7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 21 O.S. 2021, Section 142.10, is
8181 amended to read as follows:
8282 Section 142.10. A. Compensation shall not be awarded:
8383 1. Unless the claim ha s been filed with the Crime Victims
8484 Compensation Board with in one (1) year five (5) years after the
8585 injury or death upon which the claim is based. If the victim is
8686 under a mental or cognitive disability or is a child under eighteen
8787 (18) years of age, the Board may use the date the criminal incident
8888 was disclosed to a responsible adult when establishing whether or
8989 not the claim was timely filed. In cases involving sexual assault

141141 of an adult eighteen (18) years of age or older, the Board may use
142142 the date the sexual assault forensic evidence kit was tested when
143143 establishing whether the claim was timely fil ed. The Board may, at
144144 its discretion, extend the filing period beyond one (1) year upon a
145145 showing of good cause or in all cases of sexual assault;
146146 2. To a claimant who was the offender, or an accomplice of the
147147 offender; or
148148 3. To another person if the award would unjustly benefit the
149149 offender or accomplice ; or
150150 4. Unless the criminally injurious conduct resulting in injury
151151 or death was reported to a law enf orcement officer within seventy -
152152 two (72) hours after its oc currence, or in the case of sexual
153153 assault, the victim undergoes a forensic medical examination within
154154 one hundred twenty (120) hours after its occurrence or the Board
155155 finds there was good cause fo r the failure to report the crime or
156156 obtain a forensic medi cal examination within that time .
157157 B. Compensation otherwise payable to a claimant shall be
158158 diminished to the extent:
159159 1. That the economic loss is recouped from collateral sources;
160160 or
161161 2. Of the degree of responsibility for the cause of the injury
162162 or death attributable to the victim as determined b y the Board.
163163 Provided, the Board shall not find a n injury attributable to the

215215 victim where a self-inflicted injury is a result of the crime
216216 committed against the victim.
217217 C. The Board, upon finding that the claimant or victim has not
218218 fully cooperated with appropriate law enforcement agencies, may
219219 deny, withdraw or reduce an award of compensation. Victims of
220220 sexual assault who undergo a forensic medical e xamination within one
221221 hundred twenty (120) hours after the sexual assault shall be found
222222 to have fully cooperated. The Board may extend this period of time
223223 for good cause.
224224 D. The Board, on its own motion or on request of the claimant,
225225 may reconsider a decision granting or denying an award or
226226 determining its amount. The motion or request to reconsider a
227227 decision shall be made within six (6) months from the date of the
228228 last action by the Board on the claim at issue. An order on
229229 reconsideration of an award shall not require a refund of amounts
230230 previously paid, unless the award was obtained by fraud. The right
231231 of reconsideration does not affect the finality of a Board deci sion
232232 for the purpose of judicial review. On claims which are denied by
233233 the Board, reconsideration may only be granted within six (6) months
234234 of the last Board action.
235235 E. The provisions of subsections A and B of this section shall
236236 not apply to claimants el igible for compensation pursuant to the
237237 Murrah Crime Victims Compensation Act who make claims under the
238238 Oklahoma Crime Victims Compensation A ct.

290290 SECTION 2. AMENDATORY 21 O.S. 2021, Section 142.13, is
291291 amended to read as follows:
292292 Section 142.13. A. The Crime Victim s Compensation Board may
293293 compensate for work loss, replacement services loss, dependent ’s
294294 economic loss and dependent ’s replacement service loss .
295295 Compensation for a caregiver who has out -of-pocket wage loss as a
296296 result of caring for the victim who was inj ured as a result of
297297 criminally injurious conduct ma y not exceed Three Thousand Dollars
298298 ($3,000.00).
299299 B. Compensation payable to a victim and to all other claimants
300300 sustaining economic loss because of injury to or death of that
301301 victim may not exceed Twenty Thousand Dollars ($20,000.00) Forty
302302 Thousand Dollars ($40,000.00) in the aggregate. The Board may,
303303 after approval of an initial award of Twenty Thousand Dollars
304304 ($20,000.00) Forty Thousand Dollars ($40,000.00), grant an
305305 additional sum not to exceed Twenty Thousand Dollars ($20,000.00)
306306 Forty Thousand Dollars ($40,000.00), specifically for loss of wages
307307 for the victim or loss of support for dependents of a deceased
308308 victim provided, there is verifiable economic loss after de ducting
309309 payments from other sou rces. In no event shall compensation payable
310310 to a victim and to all other claimants sustaining economic loss
311311 because of injury to or death of that victim exceed Forty Thousand
312312 Dollars ($40,000.00) Eighty Thousand Dollars ($8 0,000.00) in the
313313 aggregate.

