BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 5-201 of Title 70, unless there is created a duplication in numb ering, reads as follows: A. Each school district shall submit to the State Department of Education by July 1, 2024, and each July 1 thereafter an itemized report of school district expenditures for the previous fiscal year related to addressing or improving diversity , inclusion, equity, or social justice in the school district. The State Department of Education shall make the expenditure report available on its Req. B. The report required by subsection A of this section shall include the following expenditures for each fiscal year : 1. The number of employees whose partial or primary job function is dedicated to involvement in anti -discrimination, equity, inclusion, diversity, anti -racism, or social justice within the school district. The information shall include the salaries of the employees, the job descriptions of the employees, the number of professional development or training programs performed by the employees, and the number of investigations conducted by the employees; 2. The total amount and itemized expenditures the school district has spent by activity related to anti-discrimination, equity, inclusion, diversity, anti -racism, or social justice; 3. The total number and related expenditures for mandatory and voluntary school staff training, professional development, or rehabilitative sessions provided relating to anti-discrimination, equity, inclusion, diversity, anti -racism, or social justice; 4. The total number and itemized expenditures for mandatory and voluntary student tr aining sessions, seminars, courses , or classes provided relating to anti -discrimination, equity, inclusion, diversity, anti-racism, or social justice; Req. The number of employees subjected to counseling, discipline, or any other remedial m easure for violating the school district’s anti-discrimination, equity, inclusion, diversity, anti -racism, or social justice policy and itemized expenditures disaggregated by type of measure including but not lim ited to mandatory or voluntary counseling, discipline, suspension, demotion, or other remedial measure; and 6. The number of students subjected t o counseling, discipline , or any other remedial measure for violating the school district’s anti-discrimination, equity, inclusion, diversity, anti -racism, or social justice policy and itemized expenditures disaggregated by type of measure including but not limi ted to mandatory or voluntary counseling, discipline, in-school suspension, out-of-school suspension, detention , or other remedial measure. C. In addition to the ex penditure report required by subsection A of this section, each school district shall submi t to the State Department of Education the following: 1. A copy of the sc hool district’s anti-discrimination, equi ty, inclusion, diversity, anti -racism, or social justice policy adopted by the school district board of education; 2. Copies of all coursework, homework assignments, classroom presentations, and other materials th at were assigned or shown to students as part of a school district’s anti-discrimination, equity, inclusion, diversity, anti -racism, or social justice policy; Req. A copy of the school district’s student and employee handbooks with the following provisions highlighted if included: a. provisions enforcing the district’s anti- discrimination, equity, inclusion, diversity, anti - racism, or social justice policy, b. the penalties or disciplin e that will be imposed on students and staff for failing to comply with th e district’s anti-discrimination, equity, inclusion, diversity, anti-racism, or social ju stice policy, c. provisions explaining the First Amendment rights of students and employees , and d. the due process procedures for disciplining students and employees for violations of the district ’s anti- discrimination, equity, inclusion, diversity, anti - racism, or social justice policy; 4. A copy of any contract entered into by the school distr ict to provide professional development, training, or any related coursework to employees or students relating to t he district’s anti- discrimination, equity, inclusi on, diversity, anti-racism, or social justice policy including the amount of the contract; and 5. A copy of any contract entered into by the school district for the performance of a diversity analysis or equity assessment or for the development of an anti-discrimination, equity, inclusion, Req. The submission required by this paragraph shall include: a. a copy of any bid or proposal received by the district for the purposes set forth in this paragraph, b. a copy of any report or work product generated as a result of a contract for the purposes set f orth in this paragraph, and c. the amount the school district expended on e ach contract for the purposes set forth in this paragraph. D. The State Board of Education shall adopt rules for monitoring compliance with th e provisions of this section and is authorized to report a school as deficient on the accreditation report for noncompliance. SECTION 2. This act shall become effective July 1, 2023. SECTION 3. It being immediately necessary for the preservation of the public peace, health , or safety, an emergency is hereby declared to exist, by reas on whereof this act shall take effect and be in full force from and after its passage and appr oval. 59-1-38 EB 11/29/2022 9:08:57 AM
