4396 Section 427.14. A. There is hereby created the medical

169268 cultivation area that is dedicated to the
170269 cultivation of flowering marijuana plants. The

175301 plants occurs. If the surface of the plant
176302 canopy consists of noncontiguous areas, each
177303 component area must be sepa rated by identifiable

181305 used in the cultivation area, the surface area of
182306 each tier or shelf must be included in
183307 calculating the area of the plant canopy .
184308 Calculation of the area of the plant canopy may
185309 not include the areas within the cultivation area
186310 that are used to cultivate immature marijuana
187311 plants and seedlings, p rior to flowering, and
188312 that are not used at any time to cultivate mature
189313 marijuana plants. If the flowering plants are
190314 vertically grown in cyli nders, the square footage
191315 of the canopy shall be measu red by the
192316 circumference of the cylinder multiplied by the
193317 total length of the cylinder,

195318 (2) “greenhouse” means a structure located outdoors

232401 concentrate, the annual fee shall be Fifteen Thousand
233402 Dollars ($15,000.00), and

235403 e. Tier 5: More than three hundred thousand one
236404 (300,001) pounds of biomass or production or use in
237405 excess of one thousand one (1,001) liters of cannabis
238406 concentrate, the annual fee shall be Twenty Thousand
239407 Dollars ($20,000.00).

241408 For purposes of this paragraph only, if the cannabis concentrate
242409 is in nonliquid form, every one thousand (1,000) grams of
243410 concentrated marijuana shall be calculated as one (1) liter of
244411 cannabis concentrate.

246412 4. The initial fee for a medical marijuana dispensary license
247413 shall be Two Thousand Five Hundred Dollars ($2,500.00). The annual,
248414 nonrefundable license fee for a medical marijuana dispensary license
249415 shall be calculated at ten percent (10%) of the sum of twelve (12)
250416 calendar months of the combined a nnual state sales tax and state
251417 excise tax of the dispensary . The minimum fee shall be not less
252418 than Two Thousand Five Hundred Dollars ($2,500.00) and the maximum
253419 fee shall not exceed Ten Thousand Dollars ($10,000.00).

255420 5. The annual, nonrefundable license fee for a medical
256421 marijuana testing laboratory shall be Twenty Thousand Dollars

259450 E. All applicants seeking licensure or licensure renewal as a
260451 medical marijuana business shall comply with the following general
261452 requirements:

263453 1. All applications for licenses and registrations authorized
264454 pursuant to this section shall be made upon forms prescribed by the
265455 Authority;

269456 2. Each application shall identify the city or county in which
270457 the applicant seeks to obtain licensure as a medical marijuana
271458 business;

273459 3. Applicants shall submit a complete application to the
274460 Authority before the application may be accepted or considered;

276461 4. All applications shall be complete and accurate in every
277462 detail;
278-
279463 5. All applications shall include all attachments or
280464 supplemental information required by the forms supplied by the
281465 Authority;

283466 6. All applications shall be accompanied by a full remittance
284467 for the whole amount of the application fees. Application fees are
285468 nonrefundable;

287469 7. All applicants shall be approved for licensing review that,
288470 at a minimum, meets the following criteria:
471+a. twenty-five (25) years of age or older,

298504 officers, partners, board members or any other form of
299505 business ownership are Oklahoma residents pursuant to
300506 paragraph 11 of this subsection,

302507 d. if applying as an individual or entity, proof that the
303508 individual or entity is registered to conduct business
304509 in the State of Oklahoma,

306510 e. disclosure of all ownership interests pursuant to the
307511 Oklahoma Medical Marijuana and Patient Protection Act,

312513 f. proof that the medical marijuana business, medical
313514 marijuana research facility, medical marijuana
314515 education facility and medical marijuana waste
315516 disposal facility applicant or licensee has not been
316517 convicted of a nonviolent felony in the last two (2)
317518 years, or any other felony conviction within the last
318519 five (5) years, is not a current inmate in the custody
319520 of the Department of Corrections, or currently
320521 incarcerated in a jail or corrections facility;

322549 8. There shall be no limit to the number of medical marijuana
323550 business licenses or categories that an individual or entity can
324551 apply for or receive, although each application and each category
325552 shall require a separate application and application fee. A
326553 commercial grower, processor and dispensary, or any combination
327554 thereof, are authorized to share the same address or physical
328555 location, subject to the restrictions set forth in the Oklahoma
329556 Medical Marijuana and Patient Protection Act;
330-
331557 9. All applicants for a medical marijuana business license,
332558 research facility license or education facility license authorized
333559 by the Oklahoma Medical Marijuana and Patient Protection Act, or for
334560 a renewal of such license, shall undergo an Oklahoma criminal
335561 history background check conducted by the Oklahoma State Bureau of
336562 Investigation (OSBI) within thirty (30) days prior to the
337563 application for the license, including:
338-
339564 a. individual applicants applying on their own behalf,
340-
341565 b. individuals applying on behalf of an entity,
342-
343566 c. all principal officers of an entity, and
344-
345567 d. all owners of an entity as defined by the Oklahoma
346568 Medical Marijuana and Patient Protection Act;
347-
348569 10. All applicable fees charged by the OSBI are the
349570 responsibility of the applicant and shall not be higher than fees
350571 charged to any other person or industry for such background checks;

