7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKL AHOMA:
7878 SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
7979 last amended by Section 2, Chapter 208, O.S.L. 2022 (29 O.S. Supp.
8080 2022, Section 4-112), is amended to read as follows :
8181 Section 4-112. A. Except as otherwise provided for in the
8282 Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
8383 Act, no person may hunt, pursue, trap, harass , catch, kill, take o r
8484 attempt to take in any manner, use, have in possession, sell, or
8585 transport all or any portion of any wildlife except fish, without
8686 having first procure d a license from the Department of Wildlife
8787 Conservation. The Oklahoma Wildlife Conservation Commissio n shall
8888 designate a consecutive Saturday and Sunday in September of each

141141 without first procuring a hunting license pursuant to the provisions
142142 of this section.
143143 B. The following legal residents of Oklahoma shall be exempt
144144 from the annual hunting license requirement of paragraph 1 of
145145 subsection E of this section and the following nonresiden ts shall be
146146 exempt from the annual nonresid ent hunting licenses required
147147 pursuant to paragraph 1 of subsection C of this section:
148148 1. Legal residents under sixteen (16) years of age;
149149 2. Legal residents sixty -five (65) years of age or older
150150 provided they have obtained a senio r citizen lifetime hunt ing or
151151 combination hunting and fishing l icense pursuant to th e provisions
152152 of Section 4-114 of this title;
153153 3. Legal residents born on or before January 1, 1923;
154154 4. Legal resident veterans having a disability of sixty percent
155155 (60%) or more and registered w ith the veterans registry created by
156156 the Oklahoma Department of Veterans Affairs; provided, that if the
157157 veteran has previously received an exemption pursuant to this
158158 paragraph, no registration with the veteran s registry shall be
159159 required;
160160 5. Legal resident owners or tenants who hunt on land own ed or
161161 leased by them;
162162 6. Any nonresident under fourteen (14) years of age;

214214 7. Legal residents having a proven disability which ren ders
215215 them nonambulatory and confines them to a wheelchair, as certified
216216 by a physician licensed in this state or in any stat e which borders
217217 this state;
218218 8. Any legal resident or nonresident under eighteen (18) years
219219 of age who is in the physical custody of a child care facility as
220220 defined by Section 402 of Title 10 of the Oklahoma Statute s; and
221221 9. Any legal resident or nonresi dent hunting, pursuin g,
222222 trapping, harassing, catching, killing, taking, or attempting to
223223 take in any manner any species of rattlesna ke during an organized
224224 rattlesnake-hunting event or festival and who has a rattlesna ke
225225 permit issued pursuant to Section 4 -143 of this title.
226226 C. Except as otherwise provided for in the Oklahoma Wildlife
227227 Conservation Code, the nonresident hunting licenses issued pursuant
228228 to this section and the fee for each license shall be:
229229 1. Annual hunting license for nonresidents huntin g game other
230230 than deer, antelope, elk or bear which expire s one (1) year after
231231 the date of issuance – One Hundred Seventy-five Dollars ($175.00).
232232 Nonresidents hunting big game or combi nation big game and upland
233233 game in a commercial hunting area shall be r equired to have this
234234 license;
235235 2. Gun hunting license for deer for nonresidents which shall be
236236 valid for hunting all deer allowed during the current calendar year

302302 6. Hunting license for elk for nonresident s – Three Hundred
303303 Five Dollars ($305.00) Four Hundred Twenty-three Dollars ($423.00);
304304 7. Five-day hunting license for nonresidents hunting game other
305305 than deer, antelope, elk, quail, turkey or bear – Seventy-four
306306 Dollars ($74.00). Nonresidents hunting big game or combination big
307307 game and upland game in a commercial hunting area shall be required
308308 to have this license; and
309309 8. Ten-day hunting license for non residents hunting small game
310310 in a commercial hunting area – Five Dollars ($5.00).

362362 D. Of the fees collected pursuant to the provisions of
363363 subsection C of this section:
364364 1. Five Dollars ($5. 00) of the license fee of each license
365365 issued pursuant to paragraph s 1 through 7 of subsection C of this
366366 section and Two Dollars and fifty cents ($2.50) of the license fee
367367 for each license issued pursuant to paragraph 8 of subsection C of
368368 this section shall be deposited in the Wildlife Land Acquisition
369369 Fund created pursuant to the provisions of Section 4 -132 of this
370370 title; and
371371 2. Five Dollars ($5.00) of the license fee for ea ch license
372372 issued pursuant to paragraphs 1 through 8 of subsection C of this
373373 section shall be for the Oklahoma Wildlife Land Stamp and shall be
374374 deposited in the Oklahoma Wildlife Land Fund created pursuant to the
375375 provisions of Section 4-141 of this title.
376376 E. Except as otherwise provided, the annual resident hunting
377377 licenses issued purs uant to this subsection shall expire one (1)
378378 year after the date of issuance. The resident hunting licenses
379379 issued pursuant to thi s section and the fee for each license shal l
380380 be:
381381 1. Annual hunting license for residents eighteen (18) years of
382382 age and older – Thirty-one Dollars ($31.00) ;
383383 2. Annual hunting license for residents sixteen (16) or
384384 seventeen (17) years of age – Six Dollars ($6.00);

