77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKL AHOMA:
78	78		SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
79	79		last amended by Section 2, Chapter 208, O.S.L. 2022 (29 O.S. Supp.
80	80		2022, Section 4-112), is amended to read as follows :
81	81		Section 4-112. A. Except as otherwise provided for in the
82	82		Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
83	83		Act, no person may hunt, pursue, trap, harass , catch, kill, take o r
84	84		attempt to take in any manner, use, have in possession, sell, or
85	85		transport all or any portion of any wildlife except fish, without
86	86		having first procure d a license from the Department of Wildlife
87	87		Conservation. The Oklahoma Wildlife Conservation Commissio n shall
88	88		designate a consecutive Saturday and Sunday in September of each

140	140		year as free hunting days in which res idents of this state may hunt
141	141		without first procuring a hunting license pursuant to the provisions
142	142		of this section.
143	143		B. The following legal residents of Oklahoma shall be exempt
144	144		from the annual hunting license requirement of paragraph 1 of
145	145		subsection E of this section and the following nonresiden ts shall be
146	146		exempt from the annual nonresid ent hunting licenses required
147	147		pursuant to paragraph 1 of subsection C of this section:
148	148		1. Legal residents under sixteen (16) years of age;
149	149		2. Legal residents sixty -five (65) years of age or older
150	150		provided they have obtained a senio r citizen lifetime hunt ing or
151	151		combination hunting and fishing l icense pursuant to th e provisions
152	152		of Section 4-114 of this title;
153	153		3. Legal residents born on or before January 1, 1923;
154	154		4. Legal resident veterans having a disability of sixty percent
155	155		(60%) or more and registered w ith the veterans registry created by
156	156		the Oklahoma Department of Veterans Affairs; provided, that if the
157	157		veteran has previously received an exemption pursuant to this
158	158		paragraph, no registration with the veteran s registry shall be
159	159		required;
160	160		5. Legal resident owners or tenants who hunt on land own ed or
161	161		leased by them;
162	162		6. Any nonresident under fourteen (14) years of age;

214	214		7. Legal residents having a proven disability which ren ders
215	215		them nonambulatory and confines them to a wheelchair, as certified
216	216		by a physician licensed in this state or in any stat e which borders
217	217		this state;
218	218		8. Any legal resident or nonresident under eighteen (18) years
219	219		of age who is in the physical custody of a child care facility as
220	220		defined by Section 402 of Title 10 of the Oklahoma Statute s; and
221	221		9. Any legal resident or nonresi dent hunting, pursuin g,
222	222		trapping, harassing, catching, killing, taking, or attempting to
223	223		take in any manner any species of rattlesna ke during an organized
224	224		rattlesnake-hunting event or festival and who has a rattlesna ke
225	225		permit issued pursuant to Section 4 -143 of this title.
226	226		C. Except as otherwise provided for in the Oklahoma Wildlife
227	227		Conservation Code, the nonresident hunting licenses issued pursuant
228	228		to this section and the fee for each license shall be:
229	229		1. Annual hunting license for nonresidents huntin g game other
230	230		than deer, antelope, elk or bear which expire s one (1) year after
231	231		the date of issuance – One Hundred Seventy-five Dollars ($175.00).
232	232		Nonresidents hunting big game or combi nation big game and upland
233	233		game in a commercial hunting area shall be r equired to have this
234	234		license;
235	235		2. Gun hunting license for deer for nonresidents which shall be
236	236		valid for hunting all deer allowed during the current calendar year

295	295		4. Primitive firearms hunting lic ense for deer for nonresidents
296	296		which shall be valid for hunting all deer a llowed during the current
297	297		calendar year deer primitive firearms season – Two Hundred Seventy-
298	298		nine Dollars ($279.00) Four Hundred Twenty-three Dollars ($423.00);
299	299		5. Hunting license for antelope for nonresidents – Three
300	300		Hundred Five Dollars ($305.00) Four Hundred Twenty-three Dollars
301	301		($423.00);
302	302		6. Hunting license for elk for nonresident s – Three Hundred
303	303		Five Dollars ($305.00) Four Hundred Twenty-three Dollars ($423.00);
304	304		7. Five-day hunting license for nonresidents hunting game other
305	305		than deer, antelope, elk, quail, turkey or bear – Seventy-four
306	306		Dollars ($74.00). Nonresidents hunting big game or combination big
307	307		game and upland game in a commercial hunting area shall be required
308	308		to have this license; and
309	309		8. Ten-day hunting license for non residents hunting small game
310	310		in a commercial hunting area – Five Dollars ($5.00).