352599 11. In order to be considered an Oklahoma resident for purposes
353600 of a medical marijuana business application, all applicants shall

356601 provide proof of Oklahoma residency for at least two (2) years
357602 immediately preceding the date of application or five (5) years of
358603 continuous Oklahoma residency during the preceding twenty-five (25)
359604 years immediately preceding the date of application. Sufficient
360605 documentation of proof of residency shall include a combination of
361606 the following:
362-
363607 a. an unexpired Oklahoma-issued driver license,
364-
365608 b. an Oklahoma identification card,
366-
367609 c. a utility bill preceding the date of application,
368610 excluding cellular telephone and Internet bills,
369-
370611 d. a residential property deed to property in the State
371612 of Oklahoma, and
372-
373613 e. a rental agreement preceding the date of application
374614 for residential property located in the State of
375615 Oklahoma.

377616 Applicants that were issued a medical marijuana business license
378617 prior to August 30, 2019, are hereby exempt from the two-year or
379618 five-year Oklahoma residence requirement mentioned above;
380-
381619 12. All license applicants shall be required to submit a
382620 registration with the Oklahoma State Bureau of Narcotics and
383621 Dangerous Drugs Control as provided in Sections 2-302 through 2-304
384622 of this title;

386650 13. All applicants shall establish their identity through
387651 submission of a color copy or digital image of one of the following
388652 unexpired documents:

390653 a. front of an Oklahoma driver license,

392654 b. front of an Oklahoma identification card,

394655 c. a United States passport or other photo identification
395656 issued by the United States government, or

399657 d. a tribal identification card approved for
400658 identification purposes by the Oklahoma Department of
401659 Public Safety; and

403660 14. All applicants shall submit an applicant photograph; and

405661 15. All applicants for a medical marijuana business license
406662 seeking to operate a commercial grow shall file along with their
407663 application a bond as prescribed in Section 2 of this act.

409664 F. The Authority shall review the medical marijuana business
410665 application; approve, reject or deny the application; and mail the
411666 approval, rejection, denial or status-update letter to the a pplicant
412667 within ninety (90) business days of receipt of the application.
413-
414668 G. 1. The Authority shall review the medical marijuana
415669 business applications and conduct all investigations, inspections
416670 and interviews before approving the application.

418671 2. Approved applicants shall be issued a medical marijuana
419672 business license for the specific category applied under, which

421701 letters shall provide a reason for the rejection or denial.
422702 Applications may only be rejected or denied based on the applicant
423703 not meeting the standards set forth in the provisions of the
424704 Oklahoma Medical Marijuana and Patient Protection Act and Sections
425705 420 through 426.1 of this title, improper completion of the
426706 application, or for a reason provided for in the Oklahoma Medical
427707 Marijuana and Patient Protection Act and Sections 420 through 426.1
428708 of this title. If an application is rejected for failure to provide
429709 required information, the applicant shall have thirty (30) days to
430710 submit the required information for reconsideration. No additional
431711 application fee shall be charged for such reconsideration. Unless
432712 the Authority determines otherwise, an application that has been
433713 resubmitted but is still incomplete or contains errors tha t are not
434714 clerical or typographical in nature shall be denied.

436715 3. Status-update letters shall provide a reason for delay in
437716 either approval, rejection or denial should a situation arise in
438717 which an application was submitted properly but a delay in
439718 processing the application oc curred.

443719 4. Approval, rejection, denial or status-update letters shall
444720 be sent to the applicant in the same method the application was
445721 submitted to the Authority.

447722 H. A license for a medical marijuana business, medical

449751 medical marijuana waste disposal facility shall not be issued to or
450752 held by:

452753 1. A person until all required fees have been paid;

454754 2. A person who has been convicted of a nonviolent felony
455755 within two (2) years of the date of application, or within five (5)
456756 years for any other felony;

458757 3. A corporation, if the criminal history of any of its
459758 officers, directors or stockholders indicates that the officer,
460759 director or stockholder has been convicted of a nonviolent felony
461760 within two (2) years of the date of application, or within five (5)
462761 years for any other felony;
463-
464762 4. A person under twenty-five (25) years of age;
465-
466763 5. A person licensed pursuant to this section who, during a
467764 period of licensure, or who, at the time of application, has failed
468765 to:
469-
470766 a. file taxes, interest or penalties due related to a
471767 medical marijuana business, or
472-
473768 b. pay taxes, interest or penalties due related to a
474769 medical marijuana business;
475-
476770 6. A sheriff, deputy sheriff, police officer or pros ecuting
477771 officer, or an officer or employee of the Authority or municipality;
478-
479772 7. A person whose authority to be a caregiver, as defined in
480773 Section 427.2 of this title, has been revoked by the Authority; or

501814 d. threatening or harming any medical marijuana patient,
502815 caregiver, medical practitioner or e mployee of the
503816 Authority,

505817 e. knowingly or intentionally refus ing to permit the
506818 Authority access to premises or records,

508819 f. using a prohibited, hazardous substance for processing
509820 in a residential area,

511821 g. criminal acts relating to t he operation of a medical
512822 marijuana business, or

514823 h. any violations that endanger public health and safety

517852 I. In investigating the qualifications of an applicant or a
518853 licensee, the Authority and municipalities may have access to
519854 criminal history record information furnished by a criminal justice
520855 agency subject to any restrictions imposed by such an agency.