436436 3. Ten-day hunting license for residents for small game in a
437437 commercial hunting area - Five Dollars ($5.00);
438438 4. Five-year disability hunting license for residents for at
439439 least six (6) months who a re receiving Social Security Disability
440440 benefits, Supplemental Security Income benefits or disability
441441 benefits under the Railroad Retirement Act, 45 U.S. C.A., Section
442442 231a, or residents who are one-hundred-percent disabled and are
443443 receiving disability paym ents from the Multiple Injury Trust Fund
444444 pursuant to Section 31 of Title 85A of the Oklahom a Statutes - Ten
445445 Dollars ($10.00);
446446 5. Gun hunting license for deer for residents eighteen (18)
447447 years of age or older - Nineteen Dollars ($19.00). The following
448448 persons shall be exempt:
449449 a. residents with proper certification from the United
450450 States Department of Veterans Affairs or its
451451 successor, certifying that the person is a disabled
452452 veteran in receipt of compensation at the one-hundred-
453453 percent rate and register ed with the veterans registry
454454 created by the Oklahoma Department of Veterans
455455 Affairs; provided, that if the veteran has previously
456456 received an exemption pur suant to this subparagraph,
457457 no registration with the veterans registry shall be

659659 for residents - Nineteen Dollars ($19.00). The following persons
660660 shall be exempt:
661661 a. residents with proper certification from th e United
662662 States Department of Veterans Affairs or i ts
663663 successor, certifying that the person is a disabled
664664 veteran in receipt of compensation at the one-hundred-
665665 percent rate and registered with the veterans registry
666666 created by the Oklahoma Department of Vet erans
667667 Affairs; provided, that if the veteran has pr eviously
668668 received the exemption pursuant to this subparagraph ,
669669 no registration with the vete rans registry shall be

671671 b. residents hunting in big game or combination big game
672672 and upland game commercial hunting areas.
673673 F. Of the fees collected pursuant to the provisions of
674674 paragraph 1 of subsection E of this section, Five Dollars ($5.00 ) of
675675 the license fee shall be for the Oklahoma Wildlife Land Stamp and
676676 shall be deposited in the Oklahoma Wildlif e Land Fund created
677677 pursuant to the provisions of Section 4-141 of this title.
678678 G. The provisions of this section shall not be construed to
679679 require a hunting license, resident or nonresident, of any person
680680 merely because the person participates, as owner o r handler of an
681681 entry, as an official, or as a spectator in the conduct of a field

733733 trial or performance test of dogs, whether a resident or non resident
734734 of this state. No license to hunt shall be required of any person
735735 engaged in training or working dogs, provided that person is in no
736736 way engaged in hunting and does not take or attempt to take in any
737737 manner any game.
738738 H. 1. Any person arrested f or hunting game other than deer,
739739 antelope, elk, bear or turkey without a valid hunting licens e as
740740 required by the provisions of subsectio n A of this section may
741741 purchase a substitute temporary thirty-day license from the
742742 arresting game warden in lieu of po sting bond. Proof of hunter
743743 safety certification will not be required for the temporary
744744 substitute license. The fee for a substitute li cense purchased
745745 pursuant to the provisions of this subsection shall be:
746746 a. for legal residents, Fifty Dollars ($50.00), and
747747 b. for nonresidents, One Hundred Forty-five Dollars
748748 ($145.00).
749749 2. Except as otherwise p rovided for by this subsection, the
750750 fees from licenses purchased pursuant to the provisions of this
751751 subsection shall be deposited in the Wildlife Conservation Fund to
752752 be used exclusively for developing, managing, preserving, and
753753 protecting wildlife and wil dlife habitat.
754754 I. Any person producing proo f in court that a current hunting
755755 license issued by the Department of Wildlife Conservation to that
756756 person was in force at the time of the alleged offense shall be