362	362		D. Of the fees collected pursuant to the provisions of
363	363		subsection C of this section:
364	364		1. Five Dollars ($5. 00) of the license fee of each license
365	365		issued pursuant to paragraph s 1 through 7 of subsection C of this
366	366		section and Two Dollars and fifty cents ($2.50) of the license fee
367	367		for each license issued pursuant to paragraph 8 of subsection C of
368	368		this section shall be deposited in the Wildlife Land Acquisition
369	369		Fund created pursuant to the provisions of Section 4 -132 of this
370	370		title; and
371	371		2. Five Dollars ($5.00) of the license fee for ea ch license
372	372		issued pursuant to paragraphs 1 through 8 of subsection C of this
373	373		section shall be for the Oklahoma Wildlife Land Stamp and shall be
374	374		deposited in the Oklahoma Wildlife Land Fund created pursuant to the
375	375		provisions of Section 4-141 of this title.
376	376		E. Except as otherwise provided, the annual resident hunting
377	377		licenses issued purs uant to this subsection shall expire one (1)
378	378		year after the date of issuance. The resident hunting licenses
379	379		issued pursuant to thi s section and the fee for each license shal l
380	380		be:
381	381		1. Annual hunting license for residents eighteen (18) years of
382	382		age and older – Thirty-one Dollars ($31.00) ;
383	383		2. Annual hunting license for residents sixteen (16) or
384	384		seventeen (17) years of age – Six Dollars ($6.00);

437	437		commercial hunting area - Five Dollars ($5.00);
438	438		4. Five-year disability hunting license for residents for at
439	439		least six (6) months who a re receiving Social Security Disability
440	440		benefits, Supplemental Security Income benefits or disability
441	441		benefits under the Railroad Retirement Act, 45 U.S. C.A., Section
442	442		231a, or residents who are one-hundred-percent disabled and are
443	443		receiving disability paym ents from the Multiple Injury Trust Fund
444	444		pursuant to Section 31 of Title 85A of the Oklahom a Statutes - Ten
445	445		Dollars ($10.00);
446	446		5. Gun hunting license for deer for residents eighteen (18)
447	447		years of age or older - Nineteen Dollars ($19.00). The following
448	448		persons shall be exempt:
449	449		a. residents with proper certification from the United
450	450		States Department of Veterans Affairs or its
451	451		successor, certifying that the person is a disabled
452	452		veteran in receipt of compensation at the one-hundred-
453	453		percent rate and register ed with the veterans registry
454	454		created by the Oklahoma Department of Veterans
455	455		Affairs; provided, that if the veteran has previously
456	456		received an exemption pur suant to this subparagraph,
457	457		no registration with the veterans registry shall be
458	458		required, and

532	532		eighteen (18) years of age or older - Nineteen Dollars ($19.00).

602	602		license;

