8181 BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 950.1 of Title 40, un less there
8484 is created a duplication in nu mbering, reads as follows:
8585 This act shall be kno wn and may be cited as the “Right to Earn a
8686 Living Act”.
8787 SECTION 2. NEW LAW A new section of law to be codified
8888 in the Oklahoma Statutes as Sec tion 950.2 of Title 40, unless there
8989 is created a duplication in numbering, reads as foll ows:

142142 1. “Agency” shall be broadly construed to include the state,
143143 all agencies, boards and commissions of state government, and all
144144 political subdivisions of the state and shall exclude no entity
145145 established under the constitution or l aws of the state or
146146 established by any entity which was itself established under the
147147 constitution or laws of the state;
148148 2. “Occupational license ” means a nontransfera ble and exclusive
149149 authorization in law i n which the legislature establishes the
150150 personal qualifications necessary to engage in any occupation or
151151 profession;
152152 3. “Occupational regulations ” shall include any regulation,
153153 rule, policy, fee, condition, test, pe rmit, administrative practice ,
154154 or other provision in which an agency or board establishes the
155155 personal qualifications necessary to engage in any occupation or
156156 profession. For the purpose of this act, an occupational regulation
157157 does not include an “occupational license”;
158158 4. “Less restrictive regulation” means, from least to most
159159 restrictive:
160160 a. market competition,
161161 b. third-party or consumer-created ratings and reviews,
162162 c. private certification,
163163 d. voluntary bonding or insurance,
164164 e. specific private civil c ause of action to remedy

230230 5. “Personal qualifications ” means criteria related to an
231231 individual’s personal background and characteristi cs, including
232232 completion of an approved educational program, satisfactory
233233 performance on an examination, work experience, other evidence of
234234 attainment of requisite skills or knowledge, moral standing,
235235 criminal history, and completion of continuing education;
236236 6. “Specialty occupational license f or medical reimbursement ”
237237 means a nontransferable a uthorization in law for an individual to
238238 qualify for payment or reimbursement from a government agency for
239239 the non-exclusive provision of medical services based on mee ting

291291 personal qualifications establish ed by the Legislature. A private
292292 company may recognize this credential;
293293 7. “Welfare” shall be narrowly construed to encompass
294294 protection of members of the public against fraud or harm. This
295295 term shall not encompass the protection of existing businesses or
296296 agencies, whether publicly or priva tely owned, against competition;
297297 and
298298 8. “Subsidy” shall include taxes, grants, user fees , or any
299299 other funds received by or on behalf of an agency.
300300 SECTION 3. NEW LAW A new section of law to be codified
301301 in the Oklahoma Statutes as Section 950.3 of Title 40, unless there
302302 is created a duplication in numbering, reads as follows:
303303 All occupational regulations shall be limited to those
304304 demonstrably necessary and ca refully tailored to fulfill legitimat e
305305 public health, safety, or welfare objectives.
306306 SECTION 4. NEW LAW A new section of law to be codified
307307 in the Oklahoma Statutes as Section 950.4 of Title 40, unless there
308308 is created a duplication in numbering, reads as follows:
309309 A. Within one year following enactment, every agency s hall
310310 conduct a comprehensive review of all occupational regulations and
311311 occupational licenses within their jurisdictions, and for each it
312312 shall:
313313 1. Articulate with spec ificity the public health, safety , or
314314 welfare objective(s) served by the regulation;

366366 2. Articulate the reasons why the regulation is necessary to
367367 serve the specified objectives ;
368368 3. Analyze, where information is readily available, the effects
369369 of regulation on opportunities for workers, cons umer choices and
370370 costs, general unemployment, marke t competition, governmental costs,
371371 and other effects; and
372372 4. Compare the regulation to whether and how other states
373373 regulate the business or profession.
374374 B. To the extent the agency finds any regulation t hat does not
375375 satisfy the standard set forth in Sect ion 3 of this act, it shall:
376376 1. Repeal the occupational regulation or modify the
377377 occupational regulation to conform with the standard o f Section 3 of
378378 this act if such action is within the agency ’s authority to do so;
379379 or
380380 2. Recommend to the Legislature actions necessary to repeal or
381381 modify the occupational license or occupational regulation to
382382 conform to the standard of Section 3 of this act if such action as
383383 it relates to an occupational regulation is not within the agency’s
384384 authority.
385385 C. Within fifteen (15) months following enactment, each agency
386386 shall report to the Legislature on all actions taken to conform with
387387 this section.

439439 SECTION 5. NEW LAW A new section of law to be codifie d
440440 in the Oklahoma Statutes as Section 950.5 of Title 40, unless there
441441 is created a duplication in numbering, reads as follows:
442442 A. Any person may petition any agency to repeal or modify any
443443 occupational regulation within i ts jurisdiction.
444444 B. Within ninety (90) days of a petition filed under subsection
445445 A of this section, the agency shall either repeal the occupational
446446 regulation, modify the regulation to achieve the standard set forth
447447 in Section 3 of this act, or state the basis on which it concludes
448448 the regulation conforms with the standard set forth in Se ction 3 of
449449 this act.
450450 SECTION 6. NEW LAW A new section of law to be codified
451451 in the Oklahoma Statutes as Section 950.6 of Title 40, unless there
452452 is created a duplication in numbering , reads as follows:
453453 A. Whether or not a petition i s filed pursuant to Section 5 of
454454 this act, any person may file an action in a court of general
455455 jurisdiction to challenge an occupational regulation.
456456 B. With respect to the challenge of an occupatio nal regulation,
457457 the plaintiff shall prevail if the court finds by a preponderance of
458458 evidence that the challenged occupational regulation on its face or
459459 in its effect burdens the entry into a profession or occupation; and
460460 either:
461461 1. That an agency has failed to prove by a preponderance of
462462 evidence that the chall enged occupational regulation is not

514514 demonstrably necessary and carefully tailored to fulfill legitimate
515515 public health, safety , or welfare objectives; or
516516 2. Where the challenged occupational regulation is necessary to
517517 the legitimate public health, safety , or welfare objectives, such
518518 objectives can be effectively served by using a less restrictive
519519 regulation, as defined in Section 2 of this act, which is less
520520 burdensome to economic opportunity.
521521 C. Upon a finding for the plaintiff, the court shall enjoin
522522 further enforcement of the challenged occupational regulation and
523523 shall award reasonable attorney fe es and costs to the plaintiff .
524524 SECTION 7. This act shall become effective January 1, 202 4.
