6565 An Act relating to schools; amending Section 1,
6666 Chapter 106, O.S.L. 2022 (70 O.S. Sup p. 2022, Section

8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
9090 SECTION 1. AMENDATORY Section 1, Chapter 106, O.S.L.
9191 2022 (70 O.S. Supp. 2022, Section 11 -201), is amended to read as

147147 serves when acquiring an age-appropriate collection of print
148148 materials, nonprint materials, multimedia res ources, equipment, and
149149 supplies adequate in quality and quantity to meet the needs of
150150 students in all areas of the school library media program.
151151 B. To provide a library media program that meets the provisions
152152 of subsection A of this section, no print or nonprint materials or
153153 multimedia resources located in a public school district or public
154154 charter school library or els ewhere on the premises of the district
155155 or charter school shall contain :
156156 1. Visual or visually implied depictions of sexual acts or
157157 simulations of such acts;
158158 2. Explicit or implied written descr iptions of sexual acts; or
159159 3. Visual depictions of nudity or implied nudity, except for
160160 such depictions which may appear in a biology textbook .
161161 C. By July 1, 2024, a nd by July 1 annually thereafter, each
162162 public school district and public charter school in this state shall
163163 conduct an audit of print and nonprint materials and multimedia
164164 resources located in a library or elsewhere on the premises of the
165165 district or charter s chool and shall remove any materials or
166166 resources that have content prohibited by subsection B of this
167167 section. Beginning July 1, 2024, each publ ic school district and
168168 public charter school shall maintain an inventory list of all print

222222 D. All print and nonprint materials and multimedia resources
223223 shall be available for inspection by parents or legal guardians of
224224 students enrolled in a public school district or public charter
225225 school.
226226 E. Recommendations for new print or nonprint materials and
227227 multimedia resources shall be made by the school librarian , library
228228 media specialist, or a designee of the superintendent of the public
229229 school district or public charter school. The superintendent of the
230230 public school district or p ublic charter school sh all review and
231231 approve or disapprove the recommendations for new print and nonprint
232232 materials and multimedia resources .
233233 F. 1. The parent or legal guardian of a student enrolled in a
234234 public school district or public charter school m ay submit a written
235235 request to the superintendent o f the district or charter school to
236236 review print or nonprint materials or multimedia resources located
237237 on school premises to determine whether they violate the provisions
238238 of subsection B of this section.
239239 2. Upon receipt of the written request, the super intendent and
240240 the principal of the school site where the material or resource is
241241 located shall review the material or resource and within ten (10)
242242 business days shall either remove the material or resour ce from

294294 school premises or submit to the parent or lega l guardian a written
295295 explanation for not rem oving the material or resource.
296296 3. A parent or legal guardian may appeal the decision of a
297297 superintendent and principal to not remove the material or resource
298298 from school premises to the school district board of education or
299299 the governing board of the cha rter school. Upon receipt of a
300300 written request for appeal, the school district board of education
301301 or charter school governing board shall review the material or
302302 resource. As part of the appeal process, the pare nt or legal
303303 guardian may read a portion of t he material or resource during a
304304 public meeting of the school district board of education or charter
305305 school governing board. The school district board of educat ion or
306306 charter school governing board shall either direct that the material
307307 or resource be removed from school premises or submit to the parent
308308 or legal guardian a written explanation fo r not removing the
309309 material or resource.
310310 4. A parent or legal guardia n may appeal the decision of a
311311 school district boar d of education or charter school governing b oard
312312 to not remove the material or resource from school premises to the
313313 State Board of Education. Upon receipt of a written request for
314314 appeal, the State Board of Education shall review the material or
315315 resource and shall either direct that the material or resource be
316316 removed from school premises or submit to the parent or legal

370370 5. A school district or charter sch ool that fails to remove a
371371 material or resource as directed by the Stat e Board of Education
372372 pursuant to this subsection shall receive a five percent ( 5%)
373373 reduction in state funding for the fiscal year following the fiscal
374374 year during which the district or charter school failed to remove
375375 the material or resource.
376376 G. The State Board of Education shall promulgate rules to
377377 implement the provisions of this section.
378378 SECTION 2. This act shall become effective July 1, 2023.
379379 SECTION 3. It being immediately n ecessary for the preservation
380380 of the public peace, health, or safety, an emergency is hereby
381381 declared to exist, by reason whereof thi s act shall take effect and
382382 be in full force from and after its passage and approval.
