8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 70 O .S. 2021, Section 24 -157, is
8787 amended to read as fol lows:
8888 Section 24-157. A. 1. No enrolled student of an institution
8989 of higher education within The Oklahoma State System of Higher
9090 Education shall be required to engag e in any form of mandatory
9191 gender or sexual diversity training or counseling; provided,

144144 requirement that presents any form of race or sex stereotyping or a
145145 bias on the basis of race or sex s hall be prohibited.
146146 2. Pursuant to the provisions of the Administrative Procedures
147147 Act, the Oklahoma State Regents for Higher Edu cation shall
148148 promulgate rules, subject to approval by the Legislature, to
149149 implement the provisions of this subsection.
150150 B. The provisions of this subsection shall not prohibit the
151151 teaching of concepts that align to the Oklahoma Academic Standards.
152152 1. No teacher, administrator , or other employee of a school
153153 district, charter school , or virtual charter school shall require or
154154 make part of a course, nor shall a school district, charter school,
155155 or virtual charter school compel a teacher, administrator, or other
156156 employee to adopt, adhere to, or profess, the following concepts:
157157 a. one race, ethnicity, national origin, or sex is
158158 inherently superior to another race, ethnicity,
159159 national origin, or sex,
160160 b. an individual, by virtue of his or her race ,
161161 ethnicity, national origin, or sex, is inherently
162162 racist, sexist, or oppressive, whether consci ously or
163163 unconsciously,
164164 c. an individual should be discriminated against or
165165 receive adverse treatment solely or partly because of
166166 his or her race, ethnicity, national origin, or sex,

222222 e. an individual’s moral character is nece ssarily
223223 determined by his or her race , ethnicity, national
224224 origin, or sex,
225225 f. an individual, by virtue of his or her race,
226226 ethnicity, national origin, or sex, bears
227227 responsibility for actions committed in the past by
228228 other members of the same race , ethnicity, national
229229 origin, or sex,
230230 g. any individual should feel discomfort, guilt, anguish ,
231231 or any other form of psychological distress on account
232232 of his or her race, ethnicity, national origin, or
233233 sex, or
234234 h. meritocracy or traits such as a hard work ethic are
235235 racist or, sexist, oppressive, or were created by
236236 members of a particular race , ethnicity, national
237237 origin, or sex to oppress members of another race ,
238238 ethnicity, national origin, or sex.
239239 2. No teacher, administrator, or other employee of a school
240240 district, charter school, or virtual charter school shall be
241241 compelled to participate in instruction, professional development,

294294 subsection.
295295 3. No school district, charter school, or virtual charter
296296 school employee shall organiz e, participate in, or carry out any act
297297 or communication that may violate the p rovisions of this subsection
298298 while acting in the course of his or her official duties.
299299 4. The State Board of Education shall promulgate rules, subject
300300 to approval by the Legislature, to implement the provisions of this
301301 subsection.
302302 C. No school district, charter scho ol, or virtual charter
303303 school shall make distinctions or classifications of students b ased
304304 on race, ethnicity, national origin, or sex.
305305 D. No school district, charter school, or virtual charter
306306 school shall compel a student, teacher, administrator , or other
307307 school employee to discuss public policy issues of the day without
308308 the consent of the student, teacher, administrator, or other school
309309 employee or the written consent of the student ’s parent or legal
310310 guardian if the student is under age eighteen (18). Provided,
311311 however, that the provisions of this subsect ion shall not be
312312 construed to prohibit students, teachers, administrator s, or other
313313 school employees from discussing public policy issues of the day or
314314 ideas that individuals may find unwelcome, di sagreeable, or
315315 offensive.

367367 E. Upon a finding of noncomplian ce with the provisions of
368368 subsections B, C, or D of this section by the State Board of
369369 Education, the noncomplian t school district, charter school, or
370370 virtual charter school sh all be ineligible to receive state funding
371371 for the fiscal years following the ye ar of noncompliance.
372372 F. School district, charter school, and virtual charter school
373373 teachers, administrators, other school employees, and students or
374374 parents or legal guardians of students under the age of eighteen
375375 (18) enrolled in a school district, char ter school, or virtual
376376 charter school may:
377377 1. Seek relief for a violation of this sectio n through the
378378 United States Departm ent of Education Office for Civil Rights; or
379379 2. Have a cause of action for injunctive relief, damages, and
380380 any other relief permitte d by law against the school district,
381381 charter school, or virtual charter school.
382382 SECTION 2. This act shall become effective July 1, 2023.
383383 SECTION 3. It being immediately necessary for the preservation
384384 of the public peace, health, or safety, an emergency is he reby
385385 declared to exist, by reason whereof thi s act shall take effect and
386386 be in full force from and after its passage and approval.
