8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new section of law to be co dified
8585 in the Oklahoma Statutes as Section 2-6-502 of Title 27A, unless
8686 there is created a duplication in numb ering, reads as follows:
8787 A. As used in this act:
8888 1. “Agritourism activity” means activity as defined pursuant to
8989 Section 5-15 of Title 2 of the Oklahoma Statutes;
9090 2. “Biosolid” means sludge, perfluoroalkyl, and any
9191 perfluoroalkyl substance;

143143 3. “Department” means the Department of Environmental Quality ;
144144 4. “Product” shall include, but not be li mited to, compost
145145 material, fertilizer, soil amendment, topsoil replacement, and
146146 mulch; and
147147 5. “Sludge” means sludge as defined pursuant to Section 2-10-
148148 401 of Title 27A of the Oklahom a Statutes.
149149 B. 1. Any person, business, or entity authorized to commence
150150 industrial, municipal, and commercial operations in this state shall
151151 disclose the use of biosolids when labeling products for sale and
152152 distribution.
153153 2. Any product under this subsection that is sold or
154154 distributed in this state shall have clear and distinct labeling
155155 disclosing that the product, either in its production or in its
156156 composition, includes biosolids generated from an industrial,
157157 municipal, or commercial wastewater treatment plant or s ludge.
158158 3. Full disclosure shall be given to any consumer who pur chases
159159 an agricultural crop or vegetative material for any agricultural
160160 purpose if the crop or material was grown at a location in this
161161 state where biosolids have been permitted to be applied or spread .
162162 C. 1. Any person, business, or entity au thorized to commence
163163 industrial, municipal, and commercial operations in this state shall
164164 disclose the use of biosolids by placing signage on any property
165165 where such operations take place and where biosolids are utilized .
166166 Such signage shall be in an area that is visible to the public.

218218 2. Prior to the sale or lease of any property described under
219219 this subsection, public access to the lan d shall be restricted for
220220 one year following the land application of biosolids as required in
221221 40 C.F.R. Part 503.
222222 3. Any property under this subsection that is sold or leased
223223 shall include a disclosure stating that the subject property was
224224 used as a biosolids application site.
225225 4. The Department shall publish and update annually a map of
226226 biosolid land application property sites on a publicly available
227227 website. All sites permitted to apply bi osolids shall be labeled
228228 with the date of each land application and the names of the
229229 landowner and lessor, if applicable. Records shall be kept in
230230 perpetuity.
231231 D. The Department shall , in consultation with the Oklahoma
232232 Department of Agriculture, Food, and Forestry, provide written
233233 notice to businesses conducting agritourism acti vities of any
234234 biosolid land application taking place within a two-mile radius of
235235 the business. Notice shall be transmitted at least sixty (60) days
236236 prior to land application.
237237 SECTION 2. This act shall become effective November 1, 2023.