365365 C. The Board may provide for the paymen t to a claimant in a
366366 lump sum or in installments. At the request of the claimant, the
367367 Board may convert future economic loss, other than allowable
368368 expense, to a lump sum.
369369 D. An award payable in a lump sum or installments for loss of
370370 support for a depende nt of the deceased victim may be computed
371371 through a formula which calculates the net loss of support for
372372 dependents based upon an es timated date of retirement or an
373373 estimated date of adult hood for dependent children, beginn ing with
374374 the date of death of the victim and ending with the least of one of
375375 the following time periods for each dependent filing loss of
376376 support:
377377 1. The amount of time from the date of death of the victim to
378378 the date the victim would have been expected t o reach sixty-two (62)
379379 years of age;
380380 2. The amount of time from the date of death of the victim to
381381 the date the spouse of the victim is expected to reach sixty -two
382382 (62) years of age; or
383383 3. The amount of time from the da te of death of the victim to
384384 the date a dependent child is expected to reach eighteen (18) years
385385 of age or twenty-three (23) years of age if the dependent child is
386386 enrolled as a full-time student. An award payable in installments
387387 for future loss of suppor t may be modified by the Board in t he event
388388 a dependent child receiv ing loss of support is between the ages of

440440 eighteen (18) and twenty -three (23) years of age and is no longer
441441 enrolled as a full-time student, the dependent dies before all
442442 installments are paid or the dependent receiving in stallments moves
443443 and leaves no forwarding address with the Board office.
444444 E. An award shall not be subject to execution, attachment,
445445 garnishment or other process, ex cept for child support and except
446446 that an award for allo wable expense shall not be exempt f rom a claim
447447 of a creditor to the extent that such creditor has provided
448448 products, services or accommodations, the costs of which are
449449 included in the award.
450450 F. An assignment by the claimant to any future award under the
451451 provisions of this act is unenforcea ble, except:
452452 1. An assignment of any award for work loss to assure payment
453453 of court ordered alimony, maintenance or child support; or
454454 2. An assignment of any award for allowable expense to the
455455 extent that the benefits a re for the cost of products, servic es or
456456 accommodations necessitated by the injury or death on which the
457457 claim is based and are provided or to be provided by the assignee.
458458 G. The Board may, in its di scretion, approve payment of crisis
459459 counseling, occurrin g within three (3) years of the cri me, in an
460460 amount not to exceed Th ree Thousand Dollars ($3,000.00) for each
461461 family member of a homicide victim; provided, the counselor is a
462462 qualified mental health c are provider. Medical and pharmaceutical

514514 treatment is not compensable for any family membe r of a deceased
515515 victim.
516516 H. Outpatient counseling expenses for a victim of criminally
517517 injurious conduct may be considered by the Board provided the
518518 counseling is focused on the crime and the counselor is a qualified
519519 mental health care provider. A total no t to exceed Three Thousand
520520 Dollars ($3,000.00) may be awarded for individual counseling
521521 sessions for victims of criminally injurious conduct. Sessions
522522 between the mental health care provider and nonoffending parents of
523523 a victimized child under eighteen (1 8) years of age may also be
524524 included in the award provided the combined total for the counseling
525525 and parental sessions do not exceed Three Thousand Dollars
526526 ($3,000.00) and the parental sessions relate to the victimization .
527527 In extreme cases, the Board may, in its discretion, waive the thr ee-
528528 thousand-dollar limit. Inpatient mental health treatment will be
529529 reviewed on a case-by-case basis and may be compensated, at the
530530 discretion of the Board, in an amount not to exceed Twe nty Thousand
531531 Dollars ($20,000.00).
532532 I. Reasonable funeral, cremation or burial expenses shall not
533533 exceed Seven Thousand Five Hundred Dollars ($7,500.00).
534534 J. Reasonable costs associated with crime sce ne cleanup shall
535535 not exceed Two Thousand Dollars ($2,000 .00).
536536 K. Loss of income of a careg iver shall not exceed Three
537537 Thousand Dollars ($3,000.00).

589589 L. Reasonable costs for vehicle impound fees are limited to
590590 violent crimes occurring in a vehicle owned by the victim of the
591591 violent crime or an eligible claimant , provided such fee is
592592 associated with the collection and security o f crime scene evidence.
593593 Reimbursement for vehicle impound fees shall not exceed Seven
594594 Hundred Fifty Dollars ($750.00).
595595 SECTION 3. This act shall become effective November 1, 2023.
