85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. AMENDATORY 70 O .S. 2021, Section 24 -157, is
87	87	amended to read as fol lows:
88	88	Section 24-157. A. 1. No enrolled student of an institution
89	89	of higher education within The Oklahoma State System of Higher
90	90	Education shall be required to engag e in any form of mandatory
91	91	gender or sexual diversity training or counseling; provided,
92	92	voluntary counseling shall not be prohibite d. Any orientation or

144	144	requirement that presents any form of race or sex stereotyping or a
145	145	bias on the basis of race or sex s hall be prohibited.
146	146	2. Pursuant to the provisions of the Administrative Procedures
147	147	Act, the Oklahoma State Regents for Higher Edu cation shall
148	148	promulgate rules, subject to approval by the Legislature, to
149	149	implement the provisions of this subsection.
150	150	B. The provisions of this subsection shall not prohibit the
151	151	teaching of concepts that align to the Oklahoma Academic Standards.
152	152	1. No teacher, administrator , or other employee of a school
153	153	district, charter school , or virtual charter school shall require or
154	154	make part of a course, nor shall a school district, charter school,
155	155	or virtual charter school compel a teacher, administrator, or other
156	156	employee to adopt, adhere to, or profess, the following concepts:
157	157	a. one race, ethnicity, national origin, or sex is
158	158	inherently superior to another race, ethnicity,
159	159	national origin, or sex,
160	160	b. an individual, by virtue of his or her race ,
161	161	ethnicity, national origin, or sex, is inherently
162	162	racist, sexist, or oppressive, whether consci ously or
163	163	unconsciously,
164	164	c. an individual should be discriminated against or
165	165	receive adverse treatment solely or partly because of
166	166	his or her race, ethnicity, national origin, or sex,

222	222	e. an individual’s moral character is nece ssarily
223	223	determined by his or her race , ethnicity, national
224	224	origin, or sex,
225	225	f. an individual, by virtue of his or her race,
226	226	ethnicity, national origin, or sex, bears
227	227	responsibility for actions committed in the past by
228	228	other members of the same race , ethnicity, national
229	229	origin, or sex,
230	230	g. any individual should feel discomfort, guilt, anguish ,
231	231	or any other form of psychological distress on account
232	232	of his or her race, ethnicity, national origin, or
233	233	sex, or
234	234	h. meritocracy or traits such as a hard work ethic are
235	235	racist or, sexist, oppressive, or were created by
236	236	members of a particular race , ethnicity, national
237	237	origin, or sex to oppress members of another race ,
238	238	ethnicity, national origin, or sex.
239	239	2. No teacher, administrator, or other employee of a school
240	240	district, charter school, or virtual charter school shall be
241	241	compelled to participate in instruction, professional development,

295	295	3. No school district, charter school, or virtual charter
296	296	school employee shall organiz e, participate in, or carry out any act
297	297	or communication that may violate the p rovisions of this subsection
298	298	while acting in the course of his or her official duties.
299	299	4. The State Board of Education shall promulgate rules, subject
300	300	to approval by the Legislature, to implement the provisions of this
301	301	subsection.
302	302	C. No school district, charter scho ol, or virtual charter
303	303	school shall make distinctions or classifications of students b ased
304	304	on race, ethnicity, national origin, or sex.
305	305	D. No school district, charter school, or virtual charter
306	306	school shall compel a student, teacher, administrator , or other
307	307	school employee to discuss public policy issues of the day without
308	308	the consent of the student, teacher, administrator, or other school
309	309	employee or the written consent of the student ’s parent or legal
310	310	guardian if the student is under age eighteen (18). Provided,
311	311	however, that the provisions of this subsect ion shall not be
312	312	construed to prohibit students, teachers, administrator s, or other
313	313	school employees from discussing public policy issues of the day or
314	314	ideas that individuals may find unwelcome, di sagreeable, or
315	315	offensive.

367	367	E. Upon a finding of noncomplian ce with the provisions of
368	368	subsections B, C, or D of this section by the State Board of
369	369	Education, the noncomplian t school district, charter school, or
370	370	virtual charter school sh all be ineligible to receive state funding
371	371	for the fiscal years following the ye ar of noncompliance.
372	372	F. School district, charter school, and virtual charter school
373	373	teachers, administrators, other school employees, and students or
374	374	parents or legal guardians of students under the age of eighteen
375	375	(18) enrolled in a school district, char ter school, or virtual
376	376	charter school may:
377	377	1. Seek relief for a violation of this sectio n through the
378	378	United States Departm ent of Education Office for Civil Rights; or
379	379	2. Have a cause of action for injunctive relief, damages, and
380	380	any other relief permitte d by law against the school district,
381	381	charter school, or virtual charter school.
382	382	SECTION 2. This act shall become effective July 1, 2023.
383	383	SECTION 3. It being immediately necessary for the preservation
384	384	of the public peace, health, or safety, an emergency is he reby
385	385	declared to exist, by reason whereof thi s act shall take effect and
386	386	be in full force from and after its passage and approval.
