77	77	BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 26 O.S. 2021, Section 4 -109.4, as
79	79	amended by Section 16, Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2022,
80	80	Section 4-109.4), is amended to read as follows:
81	81	Section 4-109.4. A. A person may submit a voter registration
82	82	application electronically as provided in this section if such
83	83	person:
84	84	1. Has a current and val id Oklahoma driver license or
85	85	identification card issued by Service Oklahoma pursuant to the
86	86	provisions of Section 6-101 et seq. of Title 47 of the Oklahoma

139	139	2. Is registering to vote at the address shown on the d river
140	140	license or identification card; and
141	141	3. Is a qualified elector and entitled to become a reg istered
142	142	voter as provided by law.
143	143	B. The Secretary of the State Election Board, subject to
144	144	available funding, shall establish a secure website to permit
145	145	persons described in subsection A of this section to submit voter
146	146	registration applications electronic ally by December 31, 2023. The
147	147	website must permit suc h persons to submit an application to
148	148	register to vote or to update an existing registration . The
149	149	Secretary may employ sec urity measures he or she deems necessary to
150	150	ensure the accuracy and integrity of voter registratio n applications
151	151	submitted electronic ally and may establish an initial date on which
152	152	voter registration applications may be submitted electronically
153	153	after establishment of the website.
154	154	C. 1. The applicant must attest to the truth of the
155	155	information provided on the application by affirmative ly accepting
156	156	the information as true and correct. Any person who submits false
157	157	information on an electronic voter registr ation application shall be
158	158	deemed guilty of a felony as described in Sections 16-103 and 16-
159	159	103.1 of this title.
160	160	2. The applicant must consent to the comparison of the
161	161	information entered into an electronic voter registration
162	162	application to the informati on contained in his or her driver

216	216	record for voter registration purposes.
217	217	3. A voter registration application properly submit ted
218	218	electronically shall be processed by the State Election Board and
219	219	the appropriate county election board in the same manner as a vote r
220	220	registration application submitted on a paper form.
221	221	D. 1. When an applicant submits a voter registration
222	222	application electronically, th e Secretary shall generate an
223	223	electronic confirmation on the website that the appl ication has been
224	224	received, with instructions as to how the applicant may check the
225	225	status of the application thereafter.
226	226	2. a. The Secretary shall submi t the information ent ered
227	227	into the electronic voter registration application by
228	228	the applicant to Service Oklahoma for comparison to
229	229	the record of the applic ant’s driver license or
230	230	identification card.
231	231	b. Service Oklahoma shall respond to the submission and
232	232	shall indicate if the information sub mitted matches
233	233	the information in the ap plicant’s driver license
234	234	record.
235	235	c. If the information matches, the electronic voter
236	236	registration application ma y proceed and Service
237	237	Oklahoma shall provide the State Election Board with

290	290	applicant’s driver license or identification card
291	291	record. If the information does not match, th e
292	292	application shall not p roceed, and the applicant shall
293	293	be notified of the failed match and may be provided
294	294	information and instruction for updating the driver
295	295	license or identification card record with Service
296	296	Oklahoma.
297	297	3. a. Following a match of records by Service Oklahoma
298	298	described in subparagr aph b of paragraph 2 of this
299	299	subsection, and if the Secretary finds that the
300	300	electronic voter registration application is in
301	301	compliance with this section and all applicable laws
302	302	relating to voter registration, the digital image of
303	303	the signature from the ap plicant’s driver license or
304	304	identification card record shall be included on the
305	305	application and the application shall be submitted and
306	306	processed as provided by law. Provided, the Secretary
307	307	of the State Election Board is authorized to designate
308	308	an alternative method of obtaining the signature of
309	309	the applicant, if necessary.
310	310	b. If the Secretary does not find that the electronic
311	311	voter registration application is in compliance with
312	312	this section and all applicable laws relating to voter

365	365	electronic voter registration application cannot be
366	366	submitted and the reasons it cannot be submitted, and
367	367	shall provide information about other methods to
368	368	submit a voter registration application.
369	369	E. The provisions of Section 24A.5 of Title 51 of the Oklahoma
370	370	Statutes relating to confidentiality of personal informati on within
371	371	driver records as defined by the Driver’s Privacy Protection Act, 18
372	372	United States Code, Sections 2721 through 2725, shall be applicable
373	373	to information obtained by the State Election Board fr om Service
374	374	Oklahoma during the information matching pro cedure described in this
375	375	section. Provided, however, this subsection shall not apply to
376	376	information entered into the el ectronic voter registration
377	377	application by the vo ter registration applicant nor to the digital
378	378	image of the applicant ’s signature provided to the Secretary of the
379	379	State Election Board by Service Oklahoma, upon the consent of the
380	380	applicant, for use on the e lectronic voter registration application
381	381	as provided in this s ection.
382	382	F. The Secretary of the State Election Board may estab lish a
383	383	system whereby a registered voter may electronically submit a change
384	384	to his or her voter registration i nformation, including a change of
385	385	name, political party affiliation or address of r esidence within the
386	386	county in which the voter is currently regi stered to vote. An

440	440	1. Such information as the Se cretary of the State Election
441	441	Board deems necessary to confirm the identity of the voter; and
442	442	2. An oath that the voter is eligible to register to vote in
443	443	Oklahoma.
444	444	Upon receipt of a valid electronically submitted change in voter
445	445	registration, the secreta ry of the appropriate county election board
446	446	shall update the voter’s registration information in the voter
447	447	registration database and shall file a notation of such changes with
448	448	the voter’s original voter registration application.
449	449	G. The Secretary shall pro mulgate rules as may be necessary to
450	450	implement the provisions of this section.
451	451	SECTION 2. This act shall become effective November 1, 2023.