659	659		for residents - Nineteen Dollars ($19.00). The following persons
660	660		shall be exempt:
661	661		a. residents with proper certification from th e United
662	662		States Department of Veterans Affairs or i ts
663	663		successor, certifying that the person is a disabled
664	664		veteran in receipt of compensation at the one-hundred-
665	665		percent rate and registered with the veterans registry
666	666		created by the Oklahoma Department of Vet erans
667	667		Affairs; provided, that if the veteran has pr eviously
668	668		received the exemption pursuant to this subparagraph ,
669	669		no registration with the vete rans registry shall be
670	670		required, and
671	671		b. residents hunting in big game or combination big game
672	672		and upland game commercial hunting areas.
673	673		F. Of the fees collected pursuant to the provisions of
674	674		paragraph 1 of subsection E of this section, Five Dollars ($5.00 ) of
675	675		the license fee shall be for the Oklahoma Wildlife Land Stamp and
676	676		shall be deposited in the Oklahoma Wildlif e Land Fund created
677	677		pursuant to the provisions of Section 4-141 of this title.
678	678		G. The provisions of this section shall not be construed to
679	679		require a hunting license, resident or nonresident, of any person
680	680		merely because the person participates, as owner o r handler of an
681	681		entry, as an official, or as a spectator in the conduct of a field

733	733		trial or performance test of dogs, whether a resident or non resident
734	734		of this state. No license to hunt shall be required of any person
735	735		engaged in training or working dogs, provided that person is in no
736	736		way engaged in hunting and does not take or attempt to take in any
737	737		manner any game.
738	738		H. 1. Any person arrested f or hunting game other than deer,
739	739		antelope, elk, bear or turkey without a valid hunting licens e as
740	740		required by the provisions of subsectio n A of this section may
741	741		purchase a substitute temporary thirty-day license from the
742	742		arresting game warden in lieu of po sting bond. Proof of hunter
743	743		safety certification will not be required for the temporary
744	744		substitute license. The fee for a substitute li cense purchased
745	745		pursuant to the provisions of this subsection shall be:
746	746		a. for legal residents, Fifty Dollars ($50.00), and
747	747		b. for nonresidents, One Hundred Forty-five Dollars
748	748		($145.00).
749	749		2. Except as otherwise p rovided for by this subsection, the
750	750		fees from licenses purchased pursuant to the provisions of this
751	751		subsection shall be deposited in the Wildlife Conservation Fund to
752	752		be used exclusively for developing, managing, preserving, and
753	753		protecting wildlife and wil dlife habitat.
754	754		I. Any person producing proo f in court that a current hunting
755	755		license issued by the Department of Wildlife Conservation to that
756	756		person was in force at the time of the alleged offense shall be

808	808		entitled to dismissal of a charge of violating t his section upon
809	809		payment of court costs. If proof of a current hunting license
810	810		issued by the Department to the person that was in force at the time
811	811		of the alleged offense is presented to the court or district
812	812		attorney within seventy-two (72) hours after t he violation, the
813	813		charge shall be dismissed without payment of court costs.
814	814		J. Unless a substitute license is purchased as provided for by
815	815		subsection H of this section, any resident convicted of violating
816	816		the provisions of this section shall be punished b y the imposition
817	817		of a fine of not less than Twenty-five Dollars ($25.00) nor more
818	818		than Two Hundred Dollars ($200.00), or by imprisonment in the county
819	819		jail for a period not to exceed thirty (30) days, or by both.
820	820		K. Unless a substitute license is purchase d as provided for by
821	821		subsection H of this section, any nonresident convicted of violating
822	822		the provisions of this section shall be punished by the imposition
823	823		of a fine of not less than Two Hundred Dollars ($200.00) nor more
824	824		than Five Hundred Dollars ($500.0 0), or by imprisonment in the
825	825		county jail for a period not to exceed six (6) months, or by both.
826	826		L. The Oklahoma Wildlife Conservation Commission shall
827	827		promulgate any rules necessary to implement the provisions of this
828	828		section.

