premises.
87	160		Rates shall apply to each calendar day of outdoor stora ge; provided,
88	161		the maximum twenty-four-hour fee, as provided for in this section,
89	162		may be charged for any towed vehicle which is store d for a portion
90	163		of a twenty-four-hour period.

123	211		maximum twenty-four-hour fee, as provided for in this section, may
124	212		be charged for any towe d vehicle which is stored for a portion o f a

155	258		F. After-Hours Release Rate.

157	259		1. The rate in this subsection shall apply to the release of a
158	260		towed vehicle to the own er, lienholder, or agent when such rele ase
159	261		occurs at a time other than normal busine ss hours.

161	262		2. As used in this subsection:

163	263		a. “after-hours release rate” shall mean the rate charged
164	264		for the release of a towed vehi cle between the hours
165	265		of midnight and 8:00 a.m., or between the hours of
166	266		4:00 p.m. and midnight Monday through Friday, or any
167	267		time on Saturday, Sunday or a national holiday, and

169	295		b. “national holiday” shall mean New Year’s Day, Martin
170	296		Luther King Day, Georg e Washington’s Birthday, on the
171	297		third Monday in February, Memorial Day, Independ ence
172	298		Day, Labor Day, Veterans Day, Thanksgivi ng Day and
173	299		Christmas Day, and shall further include the Friday
174	300		before such national holiday which falls on a Saturday
175	301		and the Monday following such national holiday which
176	302		falls on a Sunday.

180	303		3. The maximum after -hours release rate shall be Fifteen
181	304		Dollars ($15.00) per quarter hour for the release of any single
182	305		vehicle or combination o f vehicles.

184	306		G. An operator or repair facility shall be required to provide
185	307		reasonable documentation to substantiate all lawful fee s charged the
186	308		owner, lienholder, agent or ins urer accepting liability for paying
187	309		the claim for the towed vehicle or purchasin g the towed vehicle.
188	310		Fees for which the operator or repair facility is being reimbursed,
189	311		or having paid to a third party, shall in clude copies of the invoice
190	312		or other appropriate documents to substantiate the payment to the
191	313		third party.

193	314		SECTION 2. This act shall become effective November 1, 2023.