808808 entitled to dismissal of a charge of violating t his section upon
809809 payment of court costs. If proof of a current hunting license
810810 issued by the Department to the person that was in force at the time
811811 of the alleged offense is presented to the court or district
812812 attorney within seventy-two (72) hours after t he violation, the
813813 charge shall be dismissed without payment of court costs.
814814 J. Unless a substitute license is purchased as provided for by
815815 subsection H of this section, any resident convicted of violating
816816 the provisions of this section shall be punished b y the imposition
817817 of a fine of not less than Twenty-five Dollars ($25.00) nor more
818818 than Two Hundred Dollars ($200.00), or by imprisonment in the county
819819 jail for a period not to exceed thirty (30) days, or by both.
820820 K. Unless a substitute license is purchase d as provided for by
821821 subsection H of this section, any nonresident convicted of violating
822822 the provisions of this section shall be punished by the imposition
823823 of a fine of not less than Two Hundred Dollars ($200.00) nor more
824824 than Five Hundred Dollars ($500.0 0), or by imprisonment in the
825825 county jail for a period not to exceed six (6) months, or by both.
826826 L. The Oklahoma Wildlife Conservation Commission shall
827827 promulgate any rules necessary to implement the provisions of this
828828 section.
829829 SECTION 2. AMENDATORY 29 O.S. 2021, Section 4-130, is

882882 Section 4-130. A. Except as otherwise provided in the Oklahoma
883883 Wildlife Conservation Code, no person may hunt or take any wa terfowl
884884 during the open season on waterfowl unless the person has first
885885 obtained an Oklahoma waterfowl hunting stamp or license from the
886886 Director or authorized agents of the Director. Each person shall
887887 have the stamp or license in their possession when hu nting or taking
888888 any waterfowl. When a stamp is purchased, the st amp shall be
889889 validated by the signature of the licensee written across the face
890890 of the stamp.
891891 B. Persons excepted from the Oklahoma waterfowl hunting stamp
892892 or license requirement of this sec tion are:
893893 1. Legal residents of Oklahoma under sixteen (16) year s of age;
894894 and
895895 2. Legal residents of Oklahoma sixty -five (65) years of age or
896896 older.
897897 C. 1. The Oklahoma waterfowl hunting stamp fee and waterfowl
898898 license shall each be Nine Dollars ($9.00) for residents and Thirty
899899 Dollars ($30.00) for nonresidents . The remainder of the fee shall
900900 be deposited in the Wildlife Con servation Fund, to be used
901901 exclusively in the State of Oklahoma, for the purpose of developing,
902902 managing, preserving, restoring and maintaining wetland habitats and
903903 for the conservation and management of waterfowl and ecologically
904904 related species.

956956 2. The collection and remittance procedures applicable to
957957 hunting license fees under this title shall apply to waterfowl stamp
958958 or license fees.
959959 3. The waterfowl stamp or license issued pursuant to this
960960 section shall expire on June 30 of each year.
961961 D. The Oklahoma Wildlife Conservation Commission may prescribe,
962962 by regulation, the form, design and manner of issuance, if any, of
963963 the waterfowl stamp, which could include the selection of art for
964964 such stamp from an art contest regulated by the Commission.
965965 E. 1. Any person arrested for hunting or taking any waterfowl
966966 during the open season on waterfowl without a valid Oklahoma
967967 waterfowl hunting stamp or license as required by the provisions of
968968 subsection A of this section may purchase a substitute temporary
969969 thirty-day stamp or license from the arresting game warden in lieu

975975 b. for nonresidents – One Hundred Forty-five Dollars
976976 ($145.00).
977977 2. The fees from the temporary stamp and license purchased
978978 pursuant to the provisions of this subsection shall be deposited in
979979 the Wildlife Conservation Fund, to be used exclusively in the State

10341034 F. Any person convicted of violating any of the provisions of
10351035 this section shall be punished by a fi ne of not less than Twenty-
10361036 five Dollars ($25.00) nor more than One Hu ndred Dollars ($100.00).
10371037 G. Nothing in this title shal l prohibit a person from hunting
10381038 waterfowl exclusively on their own property without an Oklahoma
10391039 waterfowl hunting stamp or license.
10401040 SECTION 3. AMENDATORY 29 O.S. 2021, Secti on 4-144, is
10411041 amended to read as follows:
10421042 Section 4-144. A. No person may hunt or take black bear
10431043 without having first procured a license from the Director of
10441044 Wildlife Conservation or an agent of the Director.
10451045 B. The Wildlife Conservation Commission shall decide the open
10461046 season, the bag limits, and territorial limitations for hunting or
10471047 taking black bear.
10481048 C. The fees for a license issued pursuant to this section shall
10491049 be:
10501050 1. For legal residents, One Hundred Dollars ($100.00); and
10511051 2. For nonresidents, Five Hundred Dollars ($500.00) Six Hundred
10521052 Twenty-three Dollars ($623.00) .
10531053 D. Any person who fails to obtain a license as required in
10541054 subsection A of this section and pay the fee as requir ed in

11181118 SECTION 4. This act shall become ef fective November 1, 2023.