883	883		Wildlife Conservation Code, no person may hunt or take any wa terfowl
884	884		during the open season on waterfowl unless the person has first
885	885		obtained an Oklahoma waterfowl hunting stamp or license from the
886	886		Director or authorized agents of the Director. Each person shall
887	887		have the stamp or license in their possession when hu nting or taking
888	888		any waterfowl. When a stamp is purchased, the st amp shall be
889	889		validated by the signature of the licensee written across the face
890	890		of the stamp.
891	891		B. Persons excepted from the Oklahoma waterfowl hunting stamp
892	892		or license requirement of this sec tion are:
893	893		1. Legal residents of Oklahoma under sixteen (16) year s of age;
894	894		and
895	895		2. Legal residents of Oklahoma sixty -five (65) years of age or
896	896		older.
897	897		C. 1. The Oklahoma waterfowl hunting stamp fee and waterfowl
898	898		license shall each be Nine Dollars ($9.00) for residents and Thirty
899	899		Dollars ($30.00) for nonresidents . The remainder of the fee shall
900	900		be deposited in the Wildlife Con servation Fund, to be used
901	901		exclusively in the State of Oklahoma, for the purpose of developing,
902	902		managing, preserving, restoring and maintaining wetland habitats and
903	903		for the conservation and management of waterfowl and ecologically
904	904		related species.

956	956		2. The collection and remittance procedures applicable to
957	957		hunting license fees under this title shall apply to waterfowl stamp
958	958		or license fees.
959	959		3. The waterfowl stamp or license issued pursuant to this
960	960		section shall expire on June 30 of each year.
961	961		D. The Oklahoma Wildlife Conservation Commission may prescribe,
962	962		by regulation, the form, design and manner of issuance, if any, of
963	963		the waterfowl stamp, which could include the selection of art for
964	964		such stamp from an art contest regulated by the Commission.
965	965		E. 1. Any person arrested for hunting or taking any waterfowl
966	966		during the open season on waterfowl without a valid Oklahoma
967	967		waterfowl hunting stamp or license as required by the provisions of
968	968		subsection A of this section may purchase a substitute temporary
969	969		thirty-day stamp or license from the arresting game warden in lieu
970	970		of posting bond. Proof of hunter safety certification shall not be
971	971		required for the temporary substitute stamp or license. The fee for
972	972		a substitute stamp or license purchased pursuant to the provis ions
973	973		of this subsection shall be:
974	974		a. for legal residents – Fifty Dollars ($50.00), and
975	975		b. for nonresidents – One Hundred Forty-five Dollars
976	976		($145.00).
977	977		2. The fees from the temporary stamp and license purchased
978	978		pursuant to the provisions of this subsection shall be deposited in
979	979		the Wildlife Conservation Fund, to be used exclusively in the State

1034	1034		F. Any person convicted of violating any of the provisions of
1035	1035		this section shall be punished by a fi ne of not less than Twenty-
1036	1036		five Dollars ($25.00) nor more than One Hu ndred Dollars ($100.00).
1037	1037		G. Nothing in this title shal l prohibit a person from hunting
1038	1038		waterfowl exclusively on their own property without an Oklahoma
1039	1039		waterfowl hunting stamp or license.
1040	1040		SECTION 3. AMENDATORY 29 O.S. 2021, Secti on 4-144, is
1041	1041		amended to read as follows:
1042	1042		Section 4-144. A. No person may hunt or take black bear
1043	1043		without having first procured a license from the Director of
1044	1044		Wildlife Conservation or an agent of the Director.
1045	1045		B. The Wildlife Conservation Commission shall decide the open
1046	1046		season, the bag limits, and territorial limitations for hunting or
1047	1047		taking black bear.
1048	1048		C. The fees for a license issued pursuant to this section shall
1049	1049		be:
1050	1050		1. For legal residents, One Hundred Dollars ($100.00); and
1051	1051		2. For nonresidents, Five Hundred Dollars ($500.00) Six Hundred
1052	1052		Twenty-three Dollars ($623.00) .
1053	1053		D. Any person who fails to obtain a license as required in
1054	1054		subsection A of this section and pay the fee as requir ed in

1112	1112		subsection A of this section and pay the fee as required in
1113	1113		paragraph 2 of subsection C of this section, upon conviction, shall
1114	1114		be punished by a fine of not less than Eight Hundred Dollars
1115	1115		($800.00) nor more than One Thousand Dollars ($1,000.00) or by
1116	1116		imprisonment in the county jail for a period not to exceed six (6)
1117	1117		months, or by both said fine and imprisonment.
1118	1118		SECTION 4. This act shall become ef fective November 1, 2023.