522856 J. The failure of an applicant or licensee to provide the
523857 requested information by the Authority deadline may be grounds for
524858 denial of the application.

526859 K. All applicants and licensees shall submit information to the
527860 Authority in a full, faithful, truthful and fair manner. The
528861 Authority may recommend denial of an application where the applicant

531862 or licensee made misstatements, omissions, misrepresentations or
532863 untruths in the application or in connection with the background
533864 investigation of the applicant. This type of conduct may be grounds
534865 for administrative action against the applicant or licensee. Typos
535866 and scrivener errors shall not be grounds for denial.

537867 L. A licensed medical marijuana business premises shall be
538868 subject to and responsible for compliance with applicable provisions
539869 consistent with the zoning where such business is located as
540870 described in the most recent versions of the Oklahoma Uniform
541871 Building Code, the International Building Code and the International
542872 Fire Code, unless granted an exemption by a municipality or
543873 appropriate code enforcement entity.

547903 waste disposal facility licensees shall pay the relevant licensure
548904 fees prior to receiving licensure to operate.

550905 N. A medical marijuana business, medical marijuana rese arch
551906 facility, medical marijuana education facility or med ical marijuana
552907 waste disposal facility that attempts to renew its license after the
553908 expiration date of the license shall pay a late renewal fee in an
554909 amount to be determined by the Authority to reinstate the license.
555910 Late renewal fees are nonrefundable. A license that has been
556911 expired for more than ninety (90) days shall not be renewed.

558912 O. No medical marijuana business, medical marijuana research
559913 facility, medical marijuana education facility or medical marijuana
560914 waste disposal facility shall possess, sell or transfer medical
561915 marijuana or medical marijuana products without a valid, unexpired
562916 license issued by the Authority.

564917 SECTION 2. NEW LAW A new section of law to be codified
565918 in the Oklahoma Statu tes as Section 427.26 of Title 63, unless there
566919 is created a duplication in numbering, reads as follows:

568920 A. It shall be unlawful for any holder of a medical marijuana
569921 business license pursuant to Section 427.14 of Title 63 of the
570922 Oklahoma Statutes to engage in any commercial growing operations in
571923 this state without acquiring a bond. The bond shall cover that area

577953 B. Every applicant for a commercial grower license or
578954 commercial grower licensee shall file with the Oklahoma Medical
579955 Marijuana Authority a bond satisfactory to the Authority and in the
580956 amount no less than Fifty Thousand Dollars ($50,000.00) for each
581957 license sought or held, with a surety company qualified to do
582958 business in this state as a surety. The bond shall be fur nished to
583959 the state for the use of the state pursuant to the provisions of
584960 this act. The bond shall be conditional that the obligor will
585961 comply with the provision s of this act including, but not lim ited
586962 to, building codes, administrative rules, and other relevant laws,
587963 and all rules and regulations made pursuant to this act and will pay
588964 all amounts of money that may be due to the state during the time
589965 such bond is in effect.

591966 C. The Authority or the Department of Environmental Quality may
592967 require a higher amount depending upon the reclamation requirements
593968 of the approved application . The amount shall reflect the probable
594969 difficulty of reclamation with consideration for such factors
595970 including, but not limited to, topography, hydrology, and
596971 revegetation potential. The amount of the bond for a commercial
597972 growing operation shall be sufficient to assure the completion of
598973 the reclamation plan if the work has to be performed by the
599974 Authority or the Department of Environmental Quality in the event of
600975 revocation of license.

6021003 D. An appropriate agency may recall the bond if the property
6031004 has been abandoned, the Authority revokes the commercial growing
6041005 operation’s license, or in response to receiving notice of a
6051006 violation of any law, regulation, policy, or ordinance nec essitating
6061007 remedial action. The bond shall be used to d efray the cost of
6071008 restoration of the prop erty including, but not limited to, removing
6081009 equipment, destruction of waste, remediation of en vironmental
6091010 hazards, prohibiting public access, addressing improperly coded
6101011 buildings, or determination of the final disposition of any sei zed
6111012 property.

6131013 E. A holder of a medical marijuana business license pursuant to
6141014 Section 427.14 of Title 63 of the Oklahoma Statutes engaging in a
6151015 commercial growing operation may ope rate without obtaining a bond

6241021 of the public peace, health or safety, an emergency is hereby
6251022 declared to exist, by reason whereof this act shall take effect and
